CITY OF MEDINA
RESOLUTION NO.2011-14
RESOLUTION CONDITIONALLY APPROVING A COMPREHENSIVE
PLAN AMENDMENT REGARDING A PORTION OF THE PROPERTY
OF "THE ENCLAVE" RESIDENTIAL DEVELOPMENT
WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and
existing under the laws of Minnesota; and
WHEREAS, certain property within the City, legally described in Exhibit A, attached
hereto (the "Property"), is guided partially Low Density Residential and partially Rural
Residential in the Future Land Use Plan of the City's Comprehensive Plan; and
WHEREAS, US Home Corporation (the "Applicant") has requested approval of a
Comprehensive Plan Amendment to change the future land use of approximately three acres of
the Property from Rural Residential to Low Density Residential and to change an equal amount
of net acreage of the Property from Low Density Residential to Rural Residential; and
WHEREAS, the planning commission held duly called public hearings on July 13, 2010
and October 12, 2010 where testimony was heard from all interested parties and following the
hearing recommended approval of the amendment; and
WHEREAS, on February 15, 2011 and March 1, 2011, the city council reviewed the
amendment, considered the recommendations of the planning commission and heard comments
from interested parties.
NOW, THEREFORE, BE IT RESOLVED, by the city council of the City of Medina,
Minnesota, that the Comprehensive Plan amendment as identified in Exhibit B, attached hereto,
is hereby conditionally approved, subject to the following terms and conditions:
(1) The amendment shall not become effective until approved by the Metropolitan Council
and formally adopted by the City Council; and
(2) Final adoption of the Comprehensive Plan Amendment by the City Council shall be
contingent upon approval of the preliminary plat of "The Enclave"; and
(3) The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City
for the cost of reviewing the request and preparing relevant documents.
BE IT FURTHER RESOLVED, that city staff is authorized to submit' the amendment
of the Comprehensive Plan to the Metropolitan Council for review.

and upon vote being taken thereon, the following voted in favor thereof:
Martinson, Pederson, Siitari, Weir
And the following voted against same: (Absent: Crosby)

Whereupon said resolution was declared duly passed and adopted.
