HomeMy Public PortalAboutORD14093 BILL NO. 2006-60 • SPONSORED BY COUNCILMAN Oettino ORDINANCE NO. 14 015 5 AN ORDINANCE OFTHE CITY OFJEFFERSON, MISSOURI,AMENDING CHAPTER 19 (MOTOR VEHICLES & TRAFFIC), SECTION 317 (SAFETY BELTS), OF THE CODE OF THE CITY OF JEFFERSON, REQUIRING THE USE OF SEAT BELTS iN VEHICLES. NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1, Chapter 19 (Motor Vehicles&Traffic), Section 317(Safety Belts), of the Code of the City Jefferson, Missouri, is hereby amended as follows: CHAPTER i9 MOTOR VEHICLES AND TRAFFIC Sec. 19.317, Safety Belts • A. As used in this section,Ihe term"passenger car"nmeans every motor vehicle designed for carrying ten (10) persons or less and used for transportation of persons: except that, the term "passenger car"shall not include motorcycles,motorized bicycles,motor tricycles and trucks with a licensed gross weight of twelve thousand(12,000)pounds or more. B. Ench driver, except persons employed by the United States Postal Service while performing duties for that federal agency which require the operator to service postal boxes from their vehicles,or which require frequent entry into and exit from their vehicles,and front sent passenger of a passenger car manufactured after January I, 1968,operated on a street or highway in this city,and persons less than eighteen(18)years of age operating or riding in a truck,as defined in section 301.010, RSMo,on a street or highway of this state shall wear a properly adjusted and fastened safety belt that meets federal National Highway,Transportation and Safety Act requirements;except that,a child less than four(4)years of age shall be protected as required in section 210,104,RSMo.The provisions of this section and 19-318 shall not he applicable to persons who have a medical reason for faillne to have a seat belt fastened about their body,nor shall the provisions(if Ibis section be noulicable to persons while oneratine or rldine a motor vehicle beine used in auricultural work-related activilles, Noncompliance with this subsection shall not constitute probable cause for violation of any other Provision of law. The provisions of this subsection shall not ponly to the transporline of children under sixteen years of aec.as arovided in 19-318. C.
