Member missing : John Nixon . Also present : Ryan Bennett ( Brewster Town Planner) The Chair read the Recording or Taping Notification : "As required by the Open Meeting Law we are informing you that the Town will be audio and video taping this public meeting . In addition , if anyone else intends to audio or video tape this meeting he or she is required to inform the chair. " MINUTES : August 14 , 2018 MOTION by Patricia Eggers to accept the Minutes of August 14, 2018 as distributed . Second by Arthur Stewart I VOTE 5- 1 -0 , September 11 , 2018 MOTION by Arthur Stewart to accept the Minutes of September 11 , 2018 as distributed . Second by William Hoag , VOTE 5-2-0 CONTINUED APPLICATION : 18 -13 Nicole and Jay Merriman , ( Represented by Frank Shirley Architects) , 692 Tubman Road , MAP 65 LOT 50 , previously M 26 L 108 , in the RM zoning district . The applicant seeks a Special Permit under MGL 40A- 6 and Brewster Bylaw 179-25 A (extension and alterations) to add to an existing historical structure within the front yard setback . Merriman were present . Board Discussion • Mr . Harrison read e- mail from Noelle Bramer ( Brewster Conservation Agent) as a result of the Cons Com meeting of October 2nd , the orders have not been drafted for review but she sees no issues with the approval moving forward . • Additional plans • Note was made that everything asked for in the previous meeting was presented . Members hearing this Continued application ; Brian Harrison , Patricia Eggers , Jeanne Kampas and William Hoag . • Continued with the same members without adding an additional member , unanimous decision • Ok' d by the applicant • Mr . Harrison asked the Board if they were comfortable going forward w/o Conservation Order of Conditions . All agreed . • Ms . Eggers mentioned the two (2 ) abutter' s letters in favor of this project MOTION by Patricia Eggers to APPROVE Special Permit 18 - 13 to add an extension and alteration to an existing historical structure within the front yard setback. Contingent upon final approval from Conservation Commission . Second by Jeanne Kampas , VOTE : 4=0-0 . Further Discussion • Chairman Harrison noted that Findings of Fact should be applied to each application on an Individual basis . • He stated the following to be added to the motion as pertaining to # 18- 13 ; • The project was determined to be pre - existing non - conforming because the existing front yard setback is plus or minus 5 feet where currently a 30 foot setback is required o The height and bulk of the proposed project are generally in keeping with the other single -family homes in the area o There will be no impact on traffic flow and safety ; the home is single family home located in residential zoning district and is to remain a single-family home o The proposed renovations will be in keeping with the historic architecture of original structure CONTINUED DISCUSSION : RE : Request from Zoning Agent Staley RE : Comprehensive Permit 15- 13 ( Habitat for Humanity/Tubman/ Paul Hush Road ) • Letter send by Victor Staley dated May 24 , 2018 to advice on his interpretation of Comp permit 15- 31 . MOTION by Patricia Eggers to adjourn at 7 : 30 PM , Second by Susan McShane , VOTE : 5- 0-0 .
