HomeMy Public PortalAbout2009-064 Resolution Authorizing Publication of ORd 469Member Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2009-64 RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE NO. 469 BY TITLE AND SUMMARY WHEREAS, the city council of the city of Medina has adopted Ordinance No. 469, an ordinance amending section 625 of the code of ordinances regarding alcoholic beverage licenses; and WHEREAS, Minnesota Statutes, § 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, the ordinance is 15 pages in length; and WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that the city administrator -clerk shall cause the following summary of Ordinance No. 469 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The city council of the city of Medina has adopted Ordinance No. 469, an amendment to section 625 of the code of ordinances regarding alcoholic beverage licenses. The amendment is the first comprehensive review of the city's liquor licensing regulations in recent years and is intended to bring the city's ordinance into conformance with state law. A number of definitions, dollar amounts of exemptions from insurance requirements and hours of operation for off -sale establishments are amended to reflect current statutory requirements or allowances. Requirements for posting a bond at the time of licensure and the setback from religious institutions are eliminated. A technical problem with the on -sale license class size limits and several outdated terms and provisions have been revised. The full text of Ordinance No. 469 is available for inspection at Medina city hall during regular business hours. BE IT FURTHER RESOLVED by the city council of the city of Medina that the city administrator -clerk keep a copy of the ordinance in his office at city hall for public inspection and that he post a full copy of the ordinance in a public place within the city.
