A regular meeting of the Gity Council of the
City of Moab, State of Utah, was held at the Grand
County Court House on the 15th day of ka;.,,, 1956, at
7:30 o'clock p.m. Present at said meetinE were the follow-
ing persons:
Mayor J.W. Corbin
Councilmen H.E. mohler
L.L. Robertson
D.W. Allen
W.D. McDougald
n.S. Parsons
City Attorney H.G. Gibson
City Recorder Ellis Foote
It appeared that upon advice of the City Engineer
that it was necessary to obtain the following described
land owned b: Clarence A. Peterson and Josephine Peterson
of E1 Monte, California, for the purpose of construction
of a sewage disposal plant, said described land being
situated in Grand County, State of Utah:
Beginning South 89° 54' West 370.0 feet
from the Southeast corner of the ;_outhwest
Quarter of Section 35, T. 23 S., h 21 E.,
S.L.M., and runping thence h orth 338.0 feet,
thence South 89 54' West 180.0 feet, thence
South 338.0 feet, thence north 89° 54' East
180.0 feet to the point of beginning. Con-
taining 1.39 acres more or less.
It was discussed that the City and the Petersons were
unable to reach a satisfactory agreement for the purchase
of said land and that the urgency of the situation required
the City to proceed with condemnation proceedings and obtain
an order of occupancy penoJng the outcome of the litigation
of said proceedings and to do so forthwith.

THEREUPON Cou.icilman D.W. Allen moved ehet the following
hesolution oe adopted; that the City Attorney be instructed
to forthwith commence condemnation proceedings against said
land and against Clarence A. Peterson and Josephine Peterson,
his wife, to obtain the above desc,ibed land for the purposes
of a site for the construction of a sewage disposal plant
for the city of Moab, Utah, and to obtain an order of occu-
pancy of tne premises pending the outcome of the litigation
of the condemnation proceedings and to do all thir_ts necessary
to effectuate said purposes.
Said teesolution was seconded by councilman w D. iecDougald
and upon vote the same was carried bj the unanimous affirmative
vote of all councilmen present.
