HomeMy Public PortalAboutORD14050 BILL NO. 2006-15 • SPONSORED BY COUNCILMAN Brown ORDINANCE NO. 0-050 SIB AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH PIERCE MANUFACTURING., INC., FOR THE MANUFACTURE AND PURCHASE OF FIRE APPARATUS. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk are hereby authorized and directed to execute an agreement with Pierce Manufacturing., Inc., for the manufacture and delivery of fire apparatus. The amount expended for the contract shall not exceed $370,010.00. Section 2. The agreement shall be substantially the same in form and content as that agreement attached hereto as Exhibit A. • Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed: /r Approved. / 2"06 residing Officer Mayor ATTEST: APPO ED A TO FORM: y CI c City uns Ior ILI 050 • Contract to furnish truck chassis and cabs This agreement is made by and between the City of Jefferson City, Missouri, a municipal corporation ("city"), and Pierce Manufacturing, Inc., Appleton, Wisconsin ("contractor"), witness: That the parties, In consideration of the agreements contained below to be met by the respective parties, agree as follows: 1. Contractor agrees furnish one Pierce Arrow XT custom pumper(hereinafter the "apparatus")and equipment as specified in It bid proposal dated April 26, 2006 (hereinafter referred to as "Specifications", the terms of which are Incorporated herein as if more fully and completely set forth, and to deliver the same as provided hereinafter. 2. Contractors standard warranty will apply. 3. It is understood that the following documents: the instructions to bidders, the specifications, and contractor's proposal, copies of which are attached here, are made a part of this contract, and each of the parties agrees to cant'out and perform all of the provisions of those documents upon Its part to be performed. • Those documents are on file in the office of the purchasing agent of the city. 4. City agrees to pay to Contractor the sum of Three Hundred Seventy-Six Thousand Fourteen and no/100 Dollars ($376,014.00) . a. If City pays the chassis progress payment at least 90 days prior to delivery, City shall be entitled to deduct Six Thousand Four and no/100 Dollars ($6,004.00) from the purchase price. 5. Said apparatus shall be delivered f.o.b. within 170 working days of the execution of this agreement by the City and delivery of same to Contractor, provided however that Contractor shall not be liable for delays caused by strikes, war, Intentional conflict, failures to obtain chassis, material shortages, or other causes beyond the control of the Contractor. 6. Contractor specifically states that the apparatus to be furnished will conform with all Federal Department of Transportation (DOT) rules and regulations In effect at the time of the bid, and with all National Fire Protection Association Guidelines (NFPA) for Automotive Fire Apparatus as published at the time of bid, except as modified by the City's specifications. 7. A competent serviceman shall, upon request, be furnished by the Contractor to . demonstrate the apparatus for the City and to give the City's employees the necessary instructions in the operation and handling of the apparatus. 8. In case the City desires to test the apparatus, such test shall be made within ten • (10) days of Its arrival in Jefferson City, and a written report of such test forthwith delivered to the Contractor at Its principal offices. If no such test be made with the said ten days then the apparatus and equipment shall be considered as fully complying with the contract specifications. 9. This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, whether oral or written, covering the same subject matter. This Agreement may not be modified or amended except in writing mutually agreed to and accepted by both parties to this Agreement. 10. This Agreement is entered Into under and pursuant to, and is to be construed and enforceable In accordance with, the laws of the State of Missouri. 11. FISCAL NOTE: 3502-9900-7350-2004-Fire Apparatus 2005-2006 Budget $ 336,494.00 Expended 68.60 • Bid No. 2266 $ 370.010,00 Balance ( $ 39,588.60) The apparatus will not be delivered until the 2007 budget year. Additional funds will be appropriated in that year. PAST PERFORMANCE: Schuhmacher Fire Equipment has provided apparatus as specified and bid in the past. RECOMMENDATION: Staff recommends award of the bid to Schuhmacher Fire Equipment of Washington,Missouri in the amount of$370,010.00. This amount represents the bid amount of $376,014,00 less the chassis progress payment discount of$6,004.00. I also recommend utilizing the Chassis Progress Payment to reduce the overall cost of this apparatus. The base bid with loose equipment of$376,014 with a Progress Payment credit the final cost of the truck will be $370,010. Delivery will be in about 8 '/2 months or March of 2007.
