MINUTES OF REGULAR MEETING HELD JANUARY 12,1957 PRESENT: Mayor- Commissioner, Vice - Mayor - Commissioner, Commissioner, Commissioner, Town Attorney, Town Clerk, L. Seton Lindsay Stewart B. Iglehart Henry V. Pope William F. Koch, Jr. Henry F. Lilienthal J. Raleigh Fountain The minutes of the Commission meeting held on Dec. 8, 195b, were read, approved and adopted. The petition of Mr. Talbot Speer, requesting a special exception to the Town ordinance which suspends the issuance of building permits from Dec. 1 until April 1, was read. The application, citing support- ing facts and stressing the assurance by Mr. Speer that none of the adjacent property owners objected to his plan for remodeling was dis- cussed. A motion to grant Mr. Speer permission to have this work done was made, seconded and unanimously approved. J. R. Fountain was then instructed to issue the permit for increasing the height of wall adjacent to Westminister Apartments and for other planned remodeling of Mr. Speer's home. The Commissioners discussed the building permit issued to Mr S. Darwin James on November 28, 1956. There was a motion and second to permit work to begin whenever the contractor is ready. J. R. Fountain was instructed to request that the contractor allow no noisy work to be done each day prior to 9:00 A. M. Mayor Lindsay read the petition of Mr. Roy W. Cronacher, re- questing a building permit for a home. The property involved is the N, 401 of Lot 7 and the S. 701 of Lot 8, Gulf Stream Ocean Tracts. The Town Clerk reported that Mr. Cronacher had furnished eleven copies of his petition on Dec. 24,1956 and that on Dec. 24,1956, letters outlining the petition and announcing the hearing on the petition to be held at the regular Commission meeting on the 12th of Jan., 1957, were mailed to adjacent property owners and to property owners across the street therefrom. A notice, summarizing the appli- cation and setting forth the date of the hearing, was posted on the Town bulletin board on Dec. 24-, 1956. No property owner adjacent to Mr. Cronacherfs property, or across the street therefrom appeared at the meeting. However, Mr. Harvey Ladew, who is now residing at his home on N. Ocean Blvd, which is located near Mr. Cronacher's lot, was present and stated his objections to the building of the home of Mr. Cronacher at this time. After discussion, Mr. Ladew stated that even though he did not approve of the construction of Mr. Cronacher's house during the winter months, he understood the problem involved and that the Commissioner§ must make the decision they felt to be just and fair. The Commissioners after discussing the fact that there are at present under con- struction several homes between Mr. Ladew's property and that of Mr. Howard Phipps and that there would be another house started soon just North of the Davenport home on AIA, voted unanimously to issue a building permit to Mr. Cronacher. The Town Clerk was instructed to request that the contractor allow no noisy work to be done on this home prior to 9:00 A. M. each day. The Commissioners voted, unanimously, to hold a Town meeting on February 16, 1957, at 10:00 A. M., in the Gulf Stream School. Commissioner Koch requested that J. R. Fountain check on the insurance coverage on the new Ford police car. He stated that this car should be covered, as satisfactorily as is the Oldsmobile police car. J. R. Fountain agreed to take care of this matter. Mayor Lindsay moved that the Town purchase 65,000.00 face value Series J Government bonds from the funds now available in the water accounts. Commissioner Koch seconded and the motion carried unanimous- ly. Mayor Lindsay moved that the Town pay Ernest Glass a seventy -five dollar 075.00) bonus for his services during 1956. After being second- ed by Mr. Pope, themotion carried unanimously. Mayor Lindsay read the following resolution, calling the Town election to be held on March 5, 1957. RESOLUTION CALLING TOWN ELECTION TO BE HELD March 5, 1957 WHEREAS, the Town Charter, Chapter 27579, Laws of Florida, Acts of 1951, requires a town election to be held on the first Tuesday in March, 1957, which is March 5, 1957; and WHEREAS, it is the duty of the Town Commission to designate a polling place and to appoint a clerk and inspectors of election for the purpose of carrying on and conducting such election; NOW, THEREFORE, BE IT RESOLVED, BY THE TOWN COMMIS- SION OF THE TOWN OF GULF STREAM, FLORIDA, in session assembled January 12, 1957, as follows: 1. An election is hereby called to be held on Tuesday, March 5, 1957, for the purpose of electing five town commissioners who will hold office for a term of three years beginning thethird Tuesday in March, 1957. 2. The Town Commission does hereby designate the ti Town Hall of the Town of Gulf Stream, Florida, as the polling place for the holding of said election, and here- by appoint the following clerk and inspectors to conduct said election, to -wit: Clerk: Dorotha Davis Bauer Inspectors: Charles Turner Florence Cramp 3. The election shall be held and thepolling place shall be open between the hours of 7:00 o'clock A. M., and 7 :00 o'clock P. M. Eastern Standard Time. 4. Only qualified, registered voters of the Town of Gulf Stream will be allowed to participate in said election. 5. A copy of this resolution shall be posted on the Town Bulletin Board at least thirty days before the elec- tion and shall also be published two times in the Delray Beach Journal, beginning at least fifteen days prior to said election. Each person who has been selected for Clerk or Inspect- or is expected to be on hand promptly at thepolling place named, on the day of the election and serve. After a motion and second, the Commissioners passed the resolution unanimously. Mayor Lindsay moved that J. R. Fountain, Town Clerk, have copies of the resolution mimeographed and tha se co�ie�s w ith a copy of the Town's € e 3 statementrfo -_ - _6, and "a5l�� ter calling attention to the Town meeting on February 16, 1957 and to the election on March 5, 1957, be mailed to each voter and taxpayer of Gulf Stream. The Commissioners were presented a bill from Brockway, Weber and Brockway for engineering service connected with the investigation and report on the Town water system in the amount of 6638.00. It was stated that by paying this bill before January 21, 1957, the Town could deduct as discount the amount of 01.00. After a motion and second, the Commissioners voted unanimously to pay this bill prior to January 21, 1957. J. R. Fountain explained to the Commission that he had inadvert- ently overcharged the Gulf Stream Golf Club 631.50 in taxes for 1956. After a motion and second, it was voted unanimously to refund this amount less 4o discount to the Golf Club. There being no further business, the Commissioners adjourned.
