CITY OF MEDINA RESOLUTION NO.2011-03 RESOLUTION GRANTING FINAL PLAN APPROVAL FOR A CIVIL DEFENSE SIREN AT THE HENNEPIN COUNTY PUBLIC WORKS FACILITY WHEREAS, Hennepin County (the "County") is the owner of land near the intersection of T.H. 55 and Arrowhead Drive in Medina, which land is legally described as Lot 1, Block 1 and Lot 1, Block 2, Hennepin County Public Works Facility Addition, according to the plat on file in Hennepin County, Minnesota (the "Property"); and WHEREAS, on September 5, 1995, the city of Medina (the "City") rezoned the Property to Planned Unit Development ("PUD") and approved various uses for the Property (collectively, the "PWF"); and WHEREAS, in 2008, the County requested approval of an amendment to the PUD to permit construction of a wind energy conversion system ("WECS") and a civil defense siren (the "Siren") at the PWF; and WHEREAS, on November 18, 2008, the City adopted Ordinance No. 452, an ordinance amending the PUD for the PWF by approving a Concept Plan and General Plan of Development in order to allow the County to construct the WECS and the Siren at the PWF; and WHEREAS, Ordinance No. 452 required that the County obtain Final Plan approval for the WECS and the Siren and further required that the Final Plan approval and initiation of construction of the WECS occur within two years of November 18, 2008; and WHEREAS, more than two years have now elapsed since the approval of the Concept Plan and General Plan of Development for the WECS without the County obtaining Final Plan approval and initiating construction of the WECS. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota as follows: 1. Final Plan approval is hereby granted for the Siren. 2. The time to obtain Final Plan approval and to initiate construction of the WECS has expired and all prior approvals regarding the WECS are now null and void. Resolution No. 2011-03 January 4, 2011 3. Authorization for the mayor and city clerk -administrator to execute the First Amendment to Planned Unit Development Agreement, granted on October 5, 2010, is hereby rescinded.
