PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR CRUSE- NICHOLSON President Oler called the meeting to order and the following business was conducted: ROLL CALL Present were: Doug Goss, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Lary Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Lisa Scheib, Ordinance Violations Clerk; Stephanie Hill Alexander, Jeff Norris, Information & Technology; Tim Brown, Deputy Fire Chief, Gary Turner,, Tony Foster, Metropolitan Development; Sandra Spencer, Controller, Greg Steins, Engineer; Richard Jeffers; Sergeant at Arms; and, Media. APPROVAL OF MINUTES Councilor Miller moved to amend the minutes of June 15, 2015 re Ordinance No. 30 -2015 to reflect the vote for engrossment was defeated with the dissenting vote of Councilor Miller; therefore, the Ordinance will be heard on third reading on July 6, 2015, and to approve the amended minutes of the meeting held June 15, 2015, supported by Councilor Winget. Upon a vote viva voce, the motion carried. Councilor Wissel moved to approve the minutes of the Special Meeting held June 29, 2015, supported by Councilor Hollis. Upon a vote viva voce, the motion carried. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS - None COMMUNICATION FROM THE MAYOR - None REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the June 11, 18 & 25, 2015, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS • Mr. Norris reviewed recent events/issues related to the GEMS financial management program. The Company is working to restore lost data. Mr. Norris will keep Council apprised of the progress. MISCELLANEOUS BUSINESS • MORRISON REEVES LIBRARY BOARD NOMINATION/APPOINTMENT: The Board of Trustees for Morrison Reeves has recommended Adam Reising to fill the unexpired term of Laura Retherford. Additional nominations may be received until the July 20, 2015 meeting. Dissenting was Councilor Quinn. Ordinance No. 36 -2015 will be heard on public hearing July 20, 2015. ORDINANCES ON FIRST READING Councilor Parker moved to suspend the rules and read Ordinance Nos. 39, 40, 41 & 42 2015 on first reading by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 39 -2015 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (CIT Realty, LLC) — Real Estate The Clerk read Ordinance No. 39 -2015 on first reading by title only. This Ordinance is a petition of CIT Realty, LLC for a ten year tax abatement on real estate valued at Three Hundred Twenty Five Thousand Dollars and zero cents ($325,000.00). Ordinance No. 39 -2015 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 40 -2015 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF TRANSPORTATION (Rose View) The Clerk read Ordinance No. 40 -2015 on first reading by title only. This Ordinance is a revision to Ordinance No. 40 -2015 which was approved in May, 2015 for Rose View Transit's 2016 grant application to the Indiana Department of Transportation, Section 5311 for operating and capital funds. Councilor Miller moved to advance Ordinance No. 40 -2015 to second reading and read by title only, supported by Councilor Miller. Upon a vote viva voce, the motion carried. Council President Oler declared Ordinance No. 40 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 40- 2015, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 40 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 40 -2015 on third reading by title only. Ordinance No. 40 -2015 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 41 -2015 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF HOMELAND SECURITY FOUNDATION (Fire Dept.) The Clerk read Ordinance No. 41 -2015 on first reading by title only. The Richmond Fire Department has been awarded a Four Thousand Dollars and zero cents ($4,000.00) Foundation Grant from the Indiana Department of Homeland Security. This grant is a reimbursement grant which means the City has to purchase the items and the State will then reimburse the City of Richmond. These funds would be used to purchase 6 -8 Tactical Ballistic Vests for the protection of the ambulance personnel responding to incidents. There being no comments for or against the Ordinance, Councilor Hollis moved for engrossment of Ordinance No. 41 -2015, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Ordinance No. 41 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 41 -2015 on third reading by title only. Ordinance No. 41 -2015 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 42 -2015 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE UNITED STATES FEDERAL AVIATION ADMINISTRATION (Airport) The Clerk read Ordinance No. 42 -2015 on first reading by title only. This Ordinance is a request to accept an appropriation of funds that are available by the Federal Aviation Administration through its Airport Improvement Program. The Indiana Department of Transportation and the Richmond Municipal Airport would each provide matching funds of 5% of the Funds awarded. If awarded, these funds will be used for costs associated with the Runway 15 -33 Pavement Rehabilitation, Lighting and Standards Correction Design Project. Councilor Miller moved to advance Ordinance No. 42 -2015 to second reading and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion carried. Council President Oler declared Ordinance No. 42 -2015 on second reading and public hearing. There . being no comments for or against the Ordinance, Councilor Wissel moved for engrossment of Ordinance No. 42 -2015, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 42 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 42 -2015 on third reading by title only. Ordinance No. 42 -2015 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 342015 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 ( Vandor- Industries Road -IT Equipment and Machinery) The Clerk read Ordinance No. 34 -2015 on first reading by title only. This Ordinance is a petition of Vandor for a ten year tax abatement for IT equipment and manufacturing machinery valued at One Million One Hundred Thousand Dollars and zero cents ($1,100,000.00). Councilor Wissel moved to delete the information and technology equipment valued at Seventy Five Thousand Dollars and zero cents ($75,000.00) and present a separate ordinance for a five year tax abatement for said equipment at the July 20, 2015 meeting, supported by Councilor Quinn. There being no comments for or against the Ordinance, Councilor Quinn moved for engrossment of Amended Ordinance No. 34 -2015, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Amended Ordinance No. 34 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 34 -2015 on third reading by title only. Amended Ordinance No. 34 -2015 was adopted with a 9-0 roll call vote. ORDINANCE NO. 35 -2015 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 ( Vandor— Rich Road -IT Equipment and Machinery) The Clerk read Ordinance No. 35 -2015 on second reading by title only. This Ordinance is a petition of Vandor for a ten year tax abatement for IT equipment and manufacturing machinery valued at Six Hundred Seventy Thousand Dollars and zero cents ($670,000.00). Councilor Miller moved to delete the information and technology equipment valued at Forty Thousand Dollars and zero cents ($40,000.00) and present a separate ordinance for a five year tax abatement for said equipment at the July 20, 2015 meeting, supported by Councilor Quinn. Upon a vote viva voce, the motion carried. Council President Oler declared Amended Ordinance No. 35 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Amended Ordinance No. 35 -2015, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Amended Ordinance No. 35 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 35 -2015 on third reading by tide only. Amended Ordinance No. 35 -2015 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 37-2015 — AN APPROPRIATION ORDINANCE AMENDING THE 2015 BUDGET (First Response) The Clerk read Ordinance No. 37 -2015 on second reading by title only. This Ordinance would authorize the transfer of Four Hundred Eighty Eight Thousand Six Hundred Dollars and zero cents ($488,600.00) from the First Response Fund into General Fund line items for the Fire Department. Council President Oler declared Ordinance No. 37 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Wissel moved for engrossment of Ordinance No. 37 -2015, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 37 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. ORDINANCE NO. 38-2016 — AN APPROPRIATION (TRANSFER) ORDINANCE AMENDING THE 2015 BUDGET (Finance) The Clerk read Ordinance No. 38 -2015 on second reading by title only. This Ordinance would authorize the transfer of Thirty Six Thousand Dollars and zero cents ($36,000.00) from Regular Salaries to Contractual Services. These funds would be appropriated for H.J. Umbaugh for assistance in preparing the 2016 Budget and monthly reconciliation from March through December, 2015. Council President Oler declared Ordinance No. 38 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Wissel moved for engrossment of Ordinance No. 38 -2015, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 38 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Parker. ORDINANCES ON THIRD READING ORDINANCE NO. 30 -2015 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Primex- Machinery) The Clerk read Ordinance No. 30 -2015 on third reading by title only. This Ordinance is a petition of Primex Plastics Corporation for a ten year tax abatement for manufacturing equipment valued at Five Million Nine Hundred Ninety Five Thousand Six Hundred Twenty Two Dollars and zero cents ($5,995,622.00). The Tax Abatement Committee recommended approval. Ordinance No. 30 -2015 was adopted with a 9 -0 roll call vote.
