WHEREAS, Marjorie L. Dix, Trustee, Tom D. Smith, Jeanette A. Smith, Charles Dix Smith and Alice L. Smith, owners of the real estate hereinafter described, having submitted to the City Council a plat of said real estate, being located in Jefferson City, Cole County, Missouri, and more particularly described as follows: Part of the West Half of the Southwest Quarter of Section 3, Township 44 North, Range 12 West, in the City of Jefferson City, Cole County, Missouri, more particularly described as follows:From the southeast corner of the West Half of the Southwest Quarter of said Section 3; thence N3°52'04"W, along the Quarter Quarter Section Line, 1961.82 feet to the northeasterly corner of MONTICELLO ACRES SECTION FIVE as recorded in Plat Book 11, page 420, Cole County Recorder's Office and the POINT OF BEGINNING for this description; thence N75 012'35"W, along the northerly line of said MONTICELLO ACRES SECTION FIVE, 404.75 feet; thence S74 022'24"W, continuing along the northerly line of said MONTICELLO ACRES SECTION FIVE, 105.11 feet to the most easterly comer of LOT 6 of SMITH PLACE ADDITION THREE, as recorded in Plat Book 12, page 168, Cole County Recorder's Office; thence N35 042'24"W, along the easterly line of said LOT 6, . 270.17 feet to the most southerly corner of the tract described in Book 361, page 340, Cole County Recorder's Office; thence N51°04'31"E, along the southeasterly line of said tract described in Book 361, page 340, 250.00 feet to the southwesterly right-of-way of SMITH PLACE; thence S35 042'24"E, along said southwesterly right- of-way line of SMITH PLACE, 175.00 feet; thence continuing along the right-of-way line of SMITH PLACE, northerly, on a curve to the left having a radius of 50.00 feet, an arc distance of 235.62 feet (Ch=N9°17'36"E, 70.71 feet) to the northeasterly right-of-way line of SMITH PLACE; thence N35 042'24"W, along the northeasterly right-of-way line of SMITH PLACE, 65.00 feet to the most southerly corner of LOT 2 of SMITH PLACE ADDITION NO. Containing 5.21 acres WHEREAS, it appearing that said plat has been fully and properly signed and accepted by the owner of said subdivision, known and referred to as the Plat of Smith Place Addition, Section Five, that all taxes have been paid, and that in all respects the requirements of Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owner of said subdivision, and that in all respects the requirements of the Planning and Zoning Commission of the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with. • 1 • NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1 . That the plat of Smith Place Addition, Section Five, lying, being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said plat attached hereto and made a part of this ordinance, is hereby approved and accepted by the City Council of the City of Jefferson, Missouri. SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of Jefferson. SECTION 3. This ordinance shall be in full force and effect from and after the date of Its passage and approval. Application filed by Toni D. Smith, property owner, for approval of a final subdivision plat of Smith Place Addition Section Five. The proposed subdivision contains 3 lots upon 5.21 acres,located approximately400 feet west and south of the intersection of West Truman Blvd with North Ten Mile Dr,in the west half of the southwest quarter,Section 3,Township 44 North, Range 12 West(Central Missouri Professional Services). Nature of Request The applicant requests approval of a three-lot final plat. Staff Analysis The preliminary plats for Smith Place Addition were approved in 1992-1993.All three lots contain areas in excess of 1.5 acres. Zonine. All lots in this section are zoned PUD Planned Unit Development. Individual site plans will be required for each lot in the absence of a subdivision-wide development plan. Access/Streets. Streets are existing in this subdivision, consisting of one local street (Smith Place) that provides access to the proposed lots. Stormwater. Refer to the engineering staff report. [Utilities, Water,sanitary sewer,gas,underground electric,telephone and cable TV lines are existing,located in the right-of-way of adjacent streets or nearby utility casements. • Sidewalks, This subdivision predated the sidewalk requirement. Additionally,development of the proposed lots would not trigger installation of sidewalks since Smith Place is classified as local street. Staff Recommendation Approval is in order subject to the following conditions: 1. Compliance with the recommendations and technical corrections of the Engineering Division. • Jefferson City Planning & Zoning Commission Meeting Engineering Division Staff Report Thursday, July 13, 2006, 5:15pm Item 7. -Other New Business Case No. P06029-Final Plat of Smith Place Addition, Section Five (5),Smith Place (PUD) COMMENTS: The Engineering Division has done a technical review of the latest submittal of the final plat as submitted by Central Missouri Professional Services Inc. Almost all items concerning Engineering Division review in Section 33-8. of the Subdivision Code pertaining to final plat contents have been addressed. The following comments are regarding this review; Regarding the final plat: A few minor clarifications remain The proposed final plat conforms with the approved preliminary plat of Smith Place Addition. iRegardine Infrastructure, Infrastructure is existing in the vicinity to serve the subdivision. However, to serve the proposed lots some new infrastructure will need to be constructed including, ute tility extension(s), and a street light. Storm Water/Erosion Control- Enclosed systems are previously constructed to intercept drainage from the proposed lots of the subdivision. Erosion control plans will be needed as a part of individual site plans for each proposed of Sanitary Sewer- Sanitary sewer has been previously constructed to serve the proposed lots. Sidewalk, Sidewalk was not a part of the previously approved preliminary plat, so is not required for final plat approval. Streets- The existing street is 30' back of curb to back of curb. Fire Hydrants/Street Lights- . Facilities were previously proposed for the subdivision. A street light will need to be constructed at the end of Smith Place, Traffic Impact/Access- Access to the proposed subdivision will be from Smith Place. Truman Blvd. is classified as a minor arterial roadway. (From City of Jefferson List of Functional Roadway Classifications, April 12, 2000) and the Countywide GBA Transportation Study, 2003. Truman Blvd. is a three(3) lane roadway with no parking allowed and one(1) turn lane provided. Site distance is adequate for access to lots from Smith Place. ENGINEERING STAFF POSITION: Conditionally support,with specific technical comments as underlined above to be addressed on a revised cony of thepreliminary plat,prior to final plat and infrastucture plans consideration by the City. • •
