CALL TO ORDER: Pursuant to the Agenda posted on January 30, 1987, Mayor Atkins called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, February 3, 1987. 2. The invocation was given by Reverend Barry Vail, Bethlehem Lutheran Church, 5319 North Halifax. 3. The Pledge of Allegiance to the Flag was led by Mayor Atkins. 4. ROLL CALL: Present: Councilmen- Dennis., Froehle, Gillanders, Swain, Atkins Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Plan -, ning Associate Saldana, Parks and Recreation Director Kobett, Public Works „Coordinator �� Peterson and Julie Estrada of the Temple City Times 5. CONSENT CALENDAR Councilman Swain requested that Item 5. B. (3) be removed from the Consent Calendar and Councilman Dennis requested Items 5.B(3), 5.C, and 5.D, also be'removed for further `discussion. On motion by Councilman Gillanders, seconded by Councilman Froehle, the remaining items of the Consent Calendar were approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting of January 20, 1987, with Councilmen Dennis and Swain abstaining. Approved as written. B. RECOMMENDATIONS FROM PARKS & RECREATION COMMISSION MEETING OF JANUARY 21, 1987 (1) REQUEST FOR USE OF LIVE OAK PARK FACILITIES TO CONDUCT A PARENTS DANCE - FIRST LUTHERAN CHURCH P.T.L. - Council approved use of Live Oak Park facilities on February 14, 1987, subject to an appropriate fee and the required Certificate of Insurance. (2) REQUEST FOR USE OF TEMPLE CITY PARK TO CONDUCT A HEALTH AND SAFETY FAIR -, QUOTA CLUB,OF TEMPLE CITY Council approved use of Temple City Park by the Quota Club to conduct a Health and Safety Fair on May 16, 1987, from 8:00 a.m. to 5:00 p.m. subject to park rules and required Certificate of Insurance. 1 ! 3S5 Council Minutes, February 3, 1987 - Page 2 E. CLAIM FOR DAMAGES: RODMAN MARTIN Council denied claim and referred to JPIA. F. RESOLUTION NO. 87- 2693:,EMPLOYMENT OF BUDGETED PERSONNEL Council adopted Resolution 87 -2693 authorizing employment of budgeted personnel. G. RESOLUTION NO. 87 -2694: APPROVAL OF PAYMENT OF BILLS Council adopted Resolution 87 -2694 allowing claims and demands in the sum of $201,336,, 31. THE FOLLOWING ITEMS WERE REMOVED FROM THE CONSENT CALENDAR FOR FURTHER DISCUSSION: B. (3) REQUEST FOR FINANCIAL ASSISTANCE FROM TEMPLE CITY SCHOOL DISTRICT - BALL -FIELD MAINTENANCE C. Councilman Swain felt, if the request for funds from Temple City High School to help maintain the varsity field was going to be an annual request, it would be better addressed during the upcoming Budget Study Session rather than amending the adopted budget. Addi- tionally,, the tax - supported school property belongs to the community and, therefore, the schools have a respon- sibility to an members of the, community including youth organizations. Councilman Dennis stated the contribution by league volunteers coming in and refurbishing the fields saved the school some cost of maintenance that probably exceeded the extent to which the fields were used by the leagues. Mayor Atkins expressed the view that, between the 55% of the state budget, the state lottery, and now the developer fees, the school system may have a larger allocation of funds than the city. Councilman Swain moved to defer action and refer to the upcoming budget study session, seconded by Councilman Gillanders,and unanimously carried. LOS ANGELES COUNTY _SHERIFF'S DEPARTMENT PROPOSED SCHEDULE OF PERSONNEL RE: 1987 CAMELLIA FESTIVAL Councilman Dennis requested. Lt. Torres comment regarding the necessity for increasing the level of personnel at this year's Camellia Festival. Lt. Torres, Temple Station stated in the past the Camellia Festival and parade had been policed by volunteer reserves. Since this is a part of the Chamber of Commerce function as well as the City, the Contract law provides that if there are police services rendered for a money making venture, police man -hours should be,charged. The parade itself „is covered by deputies under City contract and reserve deputies. Following discussion, Council determined the presence of uniformed sheriff's personnel rather than off duty volun- teers lowered the propensity for confrontation and would add to-the security, control, safety and protection of the Community during the Camellia Festival. 1 s. 3,63 Council Minutes, February 3,1987 - Page 3 Councilman Dennis moved to authorize $1,934 for increased Sheriff's Department personnel to provide added public safety during the 1987 Camellia Festival, seconded by Councilman Gillanders and unanimously carried. D. PLANNING COMMISSION ACTION FROM THEIR REGULAR MEETING OF JANUARY 27, 1987 Councilman Dennis questioned the setting of a public,,hcar- ing before the Planning Commission on a proposed Granny Flat Ordinance. City Attorney Martin stated this is in response to recent changes in the state law which we have to accommodate. If the City does not have a Granny Flat Ordinance (which we do not) then Granny Flat's will automatically be permitted. Councilman Gillanders moved to receive and file the Plan - ning.Commission action, seconded by Councilman Dennis and unanimously carried. 6. UNFINISHED BUSINESS: None. 7. NEW BUSINESS: A. ORDINANCE NO. 87- 599 -U: AN URGENCY ORDINANCE RELATING TO ACUPRESSURE City Manager Koski presented background information stating Deputy Bill Riordan. of the Sheriff's Department reports that an area of business activity in need of specific control and appropriate regulations is the acupressure business. A 45 -day moratorium is recommended in order to develop appropriate regulations through the Planning Com- mission and Sheriff's Department. Councilman Gillanders moved to adopt Ordinance No. 87-599 -U imposing a. moratorium under Government Code Section 65858 on uses relating to the business of acupressure and refer to the Planning Commission and Sheriff's Department for investigation and report, seconded by Councilman Froehle and unanimously carried. B. DOWNTOWN REVITALIZATION SUB - COMMITTEE REPORT ON C -1, C -1 -R, AND C -2 ZONES Mayor Atkins stated a presentation was made to the City Council and Planning Commission by the Downtown Revitaliza- tion sub - committee on zoning uses in the C -1, C-1-R, ;.and C -2 zones. Since Councilmen Froehle and Gillanders were unavailable for that presentation, he had requested this item be placed on this evening's agenda to receive Coun- cil's input on the list of uses that had been recommended. After considerable discussion, the following conclusions were expressed: Councilmembers Atkins and Gillanders felt a determination on the appropriate zoning in the Downtown section has been a long time in coming; the process should be expedited as soon as possible; and, therefore, there would be no need to refer the matter back to the Planning Commission but that City Council should make the determination. I5 261 Council Minutes, February 3, 1987 - Page 4 Councilmembers Dennis, Froehle and Swain disagreed and concluded that the City is in the middle of making a ''Gen- eral Plan revision; that the Downtown Revitalization sub- committee had been asked to do a study on the C -1, C -1 -R, and C -2 zoning and submit their recommendations; that the proper course of action for this procedure is to submit the sub- committee,s recommendations to the Planning Commission who in turn would submit their recommendations to the-City Council; and to let the process run its course. vW The Councilmembers did concur that the C -1 -R was an experi- mental zoning that no one knew how it would work and that the Planning Commission, City Council and business commu- nity are aware that changes were necessary. Councilman Swain moved to refer the recommendations from the sub - committee on zoning on proposed uses to be;,permit- ted in the C -1, C -1 -R and C -2 zones back to the sub- commit- tee and request that they send their latest recommendations to the Planning Commission and the Planning Commission in turn to send their recommendations to the City Council as soon as possible, seconded by Councilman Dennis and carried on a roll call vote as follows: ROLL CALL: AYES: Councilmen- Dennis, Froehle, Swain NOES: Councilmen- Atkins, Gillanders 8. COMMUNICATIONS: A. CORRESPONDENCE FROM BRENT BERGH & ASSOCIATES - REQUEST FOR RELIEF FROM BUILDING MORATORIUM. City Manager Koski stated Brent Bergh & Associates had submitted a letter to the Planning Commission requesting relief from the building moratorium. The Planning Commis- sion at their January 13th meeting took no action, indicat- ing relief from the moratorium would be premature because the General Plan was still in'tthe process of public hear- ing and a possibility existed that changes could still be made that are not evident at this time. Brent Bergh was appealing the Planning Commission decision. Councilman Gillanders moved to confirm the Planning Commis- sion's decision denying the request in writing, seconded by Councilman Swain and unanimously carried. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Bob Pitts, 5312 Degas Avenue, spoke as Commissioner of the San Gabriel Valley Baseball Association, relating that the Varsity Field at Temple City High Scho'bl which is used by the youth baseball leagues is inspected by his staff to determine the safety and playing ability of the various teams that come into Temple City to play. This is the only field available for the Leagues in this age group (15 -18 years). The groups are small and the amount of money they have is limited. If, additional information is needed as exactly how much each league contrib- utes to the school district, each league president could pro- vide this information to Council when making their determination in the Budget study session. Parks & Recreation Director Kobett was directed to include in his budget report information regarding league contributions made to TCHS for field maintenance. .:W 3'59 Council Minutes, February 3, 1987 = Page 5 Cal,Magro, 9207 Wedgewood, representing the Downtown Revitali- zation sub - committee on zoning summarized the sub - committee's action stating the committee had considered opening the zone to C -2. However,, they concluded that opening it up completely:to C -2 would not be in the best interests of the business commu- nity. There are some uses that would not be suitable in the C -1 zone. The C -1 -R concept was not successful because of the grandfather clause. There are some things in C -2 that do not belong in C -1 zone. Penny Graham, Graham Music, stated the sub - committee had worked many hours on this report, and the Chamber Board of Directors will take action shortly on the sub - committee's recommenda- tions.. RECESS TO CRA: At this time Council recessed to meet as the Temple City Community Redevelopment Agency; approved a proposed shopping center at 5614 -18 Rosemead Boulevard; approved the proposed sign for "Temple City Plaza" by Exxon; and adopted a resolution approving the -payment of bills in the sum of $1193.75. The Minutes are set forth in full in the records of the Agency. 10. ACTION ON REQUEST BY CRA: None. 11. MATTERS FROM CITY OFFICIALS: A. CECIL GREEN - SENATE CANDIDATE Councilman Gillanders stated Cecil Green was running-for the Senate representing District 33 and felt that his .background and experience in local government well quali- fies him for this State office. B. L.A. SHERIFF'S DEPARTMENT - NEW EQUIPMENT Councilman Swain reported on the visit to the Star Center of the Sheriff's Department and viewed the new proposed digital communication system which is being implemented. The contract cities will bear approximately 12% of the cost over a 10 year period starting in 1988. C. SOLID WASTE MANAGEMENT TASK FORCE Councilman Swain reported she had attended the meeting on solid waste management where every city in the San Gabriel Valley was represented.' Sheistated there are many mis- conceptions, pros and cons and new information continually becoming available which Council needs to be aware of before taking any stand on waste - management. D. "STUDENT DAY IN GOVERNMENT" - FEBRUARY 3 Mayor Atkins reported on "Student Day in Government" which is an annual event sponsored by the City in cooperation with Temple City High School. The purpose of this activity is to allow City officials, staff and students to become better acquainted with the City's organization. An alert group of students attended today posing excellent ques- tions. The Mayor expressed his appreciation for 'st'aff support as well as that of the Fire and Sheriff's Depart- ments. 1 s 357 Council Minutes, February 3, 1987 - Page 6 E. SANITATION DISTRICT Mayor Atkins stated the Sanitation District has been denied any further dumping of "sludge" into the ocean and this will now only compound the issue of what to do with waste sludge and trash. 12. ADJOURNMENT: On motion by Councilman Dennis, seconded by Councilman Gillanders, the meeting of the City Council adjourned at 9:00 p.m. The next regular meeting will be held on Tuesday, Febru- ary 17, 1987, in the Council Chamber at 5938 North Kauffman Avenue, Temple City.
