ProjectsMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2010-24 RESOLUTION RECEIVING FEASIBILITY REPORT AND CALLING FOR PUBLIC HEARINGS ON TWO IMPROVEMENT PROJECTS AND LEVYING SPECIAL ASSESSMENTS FOR SAME WHEREAS, pursuant to a resolution adopted by the city council on March 2, 2010, a feasibility report has been prepared by Bonestroo as the city's consulting engineer regarding street improvement projects on Holy Name Drive and Pioneer Trail, and the report was received by the city council on April 6, 2010; and WHEREAS, the two projects each consist of mill and overlay work in the areas described in the report; and WHEREAS, the report provides information regarding whether the two projects are necessary, cost-effective and feasible. NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of Medina, as follows: 1. The feasibility report is hereby accepted and each of the two projects is determined to be necessary, cost-effective and feasible. 2. Each of the projects shall be constructed separately using the City's 2010 materials bids for the mill and overlay portions of the work. 3. The city council shall consider the making of such improvements in accordance with the feasibility report and assessing benefited properties in accordance with the city's special assessment policy and pursuant to Minn. Stat., Chapter 429. The estimated total costs of the projects are as follows: Holy Name Drive $114,641 Pioneer Trail $187,527 4. Public hearings to consider the making of such improvements and the levying of special assessments related thereto shall be held at 7:00 p.m. in the council chambers at Medina city hall on the following dates: Holy Name Drive Pioneer Trail May 4, 2010 May 18, 2010 Resolution No. 2010-24 April 6, 2010 5. City staff is authorized and directed to prepare plans and specifications for making the two projects. 6. City staff is directed to prepare the appropriate notices for the improvement hearings and assessment hearings and to cause the proper published and mailed notices to be given for the public hearings as required by law and in accordance with the above schedule. 7. The amount of each project to be specially assessed against benefited properties in accordance with the city's special assessment policy and Minn. Stat. Chapter 429 is as follows: Holy Name Drive Pioneer Trail $25,221 $41,256 8. The city clerk, with the assistance of the city engineer, shall forthwith calculate the proper amount to be specially assessed for each such improvement against every assessable lot, piece or parcel of land within the area affected without regard to cash valuation and shall file a copy of the proposed assessment in the clerk's office at city hall. Assessments shall be payable in equal annual installments extending over a period of seven years, the first installment to be payable on or before the first Monday in January, 2011 and shall bear interest at the rate of 5.10 percent per annum from the date of adoption of the assessment resolution.
