HomeMy Public PortalAbout2011-007 Resolution Approving Division of Property Referred to Holasek-Nolan Lot SplitMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION 2011-07 RESOLUTION APPROVING A DIVISION OF PROPERTY REFERRED TO AS THE HOLASEK-NOLAN LOT SPLIT WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, U.S. Home Corporation (the "Applicant") has made an application for a division of an unaddressed property on behalf of the Holasek and Nolan families; and WHEREAS, the subject property is identified in Hennepin County records with the property identification number of 12-118-23-43-0002; and WHEREAS, the subject property has the following legal description: Lot 13, Auditor's Subdivision No. 241, except that part of Lot 13, Auditor's Subdivision No. 241, Hennepin County, Minnesota described as follows: Beginning at the Southeast corner of Lot 14 of said Auditor's Subdivision No. 241; thence south along the most easterly line of said Lot 13 distant 2.3 feet; thence West parallel with the North line of said Lot 13 distant 656.35 feet; thence east along said northerly line 524.35 feet to the west line of said Lot 14; thence south along said west line 412.50 feet to the southwest corner of said lot 14; thence east along the south line of said Lot 14 to the point of beginning. WHEREAS, the proposed division would result two parcels as identified and described in Exhibit A, attached hereto; and WHEREAS, the City of Medina Planning Commission reviewed the proposed subdivision on January 11, 2011 and recommended approval of the request; and WHEREAS, the Medina City Council reviewed the proposed rezoning at the January 18, 2011 City Council meeting and directed the preparation of this resolution; and WHEREAS, the proposed subdivision is not in conflict with the general and specific plans of the City; and WHEREAS, the proposed subdivision meets minimum zoning standards, will not negatively impact the environment, will not negatively impact the provision and continued use of public and private rights -of -way, will not impair public health, and is suitable for the proposed use contemplated; and Resolution No. 2011-07 February 1, 2011 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that subdivision approval be granted to the Applicant, subject to the following terms and conditions: (1) Both resulting parcels shall be platted prior to the establishment of a new principal use or construction of any structure. Park dedication, the dedication of any remaining required easements, and any other required dedications shall be conveyed at the time of final approval of any such future development. (2) Both resulting parcels shall convey to the City a 33 foot wide right-of-way easement for Hunter Drive. (3) The resulting northern parcel shall convey a 10 foot wide trail easement adjacent to the Hunter Drive right-of-way for the northern 160 feet of the property. It is acknowledged that the area of this easement dedication does not account for the full dedication requirement of the City, and additional dedication shall be required upon future subdivision or platting of the parcel. The area of the easement dedication shall be credited against any future park dedication requirements of the resulting northern parcel. (4) The full amount of park dedication for both parcels shall be determined during the process of development of the lot in question, based on the relevant regulations and property values at that time. (5) The resulting northern parcel shall convey drainage and utility easements as follows: an easement 15 feet in width adjacent to the Hunter Drive right-of-way for the northerly 160 feet; an easement 10 feet in width adjacent to the Hunter Drive right-of-way, with the exception of the northerly 160 feet; and an easement 10 feet in width adjacent to the northern property line. (6) The resulting northern parcel shall be rezoned to R-2, Two -Family Residential. (7) All instruments to record the division and to place into effect the conditions of approval, including all easements required to be conveyed, shall be reviewed and approved by the City Attorney. (8) The Applicant shall meet the requirements of the City Attorney with regards to title issues and all recording procedures. (9) The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the proposed lot split, and for drafting and recording all relevant documents. (10) All necessary documents shall be recorded with Hennepin County to complete the division within 180 days or this approval shall be null and void.
