The meeting of the Town Commissioners of the Town of Gulf Stream Florida was held at the Town Hall on Monday, February 11,1952 at 10 a.m. Present: Mayor Commissioner L. Royce The reading of the minutes of the last meeting held on January 14th, 1952 at 11 a.m. were dispensed with, as each Commissioner had been furnished a typewritten copy of said minutes. Upon motion duly made, seconded and unanimously voted, the minutes were approved and ordered filed. Officer E.W. Cooper made a report in general. He referred to some street signs that were badly rusted, and the Commissioners upon motion duly made and seconded, approved replacing the rusted signs with new ones. The Commissioners approved the payment of the attached list of bills check #960 to #979 inclusive. The Bank Balance was reported as $7,244.03. It was reported to the meeting that 2,557,000 gallons of water had been furnished the Town of Gulf Stream by the Gulf Stream Golf Club during the month of January 1952 for which the Town paid the Gulf Stream Golf Club $306.$4. The resale of water to individuals amounted to $595.40 There was presented to each Town Commissioner a copy of a new pro- posed Zoning Ordinance. There wws hung on the wall of the office in the Town Hall a colored map in sup -ort of the New Zoning Ordin- ance. Each Commissioner having read a copy of the New Proposed Zoning Ordinace, discussion was then held and suggested changes were proposed. Town Commissioner Alexander B. Royce was asked to consult with Town Attorney C.Y.Byrd about such changes. Anpoint- m,�nt was made for that afternoon with Mr. C.Y.Byrd. The meeting then voted to adjourn and reconvene on Tuesday morning February 12,1952 at 9 a.m. Minutes of Adjourned meeting held on February llth,1952 and contin- ued this day, February 12,1952 at 9 a.m. Present: M•iyor Commissioner L. Royce �( ) Minutes Town of Gulf, Stream, Palm Beach County, Florida February 11th add February 12th,1952. 2 After due consideration and discussion of the proposed Zoning Ord- inance whaich has been prepared by the Town Attorney, several changes were suggested by various members of the Town Commission and said changes were approved by the Commission, and Commissioner Royce and Mayor Lindsay were instructed to confer with Town Attorney C.Y.Byrd in having the proposed changes placed in the preliminary Zoning Ordinace and a rough draft of the Zoning Ordinance was to be prepared by the Town Attorney. On motion duly made by Commissioner Royce and Seconded by Commiss- ioner Clarke and carried, Mayor Lindsay was authorized and intructed to have the Town Attorney prepare the preliminary Zoning Ordinance showing all proposed changes, and also to have prepared a small sized Zoning Map in suffieient copies to be attached to printed or mimeographed copies of preliminary Zoning Ordinance which Commissioner Royce agreed to have re- produced at his office in New York from the preliminary draft prepared by the Town Attorney and the Town was bear such expense or expenses as were necessary in having the preliminary Zoning Ordinance prepared, and also the proposed Zoning Map. . FLORIDA Mr. William Bauer Town Clerk Town of Gulf Stream Delray Beach, Florida Dear Bill: January 25, 1952 I am enclosing herewith a copy of the restrictions contained in the deed given to Mr. Pierre L. Bailly, covering the sale of certain ocean front property in Gulf Stream. Yours very truly, JZV.;Rilay, Jr. jfr /k encl. C 0 P Y THE Grantee covenants: 1. The following covenants shall apply only to the North 100 feet of the premises conveyed by this Deed: (a) The premises shall be used for residential purposes only. (b) That no building except one detached dwelling house (with the usual outbuildings for use in connection therewith) for the use and occupancy of one family only will be constructed or erected upon said premises or permitted to be thereon. (c) That no portion of the premises, nor any interest therein, shall ever be conveyed or transferred by deed, lease or otherwise to any person other than a person belonging to the Caucasian race, and that no individual other than one belonging to the Caucasion race shall ever occupy any portion of the said premises (excepting only domestic servants domiciled and employed on the premises). (d) That no building or any part or portion thereof, nor any wall over six feet in height, shall be constructed, erected, placed or permitted upon the said premises within ten feet of the north line thereof; a fence or hedge shall be considered to be within the meaning of the term "wall ". 2. The following convenants shall apply to the rEmainder of the said premises: (a) That the said premises shall be used only for residential purposes or for the operation of hotels and apartment houses thereon, provided, however, that retail sales stores and shops may be operated on the premises in any hotel or apartment house which may be con- structed thereon. Such retail stores and shops, if located on the westerly side of any building, shall have no outside entrances or approaches. (b) That no buildings shall be constructed on the said premises excepting structures designed for residential hotel or apartment house use. (c) That no buildings or structures of any kind shall be con- structed, erected, placed or permitted to be on the premises until the plans and specifications therefor, and the plan for the arrange- ment thereof on the ground, shall have been approved in writing by an officer or duly authorized agent of Bessemer Properties, Incorporated. This restriction shall terminate on February 1st, 1956. The Grantor agrees that approval of plans and specifications submitted to it will not be arbitrarily withheld, but aesthetic #rounds may be assigned as the basis for disapproval of such plans and specifications. (d) That no building or part or portion thereof, nor any wall over six feet in height, shall be constructed, erected, placed or permitted to be on the premises within ten feet of the south boundary thereof; a fence or hedge shall be considred to be within the meaning of the term "wall ".
