Dear Joy, Ray Hord, the building official, and I met Mike Mauger and Andrew (?) at 1 Lighthouse Lane on Wednesday. The following is a list of items that still need to be done in the ground floor enclosure: 1. Remove insulation '2Q . ,C D,Y` 2. Remove wallboard ��r 3. Remove interior doors (3) 6 ' ' , tcp . 4. Provide access to the other enclosure for inspection Items 1 through 3 are required because only flood-resistant materials can be located be located below Base Flood Elevation. For now, item 4 refers to all electrical except the light switch by the entry door. Below are questions about that switch. Does Patricia or you have an Elevation Certificate for this house? If would help a lot to see what elevation the slab is at, and what the Base Flood Elevation was at the time of construction. That would assure that the light switch by the door was original to the building and can stay. It would also determine the height to which the insulation and wallboards need to be removed to. The switch is 5-feet above the floor. Please let me know about the Elevation Certificate. Dianne K. One possibility I wanted to suggest in the event no definitive understanding can be reached is to file an affidavit affecting title on the property so that any new purchaser would be on notice of the potential problem. There is, of course,some legal risk with doing this since it is always possible for someone to claim slander of title or something similar but,under the circumstances,I'm not sure that is of much concern. I think the bottom line is that it would be beneficial to the property and the owner thereof to make the property compliant if the violation is as minimal as I believe to be the case; however, I have not been into the property. As I recall it,there were some modifications made so that habitable space was permitted below the base flood elevation and the modifications were never removed. If the components making the space habitable were removed, would that not satisfy the problem? Obviously,physical occupancy even in uninhabitable space is possible but not likely. Patricia does not have the resources to bring the property into compliance.The house is for sale but if it doesn't sell it will definitely be foreclosed on before the end of 2012. I explained the history of the habitable space below base flood. She is going to call Terry Jackson,the realtor, so any potential buyers will know the living space on the ground floor has to be removed.
