RECOMMENDATION:
The City Council is requested to :
1. Introduce for first reading by title only and waive further reading of Ordinance No .
17-1026 (Attachment "A"), amending Titles 4 and 9 of the Temple City Municipal
Code (TCMC) to adopt regulations for unattended collection boxes (UCBs ) and other
recycling and collection facilities ;
2 . Waive further reading of Ordinance No . 17-1026;
3 . Schedule the second reading of Ordinance No . 17-1026 for December 5 , 2017 ; and
4. Adopt Resolution No . 17-5295 (Attachment "B") amending the Master Fee and Fine
Schedule for Fiscal Year (FY) 2017-2018 , to establish a new fee for UCB permits .
BACKGROUND:
1. Since May of 2015, the City has received 15 complai nts regarding UCBs. UCBs are
used by a variety of non-profit and for-profit companies to collect prev ious ly owned
materials such as clothes , books , and household goods. The items are then reused
or recycled by the operating company either for profit or to support the mission of
the non-profit. The boxes are often left on public or private property without the
owner or tenant's permission . Donated goods that do not fit into the boxes are left
nearby and appear to be trash and act as an attractive nuisance . Calls to the
operators of the boxes are typically not returned or voicemail systems are full .

Attachment "C" includes a summary report of all cases related to this issue and some
sample pictures .
2. On August 16 , 2017 , the City Manager directed staff to initiate a Zoning Code Text
Amendment adopting regulations for UCBs and other recycling facilities .
3 . On October 10, 2017 , the Planning Commission adopted a resolution
recommending that the City Council adopt the proposed Ordinance as
recommended by staff.
ANALYSIS:
The proposed Ordinance sets up a new permit and process for existing and new UCBs.
The Community Development Director would review permit applications for compliance
with standards such as :

Physical attributes of the UCB ; and
Maintenance of the UCB .
The Ordinance also provides additional regulations on recycling facilities and larger
donation collection facilities . The Ordinance defines two categories -reverse vending
machines and collection facilities -and provides regulations including :
• Zones where the uses are allowed; • Entitlement required for each type ;
• Maximum sizes; • Locational requirements ;
• Sign regulations; • Parking standards ; and
• Lighting requirements ; • Operational and maintenance rules .
The intention of the proposed Ordinance is to create a clearer system of regulating UCBs,
reverse vending machines , and collection facilities . The Community Preservation Staff
has sought to keep these facil ities and boxes from becoming a public nuisance through
the City's public nuisance ordinance (TCMC Section 4-2C). However, this has become
particularly difficult as contacting these operators is very difficult and often ineffective .
When operators do respond , sometimes the boxes are moved to another nearby location
without the property owner's permission. The proposed Ordinance seeks to remedy this
situation by creating a permit process which would require the property owner's
permission and a clear list of operational , maintenance, locational , and other standards .
Staff's recommended ordinance seeks to clarify and provide additional regulations on
facilities that collect salvageable and recycled items . These are classified into four
categories . The smallest are UCBs , which are defined as unstaffed drop off boxes that
accept textiles , shoes , books, household goods , recycled materials , or other salvageable
property . The Ordinance also proposes to regulate reverse vending machines . These
are automated mechanical devices which accept recyclable materials and provide a
redeemable credit slip. They may not be greater than 50 square feet in size and 8 feet in

height. All facilities larger than this are considered a collection facility . A colle ction facility
is a center that collects various salvageable or recyclable material. They may include
mobile units , a group of reverse vending machines , a truck trailer, or a shipping container.
They may not be more than 500 sq uare feet and may not be permanently f ixed to the
ground . Any facility larger than a collection facility is considered a material recycling plant.
The following table summarizes the proposed regulations for each type of facility . For
more detailed information see proposed Ordinance 17-1 026 (Attachme nt "A "). Exhibit "A "
of Attachment "A " includes the new Section regulating UCBs. Exhibit "B" of Attachment
"A " includes the new Section regu lating reverse vending machines and collection
facilities.

Material recycling plants will be prohibited in all commercial and residential zones . A CUP
will be required for proposed plants in the manufacturing zones . Performance standards,

CITY STRATEGIC GOALS:
The City Council is requested to adopt regulations for unattended collection boxes and
other recycling and collection facilities to further the City's Strategic Goals of Quality of
Life and Public Health and Safety.
FISCAL IMPACT:
The review of a new permit for unattended collection boxes would result in an added
expense in the form of additional Planning and Community Preservation Staff time .
Resolution 17-5295 would mitigate this added expense by requiring UCB operators to pay
a permit fee equal to the expected cost of reviewing these applications . Attachment "E"
includes an estimate of the staff t ime and costs associated with the cost of reviewing and
approving these permits . The recommended fee of $170 for the initial permit and $97 to
renew a permit achieves 75 percent cost recovery consistent with other planning fees .

AN ORDINANC E OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
CALIFORN IA, AMEND ING TITLE 4, CHAPTER 2 AND TITLE 9, CHAPTER 1, OF
THE TE MPLE CITY MUNICIPAL CODE PER TAIN ING TO THE REGULAT ION OF
UNATIENDED COLLECTION BOX ES, COLLECTION FACILI TIES , AND
REVERSE VENDING MACH INES
WHEREAS , the City ofTemple City ("City") ha s adopted a General Plan, the Temp le City Zoning Code,
and public nui sa nce regulations to ens ure a well -planned an d safe community and to protect publ ic health,
safety, and welfare; and
WH EREAS , State law requires that the Temple City Zoning Code, found at Title 9, Chapter 1 of the
Temp le City Municipal Code {"TCMC"), co nform with the General Plan's goals and policies; and
WHEREAS, it is necessary f ro m t ime to time to update the Temple City Zoning Code to bring it into
conformity with State law and to address public hea lth, safety, and welfare concerns that have arise n since
its last update; and
WHEREAS, since May of 2015 the City has re ceived 15 complaints involving unattended collection
boxes and recycling facilities. Trash and debris col lects around these facilities and boxe s. Donations can
pile up beyond the capacity of th e facilities leading to an attractive nu isance and the scattering of loose
trash and debris. They are vandalized . They are pl aced on private property without owner or tenant
approva ls. They are left in the public right of way a nd on city owned properties without permission.
Contact i nformation is often out-of-date or voicemail boxes are full and complaints cannot be left. In
instances where contact can b e mad e, messages are often not returned. The fa cilities obstruct circulatio n,
traffic, and p arking includ i ng that in the public right of way. Complaints r egarding these facilities h ave
become more frequent and regul ar si nce Jan uary of 2017; and
WHER EAS , the City wishes to consider clearly defined rules for the es tablish ment of unattended
collection boxes, collection fac ilities , and reverse vending machines to address the publ ic health, safety,
and general welfare issues t h at have been the subject of numerous compl aints; and
WHEREAS , on October 10, 2017 the Planning Commission held a notice d publ ic hearing on this
item to rece ive public comment and to make a recomm endatio n to the City Counci l; and
WHEREAS, City Counci l held a noticed public hearing o n November 7, 2017; and
WHEREAS, on November 7, 2017, the City Council introduced for f irst reading by title only Ordinance
No. 17 -1026; waived further r ea d ing; an d sc heduled a secon d reading and adoption of the ordinance for
November 21, 2017.
THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDAINS AS FOLLOWS :
SECTION 1 : Section 4-2C-2.A ofthe TCMC is amended by adding Section 4-2C-2.A.44, as follows:
"44. Any Unattended Collection Box not in conformance with the regulations of Section 9-lT-11 ."

more types of empty beverage co ntainers in cl udi ng al uminum cans , gl ass, and p las t i c bottles,
and issues a cash refund or a re de e mab l e credit sl ip w ith a va lue not less than the conta iner's
r ede mption value as dete rmin ed by state l aw . A reverse vending machine may sort and process
containers mechanically p rovi d e d th at th e e ntire process i s e n cl o se d within th e ma chi ne. To
accept and tempo r ar ily store all conta i ner types i n a proportion commensurate with their
rel ativ e r edemption rates, an d to meet th e requirements of certification as a recycling faci lity,
multipl e grouping of r everse vending machin es may b e n ecessary, in which ca se the mach ines
are considered a collection f acil ity. A reve rse ve nding mach ine is considered a n access ory to a
primary use. Reverse vend i ng machi n es a r e no g r ea t er t h an 50 sq u are feet in siz e and 8 f eet i n

SECTION 11: The City Co u ncil declares that, sho uld any provision , secti on, subsectio n, paragraph, sentence,
clause, phra se, or word of t his Ordinance be r en dered or declared invalid or unconstitutional by any final
court action in a court of com petent jurisdi ct ion or by reason of any preemptive legislation, such dec is ion or
act io n would not affect the validity of the remaining section or portions of the Ordi nan ce. The Ci t y Council
decla res that it would have independe ntly adopted the rema in i ng provisions, sections, su bsec t ion s,

A. General Provisions:
1. Purpose : The pu r pose of these regu lations is to promote the health, safety, and/or welfare of
the pub lic by providing minimum nuisance-related performance standards for the operation of
unattended col lection boxes (UCBs). This include s establ ish i ng criteria to ens u re that material is
not allowed to accumu late outside of the UCBs, the UCBs remain free of graffiti and other
nu isances, UCBs are maintained in sanitary conditions, and users are fully informed of those who
operate the UCBs so that they can be contacted if there are any nu isance -re lated questions or
concerns.
2 . Vio lations: Fai l ure to comply with any of the provisions of this Section 9-lT-11 is declared to be
prima facie evidence of an existing v io l ation and a dec lared public nuisance, and may be abated
by the director in accordance with the provisions of Section 4-2C -2 (Pub lic Nuisances). Any
person in violation may be subject to administrative pena lties, citations, civ il act i on, or other
legal remedies.
3. Responsibility: The property owner and the UCB operator (operator) have joint and severa l
liabi l ity for pub l ic nuisance cond it ions and comp liance with this chapter, including fees,
administrative citations, civil actions, and/or l ega l remedies re l ating to a UCB. The property
owner remains li ab le for any v io lati on of duties imposed by this Section 9-lT-11 even if the
property owner has, by agreement, imposed on the operator the duty of comp lying with the
provisi ons of t hi s Section 9-lT-11.
4. Definitions: The fo llowing definitions app ly on ly to Section 9-lT-11.
AGENT: A person who is authorized by t he property owner or UCB operator to act on their
behalf to be t h e app licant for a UCB permit. To be considered an agent, a person must be
given express wri tten authorization on a form provided by the city to app ly specifi cally for a
UCB permit. For this Section 9-lT-11, a person who is on ly given general authorization to act
for various activities and transactions regarding a property is not cons idered an agent.
DIRECTOR: The d i rector of the Community Deve l opment Department or their designee .
NUISANCE OR PUBLIC NU ISANCE: The conditions as set forth in Temple City Municipa l Code
Section 4-2C -2 (Prohibited Public Nuisance Conditions).
OPERATOR: A person or entity who operates or maintains any UCB.

a. Re newa l Permit Application Timing: A UCB ope rat or may apply for permit renewal by
sub mitting to the Community Development Depa rtment at least 30 days prior to the
exp iration of the active UCB perm it . Late sub mittal s may b e processed as n ew applications.

made o n a form provided by the Commu nity Deve lo pment Department. Al l applications
must be f il ed with th e Commun ity Development Department and include th e items l isted

c. Timing of Review : The direct or will e ith er approve or deny the renewal of a UCB permit
within 30 days of receipt of the co mpl ete renewal application and payment of the renewal
fee . The fa ilure o f the Commu ni ty Development Department to act w ithi n this timeframe
will cons titute approval of the UCB p erm it renewal.
d . Findin gs for Revi ew: The director wi ll approve the renewal of a UCB p ermit if the director
finds that no c ircumstances ex i st ed during th e t e rm of the UCB perm it, or ex isted at any
time d uring the re view of the app li catio n for re newa l, th at are incons iste nt with any criteria
required for approval of a n ew UCB pe rmi t as specified in Section 9-lT-11 .8.4 (Findings f or

in Sect ion 9-1T-1l.D (Revocat i o n of Permit).
e. Remova l if Permit Expires o r Is Not Renewed: If the permit expires and is not renewed, the
col lection box must be removed from the real property within 15 days after expiration of
the permit .

each of the fo ll owin g is true:

to any UC B m ana ged by the proposed operato r;
c. All exis ting un permitted UCBs that are managed by the proposed operator have been
removed or the director at h is discretion may all ow an unpermitted UCB to r emain during
the perm it process if it otherwise co mplie s with the re q u irement s of th is sect ion ;
d. Any ve rifi ed p ubl ic nuisance o n th e subject property ha s been abated and any case of a
complaint to the city regard in g nuisa nce conditions on the subject property ha s been
closed; and

e . The proposal is consistent with all the requirements of this Section 9-lT-11.
f . For ren ewa l s, the si te does not have a history of being an attractive nui sance even if
incidents of nuisances were abated. For this su bsection, "history of attractive nuisance"
means three verified nuisance comp l aints in the previou s 12 months.
5. Time Limit for Final Decision: The d irector will provide a written decision regarding the
placement of a UCB within 60 days of the su bm ission of a complete app li cation for a UCB
permit.

exempted by Section 9-1T-1l.B.1.a (Second UCBs).
d. Dwelling Units: No UCB may be al l owed on a lot with a re sidential dwell i ng unit.
e. Vacant Lot s: No UCB may be allowed on a lot w ithout a main building.
f . Occupied Structure: A UCB i s on ly permitted on a lot that also co ntains a main building

to be r epaired, removed , and/o r abated include, but are not limited to g r affiti, removed,
or damaged signs and notifica tions, p eeling paint, ru st , and broken co ll ection operating

provision s of t he Temple City M un ic ipa l Code, or any ot he r l aw.
2. Notice o f Revoca tio n : The director will provide a writ t en notification to the permittee and
property owne r st atin g the specific gr o un ds for a revoca tion and a demand for correction and
abatement. The n ot ice will allow the permittee up t o 15 days from mailing of the notice to
correct or aba t e th e viola t ion. Upon f ailure to make the correction or abatement , the director
will revoke t he p ermit . Afterwards, the permittee wi ll not be eligible for a permit at any
location f or one ca len dar year.
3. Remova l of Revo ked UCB: Upo n revocati on, or if appea led, after any appea l as set forth in
Sec t io n 9-1T-11.F (Appea l t o t h e Pl an n in g Commissio n), t he collection box wi ll be removed
fro m t he rea l property wit hin 15 da y s by the permittee. If th e UCB is not removed with i n 15
days, the ci t y may remove, store o r d is p ose of the UCB at the expense of t h e pe r mittee or
property owne r . Th e property own er w ill be responsi bl e for all costs associated with the
remova l of t he UC B incurred by the ci t y . Costs may be pursued by t he city pursuant to Section
4-2C of the Te m ple City Municipa l Code.
4. Violation of Ot he r Laws: A permit for a UCB may be revo ked if any governmental authority or
agency de t erm ines t hat the UCB has vio lated the Ca lifo rni a Consumer Protection Act and/or
the Ch aritab le Orga ni zations and Solicitations Act.

1. Content of Removal Sign : Any UCB scheduled to be removed by either order of the city or
the ope r ato r must cl early d isplay a notice on the UCB with at least four-inch type visible from

REMOVED BY" followed by th e date th e UCB is sched uled for removal. Th e ope r ator and
property owners are jo intly and seve r ally responsible for th e placement of the notice .
2. Public Right of Way : Unp ermitt ed UCB s in the public r ight of way may be removed witho ut
prior notice to the owner. The City shall notify the owner within one bu sines s day after
removing the UCB and shall sto r e th e item for 14 calen da r days after notice is given . If no
communication is re ceived by the owner of the UCB withi n 14 ca lendar days of r eceiving notice
the City may dispose of th e UCB . Th e owner of the UCB shall be given 14 d ay s to retrieve the
UCB .
F. Appeal to the Planning Commi ssion: Any person aggrieved by th e decision rendered by the director
in granting, denyin g, or revoking any appl ication for a permit under this Se ction 9-lT-11
{Unattended Collection Box) may appeal the decision to the Planning Commission ac cord ing to the
requirements of Section 9-1E-4 (Appeals).

machine or co ll ection f acil ity, must com ply w ith all provisions of Section 9-lT-12 before operating in

Manufacturing Districts, subject to zoning cl earance, pursua nt to Section 9-1E-7 , and compliance
w ith the follow in g standards.

b. Indoor Loca tions: If located ins id e a st r u ct ure, t he reverse vendi ng mac hin es must be with in

including any pro t ective enclos ure, and may not be more than eig ht feet in height. A reverse

i. Must be set back at least 45 feet from any public right-of-way, and not obstruct
pedestrian or vehicular circu lati on and
ii. Must permanently locate any containers provided for after-hours co ll ection of recyclab le
materials at least 30 feet from any property zoned or occupied for res id ential use .
b. Maximum Size: Collection facilities may not be larger than 500 square feet and may not
occupy more than three parking spaces, except for spaces that wi ll be periodically needed for
remova l of material s or exchange of conta in ers.
c. Appeara nce of Facility: Collection facilities , site fencing, and signs must be of a co lo r and
design compatible with the su rroundin g uses and neighborhood.
d . Landscaping and Screening: The co lle ction facility:
i. May not reduce or eli minate any required landscap ing;
ii. Must be screened from view from adjacent public rights-of-way using fences, landscape,
or other approved materials; and
iii. Must be subject to add itional landscaping and screening as determined through
cond itional use permit.
e. Park ing Requirements:
i. No ad dition al parking space is required for customers of a collection facility lo cated in the
estab li shed parking lot of the main use .
ii. Mobile or portable collec tion facilitie s must have an area clear ly marked to prohibit other
vehicu lar parking during hours when the mobile co lle ction facility is sc heduled to be
present.
iii . Use of parking spaces by the facility and by the emp loyee may not reduce available
parking spaces below the minimum number required for the main use unless a parking
study shows th at existing capacity is not fully utilized during the time the collection facility
wi ll be on the site .
f . Signs: Signs may be provided as follows:

i i. The sig n must contain the hours of operat ion , redempti on va lu es, and the name of the
operator or prop erty owner; and
g. Operating Sta nda rds: Collection facilities :
i. May not accept household hazardous waste , electro nic waste , or other products that may
cause a ri sk to the health and sa f ety of the com munity;
ii . May not use any power-d ri ven pro cess in g equ i pment except for reverse vending
machines;
ii i. Must use containers that are constructed w ith durable waterproof and rustproof
material, that are covered w hen the si t e is not attended, secured from unauthorized
remova l of material, and of a capacity sufficient to accommodate mate r ials collected
and the co lle ction schedu l e;
iv. Must store all materials in co ntain ers or in the mobile unit ve h ic le, and may not leave
materials outside of co ntainers when attendant is no t present; and
v . Mobile faci lities, at which trucks or conta in ers are removed at the end of each col lection
day, must be swept at the en d of each collection day.
h. Hours of Operation: Attended facilitie s located w it hin 100 feet of a property zoned or
occupied by a resident ial use may only operate between the hours of 9:00a .m . and 7 :00
p.m .
i. Tras h Enclosure: The col lec tion facility must either use th e tra sh dumpste r for the primary
use or co nstruct an adjacent fu ll y enc losed trash enclo su re , w ith a si x-foot concerte block
wa ll and a metal gate, surrounde d with a min imum of three feet of automatically irrigated
landscaping .
3. General Standards: All reverse vendi ng machines and co ll ection facilities must comply with the
f ollowing sta ndards :
a. Signs: Recycling and collection facilitie s maybe provide d identification and in formationa l
sig ns, as fo ll ows, provided t h at all signs meet the sta nda r d s of t h e app li ca bl e zon ing district.
i. All co ll ec tion f aci lities and r everse vending machines must be clear ly marked to iden t ify
the type of materia l which may be deposited , and display a notice stating that no
material shal l be left outside t he enclosure or mach ine; and
ii. The recycl in g and collection faci l ity must be clea rly marked to identify the name and
teleph o ne num ber of the operator and the hours of operation .

iii. Directiona l signs bearing no advertising message , may be installed with prior approval of
the di r ecto r if found necessary to facilitate traffic circulation or if the collection facility is
not visib le f rom t he public r ight -of-way.
b . Refuse Disposa l : Sites with reverse vending ma chines and co ll ection fac i lities must maintain
adequate on-site r efuse containers for the disposal of n on -re cycla ble, non -hazardous waste.
Trash cans sha ll be placed adjacen t to facilities and be emptied periodically so as not create
litter in the adjacent area .
c. Maintenance and Cleanliness: The site mu st be maintained clean , sanitary, and free of litter,
waste materials, and loose debris. Temporari ly stored materials m ust be moved to an
approved p rocessing site as soon as pract ical.
d . Locations:
i. Dwelling Units : No reverse vending machine or co l lection facility may be allowed on
a lot with a r esidential dwell ing unit.
ii. Vacant Lots: No reverse vend ing mach i ne or co llect ion facility may be allowed on a
lot wit hout a main building .
iii . Occupied Structure: A reverse vend i ng mac hi ne or collection facility is on ly
permitted on a lot that al so contains a main bu ild i ng t h at contains at l east one

A NEW FEE FOR UNATIENDED COLLECTION BOX
PERMITS
WHEREAS , the City Co un ci l of the City of T emple C ity desires to defray the costs
of providing va ri ous programs , services , and fac ilities ; and
WHEREAS , the City Council has rece ived and cons idered information about the
actual cost of providing such programs, services , and facilities ; and
WHEREAS , the City Council held a duly noti ced public hearing on November 21 ,
2017 , to consider amending the updated Maste r Fee and Fine Schedule for Fiscal Year
2017-18 to establish a new fee for unattended col lection bo x permits .
NOW, THEREFORE , the City Council of the City of Temple City does hereby
resolve , find , determine , and order as follows :
SECTION 1. The proposed permit fee for unattended collection boxes is reasonably
necessary to recover the costs of providing the programs , services , and facilities for which
such fees are levied or authorized to be levied .
SECTION 2. The Ci ty Master Fee and Fine Schedule is amended to estab li sh fee
number PL-34 for Unattended Collection Bo x Perm its in the amount of $170 and fee
