1971, with Mayor .Ross presiding and. all councilmen present.
Minutes of the previous meetings were approved as read on a
motion by Hippen, seconded by Eckhoff. Carried.
On a motion by Claassen, seconded by Van Deest, the treasurer's
re -pout was accepted as read. Carried.
Huisman made a motion which was seconded by Eckhoff to allow

A motion was made by Eckhoff, seconded by Van Deest, to suspend
the rules and pass on first reading Ordinance No. 44.12
establishing
grades on various streets and avenues in the Town of
Wellsburg.

The Council of Wellsburg, Iowa, met on the above date
in special session pursuant to law and the rules
of said Council and in accordance with the terms of a notice
of meeting, a copy of which was served on each member of the
Council within the time required by law and accepted in
writing by each member thereof, said notice of meeting being
as follows:

You are hereby notified that a meeting of the Council of
Wellsburg, Iowa, will be held on the llth day of May
1971, at the Town Hall at Wellsburg, Iowa, at 7.30 o'clock
P. M., for the purpose of introducing a Resolution Approving
Plans, Specifications and Form of Contract, and for such other
business in connection therewith as may come before the
meeting.

The meeting was called to order by Willard Ross
Mayor, and on roll call the following Council members were
present:
Herman H. Hippen, Thomas A. Claassen, Lester Huisman,
Ted Van Deest and Herman J. Eckhoff
Absent: None
This being the time and place fixed for a public hearing
on the matter of the adoption of plans, specifications and
form of contract for the construction of portland cement
concrete curb and gutter, together with necessary grading,
incidental street drainage facilities, and miscellaneous
related work, the Mayor called for any oral objections to
the making of said improvements, or to the adoption of the
plans, specifications and form of contract. No oral objections
were offered and the Clerk reported that no written objections
thereto had been filed.
Councilman Hippen
introduced the follow-
ing Resolution entitled "RESOLUTION APPROVING PLANS,
SPECIFICATIONS AND FORM OF CONTRACT" and moved that the
same be adopted. Councilman Claassen
seconded the motion to adopt. The roll was called and
the vote was,

NAYS: None
Whereupon, the Mayor declared the following Resolution
duly adopted:

RESOLUTION APPROVING PLANS,
SPECIFICATIONS AND FORM OF
CONTRACT
WHEREAS, on the 12th day of April 1971,
plans, specifications and form of contract were filed with
the Clerk of Wellsburg, Iowa, for the construction of portland
cement concrete curb and gutter, together with necessary
grading, incidental street drainage facilities, and miscellaneous
related work, within Wellsburg, Iowa; and
WHEREAS, said plans and specifications are consistent
and in compliance with the final grades heretofore established
by ordinance for all streets to be improved; and
WHEREAS, notice of hearing on plans, specifications
and form of contract was published as required by law:
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF
THE TOWN OF WELLSBURG, IOWA:
That the said plans, specifications and form of
contract are hereby approved as the plans, specifications
and form of contract for said improvements.
PASSED AND APPROVED, this llth day of May
1971.

The Mayor thereupon announced that a further purpose
of the meeting was to receive, open, consider and tabulate
bids for the construction of portland cement concrete curb
and gutter, together with necessary grading, incidental street
drainage facilities, and miscellaneous related work, in accordance
with the plans and specifications now adopted. The following
bids were thereupon received, opened and inspected and tabulated
by the Clerk:

Councilman Huisman introduced the
following Resolution entitled "RESOLUTION MAKING AWARD OF
CONTRACT" and moved its adoption. Councilman

Whereupon, the Mayor declared the following Resolution

OF CONTRACT
BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF
WELLSBURG, IOWA:
That the bid of
Watters Construction of Cedar Falls, Iowa
in the amount of $ 28,287.30 for the construction of
portland cement concrete curb and gutter, together with necessary
grading, incidental street drainage facilities, and miscellaneous
related work, within Wellsburg, Iowa, described in the plans
and specifications heretofore adopted by this Council on
May 11 , 1971, be and is hereby accepted, the
same being the lowest bid received for said work.
The Mayor and Clerk are hereby directed to execute
a contract with the said
Watters Construction of Cedar Falls, Iowa ,
for the construction of said improvements, said contract not
to be binding on the Municipality until approved by this
Council.
PASSED AND APPROVED, this llth day of May ,

1971, there was adopted a Resolution ordering construction
of portland cement concrete curb and gutter, together with
necessary grading, incidental street drainage facilities,
and miscellaneous related work, on the following streets or
portions thereof, within the Town of Wellsburg, Iowa, to -wit:
DESCRIPTION OF
PROPOSED WELLSBURG, IOWA, CURB & GUTTER PROJECT, 1971
Work to consist of construction of 30 inch portland cement
concrete integral curb and gutter, curbs to be constructed 32
feet back to back on the following streets or portions thereof:
On both sides of Second Street, from Monroe Street to Washington
Street.
On the west side of Monroe Street, from Fourth Street north
336 feet.
On the east side of Monroe Street, from Fourth Street to
Second Street.
On both sides of Madison Street, from Fourth Street to Second
Street.
On both sides of Jefferson Street, from Fourth Street to Second
Street.
On the west side of Adams Street, from Second Street to First
Street.
On both sides of Madison Street, from McAdoo Street to Wilson
Street.
Curbs to be constructed 40 feet back to back on the follow-
ing street:
On the north side of Third Street, from Monroe Street to
Jefferson Street.
On the south side of Third Street, from Monroe Street to
a point 120 feet east of Jefferson Street.

ASSESSMENT METHOD
Benefited private property will be assessed only for
the cost of the curb and gutter improvements, including
returns and alley crossings and incidental engineering,
administrative and other costs applicable to this
portion of the overall project. All other costs will
be paid for at the general expense of said Town.
A true copy of said Resolution is hereto attached
marked Exhibit "A".
I further certify that on the 12th day of May ,
1971, said Municipality of Wellsburg, Iowa, did enter into
contract with
Watters Construction of Cedar Falls, Iowa
for the construction of said improvements.
I further certify that attached hereto marked Exhibit
"B" is a true copy of the plat, estimated total cost of the
improvements and schedule of estimated assessments proposed
to be made on the benefited properties for the purpose of
paying for said improvements, filed with the Clerk in
accordance with Code Section 391.20 of the Code of Iowa,
1971.

A motion was made by Eckhoff and seconded by Hippen to
adopt Ordinance No. 54-7.
Roll call of votes:
Ayes: Claassen, Eckhoff, Hippen, Iluisman, Van Deest
Nays: None Absent -None
On a motion. by Eckhoff, seconded by Claassen, it was agreed
to suspend the rules and dispense with readings on. Ordinance
No. 23.9 prohibiting the construction, maintainance and use of
curb side postal.containers and declaring the same to be a
public nuisance.

A motion was made by Hippen, seconded by Huisman, to
adopt Ordinance No. 23.9.

A motion was made by Hippen and. seconded by Eckhoff to
close and fill with dirt the area previously used as the town
dump. Carried.
On a motion by Claassen, seconded by Van Deest, the town
will pay $200 towards the summer community baseball program.
Carried.
Following a motion by Eckhoff, seconded by Claassen, the
meeting stood adjourned.

The Wellsburg Town Council met in special session on June I.,
1971 with Mayor Ross and Councilmen Claassen, Hippen, Huisman,
and Van Deest present.
On a motion by Claassen, seconded by Huisman, the town clerk
was instructed to contact the city engineer and Contracter Paul
Watters for detailed prices and contract to complete storm sewer
on Monroe Street between Second and Third Streets abutting the
Snittjer property that was to be an open ditch according to the
or+qpgl contract. Motion carried.
