CALL TO ORDER AND ROLL CALL
Mayor Aymon called the regular meeting of the McCall City Council to order at 5:30 p.m.
Mayor Aymon, Council Member Giles, Council Member Holmes, Council Member Nielsen, and
Council Member Sowers all answered roll call.
City staff members present were Anette Spickard, City Manager; Bill Nichols, City Attorney;
BessieJo Wagner, City Clerk; Linda Stokes, City Treasurer; Michelle Groenevelt, Community
Development Director; Kurt Wolf, Parks and Recreation Director; Jay Scherer, Airport Manager; Eric

Mayor Aymon led the audience in the Pledge of Allegiance.
APPROVE THE AGENDA
Council Member Holmes moved to approve the agenda as submitted. Council Member Giles
seconded the motion. In a voice vote all members voted aye and the motion carried.
CONSENT AGENDA
Staff recommended approval of the following ACTION ITEMS. All matters which are listed within
the consent section of the agenda have been distributed to each member of the McCall City Council
for reading and study. Items listed are considered routine by the Council and were enacted with one
motion.

6. AB 19-006 Request to approve Escrow Agreement Amendment for Silverpine Village:
Planned Unit Development PUD-16-01, SUB-16-04: Silverpine Village, a thirty (30) unit
townhome development adjacent to the Alpine Village Phase 1 plaza, is currently under
construction. In order to record the project's subdivision plat prior to completion of all of the
infrastructure and site improvements, the applicant entered into a Development Agreement
with the City of McCall (approved by Council on July 13, 2017) and provided financial
assurances through an Escrow Agreement for the incomplete items. The Escrow Agreement
expired December 31, 2018. Therefore, an Amendment to the Escrow Agreement is needed
to extend the financial assurances through project completion anticipated to occur during the
2019 building season. Motion: Approve the First Amendment to Silverpine Village Escrow
Account Agreement and authorize the Mayor to sign all necessary documents.
7. AB 19-005 Request Approval of the FY18 Annual Road and Street Financial Report:
Pursuant to IC §40-708, it is state policy that highway user revenues accruing to the state
highway account be spent exclusively for the maintenance, construction and development of
highways and bridges in the state highway system. All moneys apportioned to cities from the
proceeds from the imposition of tax on fuels and from any tax or fee for the registration or
operation of motor vehicles for general highway construction and maintenaince, bridge and
culvert moneys, will be accounted for as to the acutal expenditure to the state controller, as
dedicated funds through the Annual Road and Street Financial Report. This report is for the
preceeding fiscal budget year, and is published once as a legal notice between January 1 and
Januay 15. Motion: Approve the FY18 Annual Road and Street Financial Report and authorize
the Mayor to sign all necessary documents.
8. AB 19-003 Request to Approve Resolution 19-01 McCall City Council Meeting Schedule
for 2019: McCall City Code §1-8-2 states that regular Council meetings will be held on the
second and fourth Thursdays of each month except when such regular meetings fall on a legal
holiday, then the meetings would be held on the preceding day unless otherwise fixed by the
Council. In past years the Council has elected to alter the regular Council meetings to
accommodate the holidays and prevent having a regular meeting on 2 consecutive weeks. The
recommendation is for January, November, and December Council meetings fall on the First
and Third Thursdays and for the remaining months the meetings will fall on the Second and
Fourth Thursdays. Motion: Approve Resolution 19-01 adopting the McCall City Council
Meeting Schedule for 2019 and authorize the Mayor to sign all necessary documents.
9. AB 19-002 Request to approve Finding of Fact, Conclusions of Law, and Decision of
Approval of Appeal for Record of Survey ROS-18-19 Lot 8 Reserve on Payette: During
their regularly scheduled September 11, 2018 meeting, the McCall Area Planning and Zoning
Commission unanimously approved ROS-18-19. During their regularly scheduled October
25, 2018 meeting, the McCall City Council heard the appeal regarding condition 1 A and
tabled the application for further study. During their regularly scheduled December 13, 2018
meeting, the McCall City Council unanimously approved the appeal, as modified by the
revised survey submitted on December 13, 2018, and directed staff to prepare revised Findings
of Fact and Conclusions of Law for the January 3, 2018 meeting. The revised Record of
Survey submitted by the applicant on December 13, 2018 provides a public access easement
across the subject parcel, Lot 8, so that a pathway can be provided for public use to a small

river access parcel at the south boundary of Reserve on Payette Subdivision. Findings
documenting Council's approval of the Record of Survey as presented in the December 13,
2018 submittal and approval of the associated appeal thereby removing a condition of P&Z
approval that required the public easement to be established on the neighboring property is
now owned by the Payette Lakes Recreational Water and Sewer District. Motion: Approve
Findings of Fact, Conclusions of Law and Decision of Approval of Appeal for Record of
Survey ROS-18-19 Lot 8 Reserve on Payette an authorize the Mayor to sign all necessary
documents.
Council Member Holmes moved to approve the Consent Agenda as submitted. Council Member
Sowers seconded the motion. In a roll call vote Council Member Holmes, Council Member
Sowers, Mayor Aymon, Council Member Giles, and Council Member Nielsen all voted aye, and
the motion carried.
DEPARTMENT REPORTS
Community Development
Community & Economic Development Director Michelle Groenevelt answered questions about deed
restricted projects, and water front project with urban renewal.
Golf Course
Golf Superintendent Eric McCormick clarified the restaurant hours and reported on the dog waste
cleanup efforts.
Library
Library Director Meg Lojek reported on the Winter Carnival activities and shared info about
cooperative living for possible workforce housing.
Parks & Recreation
Parks & Recreation Director Kurt Wolf answered questions about the water front project, citizens
renting city equipment, snow removal on the sidewalks, safety signs on the ice at Legacy Park, and
the Christmas lights.
Police
Police Chief Justin Williams answered questions about parking and road violation procedures.
Public Works
Public Works Director Nathan Stewart answered questions about parking signs, snow removal, and
bidding and traffic control issues for the downtown project.

PUBLIC HEARING
AB 19-007 Request to Adopt an Ordinance for Code Amendment 18-04: Amending McCall City
Code Title 9, Chapter 8 — Flood Control Regulations
Mayor Aymon opened the public hearing at 6:07 p.m.
Public Works Director Nathan Stewart presented the Ordinance for Code Amendment 18-04:
Amending McCall City Code Title 9, Chapter 8 — Flood Control Regulations. The Federal Emergency
Management Agency (FEMA) has created a new Flood Insurance Study (FIS) and new Flood
Insurance Rate Maps (FIRMs) for McCall and the surrounding area. These maps identify flood risk
and help assign insurance rates for flood insurance provided through the National Flood Insurance
Program (NFIP). Staff has been working with FEMA over the past three years to identify and confirm
the accuracy of the new FIRMs throughout the City and its impact area. The new FIRMs are going
into effect on February 1, 2019. These maps will provide better quality data than the existing maps
and removes 403 parcels from the floodplain while including 88 new parcels. Communities must
adopt the new FIS & FIRM prior to the February 1, 2019 date via the proposed Code
Amendment/Ordinance, or McCall will be automatically suspended from the NFIP.
In addition to adopting the new FIS and FIRMs, the proposed ordinance brings McCall's flood control
regulations into compliance with the Idaho State model Flood Damage Prevention Ordinance, which
has been approved by the State of Idaho as well as the Federal Emergency Management Agency
(FEMA). It also designates the City Planner as the City's Floodplain Administrator. McCall Planning
and Zoning Commission unanimously recommended approval of the proposed code amendments at
their 12/3/18 meeting. The Valley County Board of Commissioners adopted the ordinance (19-02) on
October 29, 2018.
Staff gave a brief history of the process and explained issues.
Receiving no comments and no written correspondence, Mayor Aymon closed the public
hearing at 6:17 p.m.
Council Member Holmes moved to suspend the rules and read by title one-time only Ordinance
977. Council Member Giles seconded the motion. In a roll call vote Council Member Holmes,
Council Member Giles, Mayor Aymon, Council Member Nielsen, and Council Member Sowers
all voted aye, and the motion carried.

City Clerk BessieJo Wagner read by title only one-time only Ordinance Number 977
An Ordinance of the City of McCall, Valley County, Idaho repealing & reenacting Chapter 8, Flood
Control Regulations (Overlay), of Title 9, Subdivision And Development, of the McCall City Code to
update the floodplain management regulations for the City of McCall and its areas of impact by
enacting Sections 9.08.01, Statutory Authorization, Findings of Fact, Purpose, and Objectives,
9.08.02, Definitions, 9.08.03, General Provisions, 9.08.04, Administration, 9.08.05, Provisions for
Flood Hazard Reduction, and 9.08.06, Legal Status Provisions, and providing an effective date.
Council Member Holmes moved to adopt Ordinance No. 977, approve the summary for
publication and authorize the Mayor to sign all necessary documents. Council Member Sowers
seconded the motion. In a roll call vote Council Member Holmes, Council Member Sowers,
Mayor Aymon, Council Member Giles, and Council Member Nielsen all voted aye, and the
motion carried.
The City Planner is designated Flood Plain Administrator.
PUBLIC COMMENT
Mayor Aymon called for public comment at 6:20 p.m.
Hearing no comments, Mayor Aymon closed the comment period.
PROCLAMATION
AB 19-001 Request for a School Choice Proclamation from Andrew Campanella, President
National School Choice Week
City Clerk BessieJo Wagner presented the School Choice Proclamation. Mayor Aymon received a
request for the City Council to consider a School Choice Proclamation from Andrew Campanella,
President National School Choice Week. In his email he wrote the following:
We are respectfully requesting that you consider joining dozens of city and county leaders across the
country in officially recognizing January 20-26, 2019 as School Choice Week in McCall. National
School Choice Week (NSCW) will feature an unprecedented 40, 000+ events nationwide.
National School Choice Week is entirely nonpolitical and nonpartisan, and we do not advocate for
or against any legislation. Our goal is simply to raise awareness, among parents, of the public and
nonpublic K-12 education options available to their children. Last year, more than 720 mayors and
county leaders, along with 32 governors, the unanimous United States Senate, and the President
issued proclamations recognizing NSCW.
Council discussed the merits of public and private schools. Mayor Aymon pointed out the Council
has voted no in previous years for this proclamation. Mayor Aymon and Council Member Giles are
supporters of public schools and did not feel it was appropriate to make this proclamation. Council
Member Sowers did not see how the proclamation would be against public schools in anyway but
rather to support education awareness of school choice.

Council Member Sowers moved to proclaim January 20-26, 2019 as McCall School Choice
Week and authorize the Mayor to sign the proclamation. Council Member Nielsen seconded
the motion. In a roll call vote Council Member Sowers, Council Member Nielsen, and Council
Member Holmes all voted aye, Mayor Aymon and Council Member Giles voted no, and the
motion carried.
BUSINESS AGENDA
AB 19-004 Request to Adopt Ordinance 975 Amending McCall City Code Title 5, Public Safety,
Chapter 6, Vehicle and Boat Regulations, Subchapter B, Parking Regulations
Police Chief Justin Williams presented the third reading of Ordinance 975. McCall City Council
reviewed the recommended changes to McCall City Code Title 5, Public Safety, Chapter 6, Vehicle
and Boat Regulations, Subchapter B, at their October 11, 2018 and December 13, 2018 City Council
Meetings no changes were made.
McCall City Attorney, William Nichols has reviewed the document and explained how the Council
can address making changes. Police Chief Williams explained his support of the changes.
A discussion ensued with each Council Member sharing their support or issues with the ordinance.
Council Member Giles is good with it as it stands. Council Member Sowers feels it is blanket coverage
and may not be necessary for all streets. Chief Williams states the City cannot pick and choose which
streets. Council Member Sowers is concerned for people who need to have a place to park a trailer in
the street and wondered if there is another way to address the hazard. Council Member Nielsen feels
Section A, addressing parking in the central business district, is too restrictive and is arbitrary for
people passing through and want to stop for food. He also suggested alternate side parking (park on
one side one day and then the other side other days) as an option to ensure snow removal happens.
Public Works Director Nathan Stewart stated that if the parking rules are difficult then people will
not follow the rules and creates issues with snow removal without damaging personal property and
cautioned against making rules hard to enforce. He stated this ordinance is to be used as a tool. Council
Member Nielsen is concerned about arbitrary enforcement.
There was a discussion about additional parking areas for trailers and whether it is the responsibility
of the City to provide the parking. Council Member Nielsen feels there are many extenuating
circumstances and reasons for a person to park a trailer on the street and thinks the ordinance is too
restrictive. He thinks it is possible to target certain areas rather than a blanket coverage. He thinks
this is the wrong approach to take. Mayor Aymon feels the trailer parking creates a safety issue.
Council Member Holmes feels the ordinance is a little over reaching. Council Member Giles
suggested the three Council Members with concerns come back with some alternate suggestions.
Council Member Holmes would like to do changes in steps such as start with the pathways and bike
lanes first and then address other issues as needed. Council Member Giles pointed out the bigger issue
with Roosevelt is more than just a bike path issue.
City Attorney Bill Nichols made some recommendations. Some of the issues are a global problem
and should be addressed in a work session. But if the code was left alone, the current code already
states it is illegal to park in residential areas with some provisions for commercial operators. He stated
the changes are a liberalization of what is already in place. He went over the changes explaining each
one and made some suggestions of how to approach the ordinance.

The Council discussed at length with differing opinions and options. Police Chief Williams explained
these changes were a request that came from outside of the Police Department and staff has been
working on the code revision over the last three years. He also stated the only real solution for boat
parking is to create parking lots. Community & Economic Development Director Michelle
Groenevelt suggested a work session to give a back history and asked the Council to summarize their
concerns and ideas and email to staff to address. Mayor Aymon and Council Member Giles did not
have anything to add as they like the ordinance as it stands and would prefer to wait until the work
session to make comment. Council Member Holmes stated her main issue is enforcement on what is
already called out and on the bike lanes and pathways. Council Member Nielsen would like a
friendlier accommodation to trailer parking. Council Member Sowers would like more relaxed
approach for trailer parking.
Since this is a the 3rd reading of the ordinance, City Attorney Bill Nichols reminded the Council a
motion is necessary to either approve or table for further discussion.
Mayor Aymon moved to table Ordinance 975 until after the work session. Council Member
Giles seconded the motion. In a voice vote all members voted aye and the motion carried.
