HomeMy Public PortalAbout2010-085 Resolution Approving Comp Plan Amend Regarding 1525 Deerhill RdMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 2010-85 RESOLUTION APPROVING A COMPREHENSIVE PLAN AMENDMENT REGARDING THE FUTURE LAND USE OF CERTAIN PROPERTIES AT 1525 DEERHILL ROAD AND 1700 DEERHILL ROAD WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Joanne Reiser Wolhfers ("Wolhfers") owns property in the City of Medina at 1525 Deerhill Road which has the property identification number 26-118-23-22-0001 on file with Hennepin County, Minnesota, and which is identified as parcel A in Exhibit A attached hereto ("Parcel A"); WHEREAS, Elizabeth Langdon Ringer ("Ringer") owns property in the City of Medina at 1700 Deerhill Road which has the property identification number 27-118-23-11-0002 on file with Hennepin County, Minnesota, and which is identified as parcel B in Exhibit A attached hereto ("Parcel B"); and WHEREAS, Ringer also owns the adjacent 8.78 acre property in the City of Medina having the property identification number 27-118-23-14-0003 on file with Hennepin County, Minnesota and which is identified as parcel C in Exhibit A attached hereto ("Parcel C"); and WHEREAS, Wolhfers and Ringer (collectively, the "Applicants") have requested approval of a Comprehensive Plan Amendment to change the future land use of their property from Rural Residential to Agricultural; and WHEREAS, the planning commission held a duly called public hearing on November 9, 2010 where testimony was heard from all interested parties and following the hearing recommended approval of the amendment; and WHEREAS, on December 7, 2010, the city council reviewed the amendment, considered the recommendations of the planning commission and heard comments from interested parties; and WHEREAS, the proposed amendment does not substantially change the type of development that is planned to occur in the area, and has no practical impact on the City's population forecasts or Traffic Assignment Zone allocations; and NOW, THEREFORE, BE IT RESOLVED, by the city council of the City of Medina, Minnesota, that the Comprehensive Plan amendment as identified in Exhibit B, attached hereto, is hereby approved, subject to the following terms and conditions: (1) The amendment shall not become effective until approved by the Metropolitan Council Resolution No. 2010-85 December 21, 2010 and formally adopted by the City Council; and (2) The amendment shall not become effective for Parcels B and C until such time as these lots are combined into one parcel; and (3) The Applicants shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the request and preparing relevant documents. BE IT FURTHER RESOLVED, that city staff is authorized to submit the amendment of the Comprehensive Plan to the Metropolitan Council for review. Dated: December 21, 2010. j7''1/k( T.M.
