AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND
MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY
REZONING FROM M-2 GENERAL INDUSTRIAL TO C-2 GENERAL COMMERCIAL, 1.24 ACRES
OF LAND LOCATED AT 227 METRO DRIVE, CONSISTING OF LOT 18, BAR'S COMMERCIAL
PROPERTY, SECTION 11, JEFFERSON CITY, COLE COUNTY, MISSOURI.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with.
WHEREAS, The zoning ordinance requires consistency between the comprehensive plan and the
zoning map and the proposed zoning change would not necessitate a change to the
Comprehensive Plan Development Plan Map.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from M-2 General Industrial to C-2
General Commercial: Lot 18, Bax's Commercial Property, Section 11, Jefferson City, Cole County,
Missouri, consisting of approximately 1.24 acres of land, addressed as 227 Metro Drive.
• Section 2. This ordinance shall be in full force and effect from and after Its passage and
approval.

a.. The existing zoning was in error at the time of adoption.
There was no error in the original zoning.
b. There has been a change in character in the area sue to installation of public
facilities, other zone changes, new growth trends, neighborhood deterioration, or
development transitions.
The area has generally developed as retail, commercial and office use.
C. There is a community need for the proposed rezoning.
The proposed use is beneficial to the community.
d. The proposed change is consistent with, and in furtherance of, the implementation
• of the goals and policies of the Comprehensive Plan, other adopted plans, and the
policies, intents and requirements of this Ordinance and other City regulations and
guidelines.
The proposed change would be consistent with the 1996 Comprehensive Plan
which shows the area as commercial.
C. The proposed zoning is compatible with the zoning and uses of property nearby.
The proposed use and zoning would be compatible and complimentary
with adjoining uses.
f. Public and community facilities, which may include, but are not limited to,
sanitary and storm sewers,water, electrical service, police and fire protection,
schools,parks and recreation facilities, roads, libraries, and solid waste collection
and disposal, are available and adequate to serve uses authorized under the
proposed zoning.
All public services are available and adequate.

g. A traffic impact analysis has been provided to indicate the potential number of
new trips generated and provisions are provided to mitigate impacts of high
traffic-generating projects.
No site specific traffic impact study would be required.
h. Authorized uses shall not adversely affect the capacity or safety of the street
network in the vicinity of the property.
There would be no significant impact on the existing street network.
1. Potential environmental impacts (e.g., excessive storm water runoff, water
pollution, air pollution, noise pollution, excessive lighting,or other environmental
harms)of authorized uses shall be mitigated.
There would be no additional environmental impact.
j. There is an adequate supply of land available in the subject area and the
surrounding community to accommodate the zoning and community needs.
The site is 1.24 acres and more than adequate in size.
k. Benefits shall be derived by the community or area proposed to be rezoned.
The community will benefit by the development of a non public high school for
alternative education.

The subject site is located on the east side of Metro Drive,about 750 feet south of Industrial Drive. 71te site is
currently zoned M-2 General Industrial,and was previously leased to the State for office space.

• Nature of Reauest
The applicant is proposing to rezone the property from M-2 General Industrial to C-2 General Commercial.
The applicant has filed a concurrent application to the Board of Adjustment for a Conditional Use Permit to
allow the existing office building to be converted to a private parochial high school,a conditional use of the
C-2 General Commercial zoning district.
Access
Access to the site would be from two existing driveways on Metro Drive. Metro Drive is classified as a local
street which provides access to abutting property.
Comprehensive Plan
The subject site is designated as"Commercial"on the Comprehensive Plan Land Use Map.
Staff Analysts
The use and character of the subject site and adjacent properties on Metro Drive could be accommodated by a
lesser zoning intensity than the current M-2 zoning designation. Since the existing uses are primarily
commercial in nature,and the Development Plan supports commercial uses there,it scents reasonable to allow
property owners to place further restrictions on the uses available on their land.
Staff Recommendation
Staff has no objection to the rezoning request.
