HomeMy Public PortalAbout2009-050 Resolution Granting CUP Approval to City of Medina for Concessions Bldg in Hamel Legion ParkMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2009-50 RESOLUTION GRANTING CONDITIONAL USE PERMIT APPROVAL TO THE CITY OF MEDINA FOR A CONCESSIONS BUILDING AND STORAGE BUILDING IN HAMEL LEGION PARK AT 3200 MILL DRIVE WHEREAS, the City of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, the City of Medina (the "Applicant") owns property known as Hamel Legion Park, located at 3200 Mill Drive, which is legally described as Lot 1, Block 1, Hamel Legion Park 2nd Addition in Hennepin County, Minnesota (the "Property"); and WHEREAS, the Applicant has requested approval of a conditional use permit for the construction of two buildings located at the Property; and WHEREAS, the request was reviewed by the planning commission on July 14, 2009 and, following public hearing thereon as required by law, the Planning Commission recommended approval thereof, subject to certain terms and conditions; and WHEREAS, the city council reviewed the application on July 21, 2009 for conformance with city ordinances, considered the recommendations of the Planning Commission and heard comments from the Applicant and other interested parties. NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina, Minnesota, that it should and hereby does approve the request by the City of Medina for a conditional use permit at the Property, subject to the following terms and conditions: 1. Improvements shall be constructed as described in the plans received by the City on June 12, 2009 and July 6, 2009, except as modified in this resolution; 2. The required accessible parking spaces shall be relocated to a more central location to adequately access the pedestrian path leading to the concession building and ball fields; 3. The pedestrian path leading from the parking lot to the concessions building shall be constructed with either bituminous or concrete for the purposes of accessibility; 4. Landscaping shall consist of drought -resistant native perennials; 5. A future irrigation system utilizing captured stormwater run-off may also be utilized; 6. Signage shall be allowed at a future date with the review of the Park Commission, without the need for a CUP Amendment. Resolution 2009-50 August 5, 2009 7. Cedar mill texture shall be installed on the main building walls and a smooth texture on the gable ends; 8. Stain for the arbor shall be of a higher quality to prevent annual maintenance of staining; 9. All items on the City Engineer memo dated June 19, 2009 shall be satisfied prior to the issuance of a building permit; 10. All items on Public Works memo dated June 26, 2009 shall be satisfied prior to the issuance of a building permit; 11. The emergency access drive shall be posted with "No Parking/ Fire Lane" signs on both sides of the drive; and 12. Staff shall work with the Building Official/Fire Marshall to reduce the width of the emergency access and bring the drive closer to the concession building. Dated: August 5, 2009 T.M.
