CITY OF MEDINA RESOLUTION NO.2010-30 RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE NO. 482 BY TITLE AND SUMMARY WHEREAS, the city council of the city of Medina has adopted Ordinance No. 482, an ordinance amending section 640 of the code of ordinances regarding the regulation of peddlers, solicitors, transient merchants and door-to-door advocates; and WHEREAS, Minnesota Statutes, § 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, the ordinance is seven pages in length; and WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that the city administrator -clerk shall cause the following summary of Ordinance No. 482 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The city council of the city of Medina has adopted Ordinance No. 482, an amendment to section 640 of the code of ordinances regarding the regulation of peddlers, solicitors, transient merchants and door-to-door advocates. The amendment defines and distinguishes among the types of persons being regulated. Peddlers (persons selling products in their immediate possession door- to-door), solicitors (persons taking orders door-to-door for delivery of products later) and transient merchants (persons selling goods from a temporary location) must be licensed by the city. Door-to- door advocates (persons canvassing for political, religious or other non-commercial causes) are not required to register with or be licensed by the city. The list of information required to be submitted for a license has been expanded. Grounds for denial of an application for a license and standards of conduct while conducting business are specified. An application for a license may be denied or, once issued, suspended or revoked by the chief of police for a violation of these provisions. Property occupants may post notice at their residence that they do not wish to be approached in connection with door-to-door sales or advocacy activities. Persons dissatisfied with city staff's actions regarding the denial or revocation of a license may appeal to the city council.
