CITY COUNCIL
MINUTES
FEBRUARY 17, 1987
INITIATION:
1. CALL TO ORDER:
Pursuant to the Agenda posted on February 13, Mayor Atkins
called the regular meeting of the City Council to order at
7:35 p.m. on Tuesday, February 17, 1987.
2. The invocation was given by Pastor Charles Woodworth of the
First United Methodist Church, 5957 Golden West Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor
Atkins.
4. ROLL CALL:
Present: Councilmen- Dennis, Froehle, Gillanders,
Swain, Atkins
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin,
Planning Associate Saldana, Parks and Recrea-
tion Director Kobett, Public Works Coordina-
tor Peterson and Julie Estrada of the Temple
City Times
5. CONSENT CALENDAR
It was moved by Councilman Froehle and seconded by Council-
man Gillanders to remove item D. from the Consent Calendar
for further discussion. On motion by Councilman Gillanders,
seconded by Councilman Froehle, the remaining items on the
Consent Calendar were approved as recommended.
A. APPROVAL OF MINUTES - Regular Meeting of February 3, 1987.
Approved as written.
B. ACCEPTANCE OF WORK - E.C. CONSTRUCTION CO. - CONSTRUCTION
OF KAUFFMAN AVENUE CIVIC CENTER PARKING LOT
Council accepted the work and authorized the City Clerk
to file a Notice of Completion; authorized payment in
the amount of $39,144.82; and authorized release of the
10% retention in the amount of $4,349.43 at the end of
the 35 -day lien period.
C. RECOMMENDATION FROM TRAFFIC COMMISSION MEETING OF FEBRU-
ARY 4, 1987
(1) OLEMA STREET, WEST OF TRELAWNEY AVENUE, RESTRICTED
PARKING
Council approved Traffic Commission's recommenda-
tion to place "No Parking 9:00 AM to 2:30 PM,
School Days Only" signs on both sides of Olema
Street in order to cut down on high school students
parking during school hours on this residential
street.

E. APPROVAL OF VENDORS ALONG PARADE ROUTE - 43RD ANNUAL
CAMELLIA FESTIVAL
Council approved five vendors recommended by the 43rd
Annual Camellia Festival Committee subject to the re-
quired Certificates of Insurance and all necessary per-
mits.
F. PLANNING COMMISSION ACTION FROM REGULAR MEETING OF
FEBRUARY 10, 1987
City Council received and filed the memo from the Plan-
ning Commission outlining action taken at the Commis-
sion's meeting of February 10.
G. CLAIMS FOR DAMAGES: (1) MANUEL GARCIA, JR.
(2) PAULA SWANSON
(3) LOUIE RAMOS
Council denied all claims and referred them to Southern
California Joint Powers Insurance Authority.
H. RESOLUTION NO. 87 -2695: EMPLOYMENT OF BUDGETED
PERSONNEL
Council adopted Resolution 87 -2695 authorizing the
employment of budgeted personnel.
I. RESOLUTION NO. 87 -2696: APPROVAL OF PAYMENT OF BILLS
Council adopted Resolution 87 -2696 allowing claims and
demands in the amount of $121,444.665.
D. REQUEST FOR STUDY SESSION WITH CITY COUNCIL - PARKS AND
RECREATION COMMISSION
Councilmembers felt an appropriate time to discuss the
proposed uses of State Grant Funds in the amount of
$84,000 would be during the time that the proposed
budget is prepared.
Councilman Swain moved to set the matter of uses for
State Grant Funds at a study session with the Parks and
Recreation Commission, date to be determined later,
seconded by Councilman Gillanders and unanimously car-
ried.
6. UNFINISHED BUSINESS:
A. PUBLIC HEARING: MODIFICATION OF ZONE VARIANCE NO.
86 -818; 9064 OLIVE; OWNER /APPLICANT: JOHN NETTLETON
City Manager Koski provided background information
stating that on January 6, 1987, the City Council
adopted Resolution 87 -2689 approving zone variance
86 -818 allowing construction of a sub- standard size
garage located a minimum of 20 feet from the property
line adjacent to Sultana Avenue. The applicant has
found that, with a 20 -foot setback, he would lose both
kitchen windows and requested that Council modify the
condition to 15 feet allowing him to keep one kitchen
window.

Mayor Atkins stated that he would abstain from the
discussion and would not vote on this matter as he has a
personal relationship with the Nettleton family.
Mayor Atkins declared the public hearing open and in-
vited anyone wishing to address the subject to come
forward at this time.
John Nettleton, 9064 Olive, asked that the Council
consider his request to modify the zone variance re-
cently granted. If the garage were situated 15 feet
rather than 20 feet from the property line, Mr. Nettle-
ton would lose only one kitchen window rather than two.
Mr. Nettleton advised that this problem was not evident
when he first came to the City Council with his request
as the original plot plan was not drawn to scale. Also,
Mr. Nettleton wished clarification on #4 of Section 2 of
Resolution 87 -2689 as it indicated that he must remove
approximately 18 feet of driveway and he did not recall
that being a condition of Council's approval. Mr.
Nettleton advised the Councilmembers that his neighbor
had been advised of his request for a 15 -foot setback
and had no objection.
As no one else wished to address Council, Councilman
Dennis moved to close the public hearing, seconded by
Councilman Gillanders, and unanimously carried.
Councilman Swain stated that she had no objection to the
15 -foot setback as it was a dead end street and the fact
that Mr. Nettleton's neighbor had no objection to the
modification. Also, Councilman Swain did not see the
need for Mr. Nettleton to remove the driveway as long as
the curb -cut and approach was removed and replaced with
curb, gutter and sidewalk.
Councilman Dennis stated that, since there is approxi-
mately 26 feet from the proposed site of the garage to
the curb, he also had no objection to the request for a
15 -foot setback.
Councilman Gillanders concurred with Councilmen Swain
and Dennis, but had concern with the fact that the Mr.
Nettleton's garage was only 18 inches from the garage of
his neighbor and felt that it could be a potential fire
hazard.
Councilman Froehle agreed with Councilmembers and moved
to adopt Resolution No. 87 -2697, which supersedes Reso-
lution No. 87 -2689, modifying #3 of Section 2 to read:
"The proposed garage shall be relocated so as to leave
a 15 -foot setback from the public right -of -way (Sultana
Avenue) "; and #4 of Section 2 to read: "The existing
curb -cut on Olive shall be removed and replaced with a
standard curb, gutter and sidewalk prior to final in-
spection", seconded by Councilman Gillanders and car-
ried, with Mayor Atkins abstaining.
B. PUBLIC HEARING: ZONING CODE AMENDMENT - ADDITION OF
PERMITTED OR CONDITIONAL USES WITHIN VARIOUS ZONING
DISTRICTS IN THE CITY
City Manager Koski advised that on January 13 the pro-
posed code amendment deletes "Clarification of Ambigu-
ity" and replaces it with a new procedure wherein the
Planning Commission, after making certain findings, can
add or delete land uses within a given zoning district.
The new procedure greatly simplifies the existing method
by which land uses are added to or deleted from the
zoning ordinance.

Mayor Atkins declared the public hearing open.
As no one wished to address the Council, Councilman
Gillanders moved to close the public hearing, seconded
by Councilman Froehle, and unanimously carried.
Councilman Dennis moved to certify the Negative Declara-
tion of Environmental Impact, seconded by Councilman
Swain and unanimously carried.
City Attorney Martin introduced for first reading by
title only Ordinance No. 87 -600, AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION
9165 OF THE ZONING CODE RELATING TO CLARIFICATION OF
AMBIGUITY.
Councilman Swain moved to waive further reading, but was
objected to by Councilman Gillanders. As there would
not be a unanimous vote on the motion, City Attorney
Martin read Ordinance No. 87 -600 in full.
7. NEW BUSINESS:
A. GENERAL PLAN UPDATE
Councilman Swain moved to set public hearing for March 3
to consider the General Plan amendments, seconded by
Councilman Dennis and unanimously carried.
8. COMMUNICATIONS:
None
9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
No one wished to address the City Council.
RECESS TO CRA:
At the time Council recessed to meet as the Temple City
Community Redevelopment Agency; and approved the Minutes of
the February 3 meeting and adopted Resolution CRA 295: War-
rants and Demands in the amount of $184.73. The Minutes are
set forth in full in the records of the Agency.
10. ACTION ON REQUEST BY CRA:
None
11. MATTERS FROM CITY OFFICIALS:
A. City Attorney Martin brought before the City Council the
matter of late arriving and incomplete insurance poli-
cies from participants of the Camellia Festival. As
this appears to be an ongoing problem, Mr. Martin sug-
gested that a due date of 30 days in advance of the
event be set for the City to receive insurance policies.
Mr. Martin also reminded Councilmembers that JPIA does
require the City to have insurance policies name the
City as additionally insured, which a few participants
omitted to include in their policies.

On motion by Councilman Swain and seconded by Councilman
Gillanders, it was unanimously carried that a "subse-
quent need" to take action on the insurance item arose
after the posting of the Agenda on February 13.
After some discussion regarding the problems surrounding
the insurance issue, Mayor Atkins recommended that a
formal written policy be developed by City staff for
events such as the Camellia Festival in order to elimi-
nate last- minute insurance problems.
Councilman Swain moved to require and accept insurance
policies naming the City additionally insured from
Camellia Festival participants up until 5:00 p.m. on
Friday, February 20, seconded by Councilman Gillanders
and unanimously carried.
12. ADJOURNMENT:
On motion by Councilman Swain, seconded by Councilman
Froehle, the meeting of the City Council adjourned at 8:30
p.m. The next regular meeting will be held on Tuesday,
March 3, 1987.
