AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A
CERTAIN EASEMENT FOR SANITARY SEWER PURPOSES ON PART OF LOT 743,
WESTVIEW HEIGHTS, SECTION 14.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
WHEREAS, by an easement recorded In Plat Book 11, Page 529, of the Records of the
Cole County, Missouri, a sewer easement was granted to the City of
Jefferson, a Municipal Corporation, to excavate within, install, construct,
maintain and repair structures for the routing and conveyance of sewer in,
under and through the lots, tracts or parcels of land described In Section 1;
Section 1. The Council finds that the following described easement is surplus
property of the City and is no longer needed for any public purpose:
All of the 10.00 foot wide Sanitary Sewer Easement, being part of Lot 743 of
• WESTVIEW HEIGHTS SECTION 14, as recorded in Plat Book 11, Page 529,
Cole County Recorder's Office, being more particularly described as follows:
From the most southerly corner of said Lot 743;thence N51 012'38"W,along the
southwesterly line of said Lot 743,85.00 feet to the most southerly corner of said
10.00 foot Sanitary Sewer Easement, and the POINT OF BEGINNING for this
description;thence N56 051'18"E,along the southeasterly line of said Easement,
85.21 feet to the line between Lots 743 & 744 of said WESTVIEW HEIGHTS
SECTION 14, also being the most easterly corner of said Easement; thence
N47°03'49"W, along the line between said Lots 743 and 744, also being the
northeasterly line of said Easement, 10.30 feet to the most northerly corner of
said Easement; thence S56 051'18"W, along the northwesterly line of said
Easement, 85.99 feet to the southwesterly line of said Lot 743, also being the
most westerly corner of said Easement; thence S51 012'38"E, along the
southwesterly line of said Lot 743, also being the southwesterly line of said
Easement, 10.52 feet to the point of beginning.
Section 2. The easement described in Section 1 is hereby relinquished, and the City
does hereby release and abandon whatever Interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to execute any necessary
legal document relinquishing all of the City's interest in the tract of ground described in Section
1.
