WHITE *** * Also admitted in OR ** Also admitted in NV *** Also admitted in WA We have researched the applicable statutes and McCall City Code provisions related to initiatives and referenda. The specific question at hand is how many valid signatures are required to get a referendum on the ballot in McCall. Idaho Code 50-501 reads as follows: 50-501.INITIATIVE AND REFERENDUM. The city council of each city shall provide by ordinance for direct legislation by the people through the initiative and referendum. Minimum requirements of the ordinance adopted shall be as follows: (1) petitioners for initiative or referendum shall be equal to twenty percent (20%) of the total number of electors who cast votes at the last general election in the city; (2) petitions for referendum shall be filed not less than sixty (60) days following the final adoption of the ordinance to be subject to referendum; (3) a special election for initiative or referendum shall be provided as prescribed in section 34-106, Idaho Code; (4) requirements for signature, verification of valid petitions, printing of petition, and time limits, except as expressly modified herein, shall be as nearly as practicable as provided in sections 34-1701 through 34-1705, Idaho Code. This section does not apply to bond elections. (Emphasis supplied) The applicable McCall City Code provision is MCC 1.6.1(B) which reads: (B) Number of Petitioners Required: To enact an ordinance by initiative or to repeal an ordinance by referendum, there shall be attached or appended to the petition the signatures of the legal voters of the City equal to at least twenty percent (20%) of the total number of voters registered to vote at the last general election in the City. (Emphasis supplied). BessieJo Wagner May 12, 2009 Page 2 The state statute allows a city to enact different threshold requirements so long as the requirements meet or exceed the minimum thresholds. As you can see, the McCall Code goes beyond the minimum and requires calculation of the minimum number of valid signatures based on the number of voters registered to vote, instead of based on the number of electors who cast ballots in the last general election in the city. McCall has adopted a higher threshold. This is consistent with the threshold for recall petitions. The next question is to determine what is meant by the term "last general election in the City." The Secretary of State's office believes this means the same thing as "last general city election held in the city." They cite Idaho Code 50-402(a) which defines "general election" to mean a general election in November in odd numbered years. That same statute states that the definitions are limited to Chapter 4 of Title 50. It is my opinion that the reference in McCall City Code 1.6.1 and Idaho Code §50-501 to "last general election in the city" means the 2008 general election. Because of the ambiguity and the differing interpretation by the Secretary of State's office, the cautious approach for the petitioners would be to seek to meet whatever threshold is higher. If they meet the lower threshold but do not meet the higher one, a court challenge could ensue. If they meet the higher threshold, the question is moot. You should provide the petitioners with the number of electors registered to vote in the City at the city general election in 2007, and the general election in 2008. By .Dan Gallagher _ Long Valley Advocate MCCALL—A group of citi- zens believe municipal- govern- ment that relies on a city man- ager is wrong for McCall and is working to change that. Throughout the state of Idaho,. only three .municipalities operate. under a city manager -run form of city government ratherthan the more traditional mayor -run form. Lindley Kirkpatrick is McCall's current manager: . Those Idaho . :cities are Lewiston,McCall and Twin Falls, said Robert Lyons, who is working toward letting the vot- ers decide. "We never, thought it was right for McCall, ° he said. "It's not that big of a city. It's an in- herent problem for the position, not Lindley." Like-minded people submitted " signatures, which were passed on to the Idaho Secretary of State's Office for verification. Lyons said McCall then announced it had problems with the signature, so the effort goes on. If a city manager approach was the right way to go for Idaho cities, especially smaller :ones, them many of.them would adopt it, Lyons said. Under the current system, the city,manager is going to lean to- wards what: the council thinks, he said. . "If the manager has- three friends on the council, then he can't be fired," he said. "At least under-the.other approach, you could 'vote him out. Lyons said the McCall City Council has run through a mum- ber of council members in the past few years, and a strong council is, needed to ;direct the city manager in their duties. Bill Robertson was McCall city manager for a time and then' mayor. He believes McCall vot- ers should have a choice what type of government they want. McCall residents had voted in the city manager style, which then must be maintained for .10: years, he said. "McCall is a resort, recre- ational town," he said. "Neither Lewiston -nor Twin Falls is what you call a recreational town. There's the concern that all the. city staff is in touch:" The residents will continue to work toward a city election on the issue, possibly 'in August: "We think we're good to go," Lyons said. .
