CALL TO ORDER Mayor Sternquist called the City Council Regular Meeting to order at 7:31 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember—Fish, Yu, Man, Sternquist ABSENT: Councilmember— Chavez ALSO PRESENT: City Manager Cook, City Attorney Vail, City Clerk Kuo Councilmember Yu made a motion to excuse Councilmember Chavez for cause. Seconded by Councilmember Fish. 3. INVOCATION Father Nick Assi, St. Luke's Catholic Church, 5605 Cloverly, provided the Invocation. 4. PLEDGE OF ALLEGIANCE Steve Stafford, Temple City resident, led the pledge of allegiance. 5. CEREMONIAL MATTERS — PRESENTATIONS A. LONGDEN ELEMENTARY SCHOOL ROBOTICS TEAM Longden Elementary School Robotics Team gave a demonstration of their robots. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Lucy Liou, Temple City resident, reminded the community to stay vigilant during the holiday season. 7. CONSENT CALENDAR Mayor Pro Tem Man made a motion to approve the Consent Calendar Items. APPROVAL OF MINUTES The City Council is requested to review and approve: 1. Minutes of the Special City Council Meeting of November 29, 2017; and 2. Minutes of the Regular City Council Meeting of December 5, 2017. City Council Minutes December 19, 2017 Page 2 of 7 Action: Approved. I B. PLANNING COMMISSION ACTIONS The City Council is requested to receive and file Actions of the Regular Planning Commission Meeting of November 28, 2017. Action: Received and filed. C. APPROVAL OF AGREEMENT NO. 17-031C WITH NICHOLS CONSULTING ENGINEERS, CHTD. TO UPDATE THE PAVEMENT MANAGEMENT PROGRAM The City Council directed staff to start the process of updating the 2013 Pavement Management Program. Four proposals were received in response to the Request for Proposals. Nichols Consulting Engineers submitted the most comprehensive proposal that demonstrates the best understanding of the project. Action: Approved a budget amendment for the Fiscal Year 2017-18 City Budget to allocate $63,200 from unallocated gas tax fund balance to Account No. 21-960-75-4257 Street Maintenance; 2. Approved Agreement No. 17-031C with Nichols Consulting Engineers, Chtd. (NCE) for $63,200 to update the Pavement Management Program (PMP); and 3. Authorized the City Manager to sign and execute Agreement No. 17-031 C. ' D. FOURTH AMENDMENT AND RESTATEMENT OF THE JOINT POWERS AGREEMENT (JPA) WITH SAN GABRIEL VALLEY COUNCIL OF GOVERNMENT (SGVCOG) The Fourth Amendment to the JPA revises the structure of the SGVCOG and extends the role of the SGVCOG in developing and constructing projects in the San Gabriel Valley, and restructures and integrates the Alameda Corridor East Construction Authority (ACE), as well as clarify member tort liability and indemnification obligations of member agencies under the JPA. Action: Adopted Resolution 17-5297 approving the Fourth Amendment and Restatement of the Joint Powers Agreement (JPA) with San Gabriel Valley Council of Governments (SGVCOG). E. SECOND READING AND ADOPTION OF ORDINANCE NO. 17-1030 AUTHORIZING THE CITY TO ENTER INTO A JOINT POWERS AGREEMENT FOR LOS ANGELES COMMUNITY CHOICE ENERGY AND AUTHORIZING THE IMPLEMENTATION OF A COMMUNITY CHOICE AGGREGATION PROGRAM The City Council is requested to adopt Ordinance No. 17-1030 which was introduced on December 5, 2017, authorizing the City to enter into a Joint Power Agreement for Los Angeles Community Choice Energy. Action: Waived further reading and adopt Ordinance No. 17-1030 ' authorizing the City to enter into a Joint Power Agreement for Los Angeles Community Choice Energy and authorizing the implementation of a Community Choice Aggregation program. APPROVAL OF MEMORANDUMS OF AGREEMENT (MOA) REGARDING THE ADMINISTRATION AND COST SHARING FOR IMPLEMENTING THE ENHANCED WATERSHED MANAGEMENT PLAN (EWMP) ASSOCIATED TASKS AND THE COORDINATED INTEGRATED MONITORING PROGRAM (GIMP) FOR THE UPPER LOS ANGELES RIVER WATERSHED MANAGEMENT AREA These Memorandums of Agreement have a term of five years and serve to ensure Temple City's compliance with the municipal separate storm sewer systems MS4 Permit. The City of Los Angeles will be performing all monitoring and reporting tasks on behalf of the member agencies of the Upper Los Angeles River Watershed Group. The San Gabriel Valley Council of Governments will serve as administrator of the MOAs. Community Development Director Forbes gave a brief summary of the staff report. Action: 1. Approved the Memorandum of Agreement between the members of the Upper Los Angeles River Watershed Group and the San Gabriel Valley Council of Governments regarding the administration and cost sharing for implementing the Enhanced Watershed Management Plan associated tasks and the Coordinated Integrated Monitoring Program for the Upper Los Angeles River Watershed Management Area; and 2. Authorized the Mayor to sign the MOAs. G. ADOPTION OF RESOLUTION NO. 17-5302 ADOPTING REVISED SALARY RANGES FOR ' UNREPRESENTED PART-TIME CLASSIFICATIONS IMPLEMENTING MINIMUM WAGE In order to ensure compliance with the State of California's minimum wage law, two of the part- time position classifications (i.e., Recreation Leader I and Recreation Aide) need to reflect a starting salary of at least $11.00 per hour. Action: Adopted Resolution No. 17-5302 adopting salary ranges for unrepresented part-time classifications implementing minimum wage. H. ADOPTION OF RESOLUTIONS AMENDING THE PERSONNEL RULES FOR FULL TIME AND PART-TIME EMPLOYEES In order to ensure compliance with the regulations of the Department of Fair Employment and Housing, limiting California employers' use of criminal history when making employment decisions, the City Council is requested to adopt the proposed resolutions and amend the Personnel Rules for part-time and full time employees. Action: 1. Adopted Resolution No. 17-5303 amending the Personnel Rules for full time employees; and 2. Adopted Resolution No. 17-5304 amending the Personnel Rules for part-time employees. I. PETTY CASH REPORT ' The City Council is requested to receive and file the Petty Cash Report. Action: Received and filed. City Council Minutes December 19, 2017 Page 4 of 7 J. ADOPTION OF RESOLUTION NO. 17-5305 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2017-18 ' The City Council is requested to adopt Resolution No. 17-5305 authorizing the payment of bills. Action: Adopted Resolution No. 17-5305. 8. PUBLIC HEARING A. TRAFFIC SAFETY REVIEW ON DAINES DRIVE BETWEEN BALDWIN AVENUE AND EL MONTE AVENUE The City Council is requested to review and approve the proposed traffic and pedestrian safety measures on Dairies Drive and hold a public hearing regarding the removal of the east leg crosswalk on Dairies Drive at Gracewood Avenue. Public Safety Supervisor Ahizumi gave a brief summary of the staff report. City Council asked questions and made comments regarding removal of the east leg crosswalk on Dairies Drive at Gracewood Avenue. Mayor Sternquist opened public hearing. Steve Stafford, Temple City resident, spoke against removal of the east leg crosswalk on Dairies Drive at Gracewood Avenue. Hearing no further request to speak, Mayor Sternquist closed public hearing. ' Councilmember Fish made a motion to adopt Resolution No. 17-5301 approving the traffic and pedestrian safety measures recommended by the Transportation and Public Safety Commission, and approved a budget amendment in the amount of $30,000 to implement the approved traffic and pedestrian safety measures. Seconded by Councilmember Yu and carried by the following votes: AYES: Councilmember— Fish, Yu, Man, Stemquist NOES: Councilmember — None ABSTAIN: Councilmember — None ABSENT: Councilmember— Chavez 9. UNFINISHED BUSINESS A. SECOND READING AND ADOPTION OF ORDINANCE NO. 17- 1029 ADOPTING THE CROSSROADS SPECIFIC PLAN The City Council is requested to adopt Ordinance No. 17-1029 adopting the Crossroads Specific Plan. City Attorney Vail informed City Council that additional issues regarding the specific plan has come to his attention and he respectfully requested more time to investigate this issue with staff. A report will be brought back to the City Council in January. Councilmember Fish made a motion to give the City Attorney's office and staff more time regarding the Crossroad Specific Plan and to bring a report back to City Council for ' consideration in January. Seconded by Councilmember Yu. City Council Minutes December 19, 2017 Page 5 of 7 10. NEW BUSINESS ' A. SENATE BILL 415 CALIFORNIA VOTER PARTICIPATION RIGHTS ACT In order to comply with Senate Bill 415 (i.e., to increase voter participation in local elections by holding them at the same time as a statewide election date), the City must adopt by December 31, 2017 a plan for full compliance with the Bill's provisions. Full compliance must be achieved by the consolidated statewide election no later than November 8, 2022. Assistant City Attorney Murphy and City Clerk Kuo gave a brief summary of the staff report City Council made comments regarding Senate Bill 415. Mayor Stemquist opened public comment. Hearing no request to speak, Mayor Sternquist closed public comment. Councilmember Yu made a motion to adopt Resolution No. 17-5293, a plan for compliance with Senate Bill 415 and allow staff to monitor any changes to the law prior to election consolidation. Seconded by Councilmember Fish and carried by the following votes: AYES: Councilmember— Fish, Yu, Man, Sternquist NOES: Councilmember — None ABSTAIN: Councilmember — None ABSENT: Councilmember— Chavez 11. COMMUNICATIONS— None 12. UPDATE FROM CITY MANAGER City Manager Cook provided an update on the Library Renovation Project, made comment on the Lights on Temple City and the General Plan. 13. UPDATE FROM CITY ATTORNEY City Attorney Vail spoke regarding the legislation relating to California employers' use of criminal history when making employment decisions. 14. COUNCIL REPORTS REGARDING AD HOC OR STANDING COMMITTEE MEETINGS A. SCHOOL DISTRICT/CITY STANDING COMMITTEE (Councilmember Chavez and Councilmember Fish) — Formed 1/3/2012 No report. B. The Committee received a report from City's audit consultant on City's draft Comprehensive Financial Report. E. FACILITIES, PUBLIC WORKS, AND INFRASTRUCTURE STANDING COMMITTEE (Councilmember Yu and Mayor Pro Tem Man) — Formed 4/4/2017 No report. F. PUBLIC ARTS COMMISSION AD HOC COMMITTEE (Councilmember Chavez and Mayor Pro Tem Man) — Formed 8/2/2016 No report. G. LIBRARY CONSTRUCTION AD HOC COMMITTEE (Councilmember Fish and Mayor Sternquist) — Formed 4/4/2017 Councilmember Fish reported on a Library Commission meeting the ad hoc committee attended relating to the progress of the Library Renovation Project. FACILITIES OPTION FOR RECREATION PROGRAM AD HOC COMMITTEE (Councilmember Fish and Mayor Sternquist) — Formed 4/4/2017 No report. FIREWORKS AD HOC COMMITTEE (Councilmember Fish and Mayor Pro Tem Man) — Formed 9/5/2017 No report. 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBERCHAVEZ—Absent B. MAYOR STERNQUIST Reported out on her meeting with the Los Angeles County Public Arts Commission relating to the gateway to the children's section of the library. E. MAYOR PRO TEM MAN Commented on the agreement to update the City's Pavement Management Program and I Lights on Temple City. He also encouraged the public to donate to the library renovation project.
