CALL TO ORDER: 2 3 4 Pursuant to the Agenda posted on February 27, 1987, Mayor Atkins called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, March 3, 1987. The invocation was given by Ed Boehne,'Principal of First Lutheran Church and School, 9123 Broadway, Temple City. The Pledge of Allegiance to the Flag was .led by Mayor At- kins. CONSENT CALENDAR A. APPROVAL OF MINUTES - Regular Meeting of February 17, 1987 Approved as written. B. RECOMMENDATIONS FROM PARKS AND RECREATION COMMISSION MEETING OF FEBRUARY 18, 1987 (1) REQUEST FOR USE OF FACILITIES AT LIVE OAK PARK - SEQUOIA UNION SCHOOL DISTRICT Council approved use of the facilities at Live Oak Park on April 30 and May 1 on a fee -free basis by the Sequoia Union School District subject to the required Certificate of Insurance. (2) REQUEST FOR USE OF LIVE OAK PARK - TEMPLE CITY YOUTH FOOTBALL Council approved the yearly request from Temple City Youth Football for-use of Live Oak Park for the 1987 football season. Approval was given subject to requirements of concession stand clean- liness, litter control, protection of the turf, insurance requirements and payment for electricity used. 15 3q3 Council Minutes, March 3, 1987 - Page 2 C PLANNING COMMISSION ACTION FROM THEIR REGULAR MEETING OF FEBRUARY 24, 1987 City Council received and filed the memo from the Plan- ning Commission outlining action taken at the Commis- sion's meeting of February 24. D. APPROVAL OF FINAL MAP, TRACT NO. 44413; SIX -UNIT RESI- DENTIAL CONDOMINIUM LOCATED AT 5632 McCULLOCH AVENUE; APPLICANT: KENNETH T. HUANG City Council approved the CC & R's; approved the map; accepted the streets as offered for dedication on said map; and made findings as outlined in staff memo dated February 23, 1987. E. RESOLUTION NO. 87 -2698: EMPLOYMENT OF BUDGETED PERSONNEL Council adopted Resolution No. 87 -2698 appointing budgeted personnel. F. RESOLUTION NO. 87 -2699: APPROVAL OF PAYMENT OF BILLS Council adopted Resolution No. 87 -2699 authorizing the payment of bills. RECESS TO CRA: At this time Council recessed to meet as the Temple City Community Redevelopment Agency; approved the Minutes of the February 17 meeting; continued condemnation proceedings on property located at 5721 Rosemead Boulevard; authorized staff to solicit "Request for Qualifications" from develop- ers for Block "A "; adopted Resolution CRA 296: Warrants and Demands in the amount of $2,013.42; and held an executive session regarding property acquisition in Block "A" follow- ing the City Council meeting. The Minutes are set forth in full in the records of the Agency. 6. UNFINISHED BUSINESS: A ORDINANCE NO. 87 -600 (SECOND READING) ZONING CODE AMEND- MENT - ADDITION OF PERMITTED OR CONDITIONAL USES WITHIN VARIOUS ZONING DISTRICTS IN THE CITY City Manager Koski stated that on February 17, 1987, the City Council held the first reading of Ordinance No. 87 -600, amending Section 9165 of the City's Zoning Code relating to the clarification' of ambiguity process. It has been determined that, should the Ordinance be adop- ted, the process of addition and /or deletion of certain uses in a given zone would be simplified. Councilman Swain moved waive further reading by title only, seconded by Councilman Froehle and unanimously carried. Councilman Swain moved to adopt Ordinance 87 -600, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 9165 OF THE ZONING CODE RELATING TO CLARIFICATION OF AMBIGUITY, seconded by Councilman Froehle and carried on a roll call vote. PUBLIC HEARING: GENERAL PLAN UPDATE Dale Beland of Cotton /Beland /Associates Inc. advised that the General Plan before the Council and residents this evening is a completely revised plan that includes all mandatory elements as required by the Government Code and was drawn up following a series of public hearings conducted by the Planning Commission and data collected via a City -wide survey. Mr. Beland emphasized that what is proposed for adoption is not a new General Plan but rather an existing General Plan being updated to be consistent with current land use policies and existing zoning in general conformance with State law. This General Plan acts as a blueprint for the City's development, projecting where the City will be 10 -20 years from today. The law now requires that a city's General Plan and Zoning Ordinance be consistent, working together toward the same end. In addition, the Environ- mental Impact Report is also under consideration at this time. The following chart was reviewed to indicate the reduc- tion in development which would occur with the proposed changes to the City's General Plan. These documents deal with the environmental assessment, the technical studies, and the General Plan itself with all seven elements which are required to be addressed in a General Plan. Councilman Swain moved to have all Minutes of Planning Commission meetings, records of community meetings and all comments, correspondence and petitions from resi- dents concerning the General Plan be made a part of the records of the City Council General Plan public hear- ings, seconded by Councilman Froehle and unanimously carried. Councilman Swain commended Cotton /Beland for the manner in which all meetings with respect to the General Plan have been handled and for the quality of work done. She also wanted to thank City staff for all their effort; the residents for their participation and interest; and especially appreciated the Planning Commission for their diligence in carrying on the many meetings and public hearings as well as the recommendations proposed. Mayor Atkins declared the public hearing open and turned the hearing over to Dale Beland for presentation. Mr. Beland reviewed areas indicated on Maps A through G of the present General Plan giving the present land use and also the proposed General Plan designation. The following were comments made by residents in relation to the following areas: Map B, Area 5. Pete Weise, 6119 North Oak, approved of the low density recommendation as he felt that this area had heavy child traffic and would be concerned about safety should it be designated medium density. Councilman Swain stated that most lots in this particu- lar area have more than one residence, one as many as six, and most are three on a, lot, which would indicate that it is not at present a single family use; and the Commission's recommendation should be carefully consid- ered in this particular instance. Bob Pitts, 5312 Degas, inquired if there has been any change in park and open space area when considering changes to the General Plan. It was his hope that consideration would be given to a park being planned for the northern segment of the City. Mayor Atkins responded that no such plan was considered as it was not feasible since there are legal precedents with respect to designating future parks on General Plans. Map C, Area 6. Wayne Eddington, 5816 Myda Avenue, stated that he was against changing the area from a single family residen- tial to a medium density residential since all proper- ties in the area with the exception of one are single family structures. 15 387 Council Minutes, March 3, 1987 - Page 5 .. i Mr. Beland responded that it was the Commission's opin- ion that, since the general area just south of Area 6 is commercial, it would be more appropriate to have a higher density residential area in lieu of single family homes. The general theory is that there is more oppor- tunity in a higher density designation to build in the kinds of mitigations that are necessary to assure com- patible land use, which is difficult to accomplish when single family homes are abutting commercial property. Tricia Bogle, 5127 Golden West, questioned the area directly below Area 6, stating the map indicates a tract and she felt it was the area of the Edwards Theater. Mr. Beland responded that the maps show existing parcel boundaries and many of the parcels are from old tracts which have been converted over time to commercial uses. Such is the case in this instance and the tract is in reality the Edwards Theater. Mary Harkins, 5817 Myda Avenue, advised that she was unclear as to what could be done on property such as hers designated medium density. Ms. Harkins was under the impression that her property was within the CRA and was concerned that the property might be considered for development by the Community Redevelopment Agency. Councilman Swain assured Ms. Harkins that her property was not within the CRA area, and that she could develop her property as she saw fit up to that which is allowed in a medium density residential zone. Map C, Area 11. Pete Weise, 6119 North Oak, it was the opinion of Mr. Weise that Areas 5, 6, 8 and 11 should be designated low density. Map D, Area 3. Ken Peterson, 5414 Robinhood, said that he did not agree with the decision to go to a medium density designation when there are three 10 -unit apartments in that area and it would seem more appropriate to stay with the high density residential designation. Map D, Area 6. Norman Snow, 5756 North Loma Avenue, stated that he is a resident of Area 6 which has been designated low density and is concerned about the designation given to Area 7 directly behind him and would prefer to see Area 7 given a medium density designation. Gary Feinstein, 9470 Pentland Street, asked what the net effect versus the current residential versus the current plan versus the current zoning of the proposal presently before the Council and residents? Mayor Atkins advised Mr. Feinstein that this type of information may be found in the three documents men- tioned prior to the commencement of the public hearing, and which are available at the City Hall and Library. Council Minutes, March 3, 1987 - Page 6 Map D, Area 7. Mrs. Eleanor Kreeble, 5803 Encinita Avenue, stated that she is in agreement with the high density designation. Rojeleo Mosio, 5762 North Loma, stated that he would like to see Area 7 designated medium density. Mrs. Snow, 5756 North Loma, stated that she would not object to a higher density behind her property, which is designated low density residential, if the structures were limited to one story. Councilman Gillanders reminded Mrs. Snow that two -story homes are permitted anywhere in the City. Councilman Gillanders inquired as to why the recommenda- tion for Area 7 on the west side was different from Area 8 on the east side. Mr. Beland responded he assumed the decision of the Commission was in reaction to what is presently in the immediate vicinity, which is substantially multiple residential, and a long- standing General Plan policy that would permit commercial development for a portion of the area. At 9:20 p.m. City Council recessed and reconvened at 9:35 p.m. Tricia Bogle, 5127 Golden West, inquired if it would be possible to secure a copy of each map prior to the next meeting and if there was any way it could be decided by the City Council as to which maps would be discussed at the upcoming meetings. Mrs. Bogle also stated that no report of resident comments from neighborhood meetings have ever been made available even though a point of taking names and addresses of those interested in re- ceiving this type of report was made. In addition, she advised that the documents referred to by Mayor Atkins prior to the commencement of this evening's public hearing were not available at the library when the public hearings were being conducted by the Planning Commission. City Manager Koski advised Mrs. Bogle that the City staff would assist in getting whatever materials or information residents require for the public hearings concerning the General Plan. Mayor Atkins said that it would be very difficult to determine ahead of time how many maps the Council would be able to cover at a particular meeting since this would be determined by resident input on each area of each map. Mr. Beland responded to Mrs. Bogle's comment that, "no information had been received on the results of the neighborhood meetings ", by saying that to his knowledge this information was mailed to those who had signed up. 1, 383 Council Minutes, March 3, 1987 - Page 7 Councilman Swain advised Mrs. Bogle that it is possible the library has the documents on the General Plan, but that they either are unaware of what they contain or perhaps have misplaced them. The City is unable to answer for the County Library. In any event, these documents are available at the City Hall. Map E, Area 3. Mr. Beland advised that there has been a change due to a mapping error on Area 3. The lot on the south end of Area 3 is incorrectly shown as high density and should be part of Area 4 commercial. Map E, Area 5. Councilman Swain suggested that Map M be considered with this area since the properties directly across the street to the east are on Map M and the letter and petition which the Council received cover both these areas. In order to better determine a decision on the designation for this area, both Maps should be consid- ered together. Kelly Haveland, representing property owners in Area 5, distributed to the Councilmembers copies of a petition submitted to the Planning Commission at the time of their public hearings indicating that the property owners wished to have their properties designated high density residential. He went on to say that out of the 20 properties in the Area, 14 property owners have signed this petition. Janet Adamanuk, 5813 Cloverly, stated that she favored having the area designated high density residential. Pete Weise, 6119 North Oak, felt that, when a survey is made regarding a particular area, the survey should include adjacent areas as they also will be impacted. A high density designation directly adjacent to a low density will have a definite impact on the neighborhood. Nick Toweil, 5031 Baldwin Avenue, said that this was his first time at a City Council meeting and was unfamiliar with the terms low, medium and high density and inquired if there was perhaps a flier giving an explanation of the various terms and designations used in zoning. Mayor Atkins recommended to Mr. Toweil that he contact David Saldana of the Planning Department during regular business hours and he will assist. Map G, Area 3 Chris Gubler, 9441 East Broadway, supported the medium residential designation for this area. Councilman Gillanders moved to continue the public hearing to the next meeting of the City Council on March 17, 1987, seconded by Councilman Froehle and unanimously carried. 8. COMUNICATIONS: A. REQUEST TO REPLACE A FENCE AT 9404 OLIVE STREET City Manager Koski provided background information stating that the fence along the Alessandro frontage of 9404 Olive Street was removed by the contractor to make room for the new curb and gutter in the widening of Alessandro between Blackley and Olive. The owner, Mr. 1 ..5 381 Council Minutes, March 3, 1987 - Page 8 Hsien Fu, and his attorney, Mr. John Ko, met with the Public Works Coordinator, indicating that it was Mr. Fu's assumption that the City would replace the fence. Cost of replacing the fence is estimated at $3,000 and the owner is asking for compensation. Councilman Gillanders moved to authorize staff to nego- tiate an acceptable compromise for replacement of the fence, seconded by Councilman Swain and unanimously carried. B. PERFORMING ARTS BOOSTERS OF TEMPLE CITY - REQUEST TO HANG BANNER FOR TEMPLE CITY HIGH SCHOOL MUSICAL PRODUC- TION SOUTH PACIFIC Councilman Swain moved to consider item 8. B. due to the fact that the "subsequent need" arose after the posting of the Agenda on February 27, seconded by Coun- cilman Gillanders and unanimously carried. Councilman Gillanders moved to approve the request of the Performing Arts Boosters of Temple City to have Temple City High School hang a banner publicizing the musical, South Pacific, subject to receipt of the Cer- tificate of Insurance naming the City additionally insured, seconded by Councilman Swain and unanimously carried. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one wished to address Council. RECESS TO CRA: At this time Council recessed to meet as the Temple City Community Redevelopment Agency; approved the Minutes of the February 17 meeting; continued the matter of a Resolution of Public Condemnation of Certain Real Property in Rosemead Boulevard Redevelopment Project to the meeting of the 17th; authorized staff to solicit Request for Qualifications from developers for Block "A "; and adopted Resolution CRA 296: Warrants and Demands in the amount of $2,013.42. 10. ACTION ON REQUEST BY CRA: None 11. MATTERS FROM CITY OFFICIALS: A. REQUEST FOR AUTHORIZATION TO ATTEND ANNUAL MEETING OF THE CITY CLERK'S ASSOCIATION OF CALIFORNIA IN SACRAMENTO APRIL 8 - 11, 1987 Councilman Swain moved to approve the attendance of the Chief Deputy City Clerk at the annual meeting of City Clerk's Association in Sacramento April 8 - 11, 1987; authorized necessary expenditures; and amend the adopted budget accordingly, seconded by Councilman Gillanders and unanimously carried. B. REQUEST FOR AUTHORIZATION TO ATTEND ANNUAL CALIFORNIA MUNICIPAL TREASURERS SEMINAR AND WORKSHOP IN COSTA MESA APRIL 21 - 24, 1987 Councilman Froehle moved to approve the attendance of the City Treasurer at the California Municipal Trea- surers Seminar and Workshop in Costa Mesa April 21 - 24, 1987, seconded by Councilman Swain and unanimously carried. 1S 379 1 1 Council Minutes, March 3, 1987 - Page 9 12.
