The special meeting of the Bal Harbour Village Council was held on Wednesday, May 31, 1989 at 10:30 A.M. in Village Hall. The meeting was called to order by Mayor Estelle Stern. Those present were: Mayor Estelle Stern Asst. Mayor Matthew B. Blank Councilman James E. Boggess Councilman Andrew R. Hirschl Also Present: Carole S. Morris, Village Manager Richard J. Weiss, Village Attorney Marilyn-P. Kreger, Village Clerk Absent: C/M Sol M. Taplin Having a quorum present, Mayor Stern announced the purpose of this meeting is to adopt the following emergency ordinance: AN EMERGENCY ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA; MAKING A FINDING THAT AN EMERGENCY EXISTS; AUTHORIZING APPLICATION FOR A STATE REVOLVING FUND LOAN; PROVIDING ASSURANCES; ESTABLISHING PLEDGED REVENUES; DESIGNATING AN AUTHORIZED REPRESENTATIVE; AUTHORIZING EXECUTION OF A LOAN AGREEMENT AND ESTABLISHING AUTHORIZING EXECUTION OF A LOAN AGREEMENT AND ESTABLISHING AUTHORITY TO UNDERTAKE THE UPDATING OF THE SEWER PLANT. A moment of silence was observed in memory of U.S. Rep. Claude Pepper. Attorney Richard Weiss advised that the first order of business should be the stating of the emergency. Mayor Stern stated that Statutes require adoption of an ordinance in cases when the Village borrows money and that in order to meet the state requirements to borrow these funds, time is of the essence. There is not sufficient time to do the usual advertising normally required to adopt ordinances. Carole Morris, Village Manager, stated that the Department of Environmental Regulation has scheduled a "list management meeting on June 20th". On this date, the city of Arcadia will be removed from this list which leaves a spot open for Bal Harbour. If Bal Harbour is ready, having previously submitted all other necessary documentation, this ordinance is the final step to be placed on the list in place of Arcadia. This will assure Bal Harbour of loan funding this year, as soon as July or August. In the event Bal Harbour is not ready, another agency that is ready would be given the opportunity to assume Arcadia's position on the list. Bal Harbour would then have to wait another year. The only other paperwork requested to be sent is being prepared simultaneously 16 with this meeting by the accounting department and building department. Everything would be Federal Expressed out to them on this afternoon. If this loan cannot be secured this year, Mrs. Morris indicated that she would begin negotiations for private funding because the sewer system cannot wait another year. In response to a question of Asst Mayor Blank, Mrs. Morris stated that the repair costs would be approximately $800,000.00 all of which would be funded by the loan at 4.6% interest rate amortized over a maximum period of 20 years. Attorney Weiss added that the loan documents provide that if something comes up during the work that any other parts need to be replaced, the cost would be covered in the loan. Sot re really isn'ta cap, just 100% of the cost of the work. a interest wCuld cost $60,000.00 annually. The Village may attempt to pay off the loan in 15 years depending on what -the amortization schedule DER submits looks like. The sewer budget currently reflects�a $58,000.00 reserve for payment for loans, which would not affect ad valorem taxes. Revenues from sewer fees is approximately $500,000.00 annually and is run as an enterprise fund which -dean that revenues and expenditures must always balance. The DER has notified the Village that is has received the money from the EPA, so assuming everything is in place, the Village may receive immediate funding. Mayor Stern called the question on Asst Mayor Blank previous motion. Vote Taken: All Voted Aye The Village Clerk read the emergency ordinance as stated above by title. Asst Mayor Blank moved the, -approval of the emergency ordinance on 1st and 2nd reading. C/M Boggess seconded the motion. Vote Taken: All Voted Aye There being no further busirss, the meeting was adjourned at 11:00 A.M. Mrs. Morris advised the Council of Deputy Police Chief Glenn Grundy condition.
