COUNCIL MINUTES
WORKSHOP MEETING - APRIL 26, 1989
A workshop session of the Bal Harbour Village Council was
held on Wednesday, April 26, 1989 at the Village Hall. The
meeting was called to order by Mayor Estelle Stern at 3:35 p.m.
and the roll was called. Those present were:

Councilman James E. Boggess
Councilman Sol M. Taplinl
Absent: Councilman Andrew R. Hirschl
Also present: Stan Price, representing the Village
Attorney2
Carole S. Morris, Village Manager
As a quorum was found to be present the meeting was
commenced.
II. Presentation by Ralph Warburton• Mayor Stern explained
that the purpose of this meeting was to hear the comments of
Ralph Warburton of the University of Miami relative to the
proposed ocean front zoning ordinance Mrs. Morris explained
that, at the Council's direction, she had been requested to
obtain an architect to provide "expert insight" into the proposed
ordinance and its effect on the Village. She had been referred,
by Dean Thomas Regan of the University of Miami, to Professor
Warburton. Mr. Warburton had been supplied with minutes of past
meetings, the proposed ordinance, comprehensive plan and the
recommendations previously offered by the firm of Harland
Bartholomew on this subject. Mrs. Morris also noted that some
council members had requested the slides from Dean Regan's shadow
study of the Bal Harbour Tower be available for today's meeting.
Unfortunately, as of the meeting, the slides had not been
located.
Mr. Warburton then began his presentation. Mr. Warburton
reported that he had reviewed all of the applicable materials and
felt that there were several crucial issues not addressed by the

ordinance is based on an assumption that all buildings

constructed under the existing code would be box shaped - which
is not necessarily true. Secondly, the color of buildings is not
addressed. In summary, the proposed ordinance does not go far
enough in regulation He suggested that the portion of our
existing code relative to the Architectural Review Board deserved
further study. Additionally, he recommended that physical
distances be utilized in the portion of the ordinance relative to
side setbacks rather than percentages He also suggested that a

concurred noting that such a method would provide flexibility as
well as architectural control. In response to questioning by
Council members, Mr. Warburton suggested that it might be
advisable to compose the architectural review board of
professionals. Mr. Weiss pointed out that a determination would
need to be made as to the authority of such a board - i.e.
advisory or quasi-judicial. In response to questioning by Mr.
Taplin, Mr. Warburton reiterated that while there is rib harm in

Council, a motion to adjourn the meeting was offered by Mr.
Boggess and seconded by Mr. Taplin. The meeting adjourned at
5:15 p.m.
