Christy Municipal Building, 320 East McCarty Street, to consider amendments to the text of Chapter 35, Zoning Code, including Exhibit 35-28 Land Use Matrix (Sections 2B Group Living and 1 F Health Care Facilities) and Section 35-92 Definitions. The purpose of the public hearing is to consider proposed amendments pertaining to assisted living facilities, nursing homes and hospitals and a proposed new zoning classification and definition for medical park. One of the items included in the zoning amendments is the definition of Medical Park. During the development of the proposed amendments, staff has had discussions with representatives of the St. Mary's Health Center. Today, May 5, 2006, we received the following proposed definition from Beverly J. Stafford, Director of Marketing, Planning and Fund Management for St. Mary's. . Medical Park. A health care complex consisting of more than one of the following uses: hospital; clinic; medical or dental office; medical laboratory; nursing home or convalescent care facility; substance abuse treatment facility; sanitarium; physical or mental rehabilitation facility; and residential care facility, located in one or more buildings totaling 50,000 square feet or more In the aggregate on one or more adjacent parcels of land totaling 5 acres or more. Under the proposed amendments, a Medical Park would be a P Permitted Use in C-O, C-1, C-2 and C-3. The St, Mary's property for their new hospital - medical complex near Highway 179 is zoned C-2 and contains more than 5 acres, They would like for their proposed facilities, which Includes a nursing home during the first phase of construction, to be classified as a permitted use. As such, they would not have to rezone the site from C-2 to C-O, obtain a Conditional Use Permit, or delay construction of the nursing home to coincide with the hospital. The definition proposed by St. Mary's is slightly different than the definition drafted by staff in that their definition reads "more than one of the uses located in one or more buildings totaling 50,000 square feet or more" and our definition reads "a hospital or clinic plus one or more of the other uses" and our definition does not include a minimum building size. The main difference is that their definition would not require one of the uses to be a hospital or clinic to meet the definition of a Medical Park. Notification The proposed amendments were published in the News Tribune as required by city code and state statute. Backeround At the March 9,2006 Planning and Zoning Commission meeting,staff presented a report on how die zoning codes of Jefferson City and four other Missouri cities classify assisted living facilities, nursing homes and hospitals. Generally, our Zoning Code is considerably more restrictive for some of the uses, particularly nursing homes.It is also inconsistent in its treatment of elderly housing facilities with similar characteristics.In order to remedy this situation, an amendment is needed. Following discussion of the draft amendment, the Commission authorized the staff to advertise the amendment for a public hearing. Proposed Amendments Theproposed amendment would allow the subject uses in more zoning districts while retaining a review of the location of certain uses through the conditional use permit process.Presented below is o brief description of die proposed amendments.The revised Matrix of Permitted,Conditional and Special Exception Uses is attached. B1. Assisted Living Facility would be allowed in C-O Office as a P permitted use(note conditional)and in N-O Office and C-3 Commercial as a C conditional use(now prohibited). • B2. Residential Care Facility would be allowed in C-O Office as a P permitted use(now conditional)and in N-O Office as a C conditional use(now prohibited). B5. Community Residence—with more than 5 persons,would be allowed in RA-1 and RA-2 Multi-family Residential as a P permitted use(now conditional)and in C-O Office as a P permitted use(now prohibited)and in C-I and C-3 Commercial as a C conditional use(now prohibited). F3. Hospital, Sanitarium—Physical and Mental Rehabilitation would be allowed in C-1 Commercial as a P permitted use(now prohibited). F4. Nursing,Convalescent Care—with building area less than 10,000 sf would be allowed in C-O Office as a P permitted use(now conditional)and in C-1, C-2 and C-3 Commercial as a C conditional use(now permitted). F5. Nursing, Convalescent Care—with building area of 10,000 sf or more would be allowed in C-0 Office as a P permitted use(now prohibited)and in RA-1 and RA-2 Multi-family Residential and in die C-1,C-2 and C-3 Commercial as a C conditional use(now prohibited). F6. Medical Park—on a total site of 5 acres or more would be allowed in C-0 Office and C-1, C-2 and C-3 Commercial as a P permitted use(note prohibited).A definition of Medical Park is also proposed. Staff Recommendation • Approve the proposed amendments subject to any changes that die Commission deems appropriate.
