HomeMy Public PortalAboutRES-CC-2022-27CITY OF Moog UTAH CITY OF MOAB RESOLUTION 27-2022 ExT11v0/ V EMERGENCY ORDER 2022-01 REGARDING THE SEVERE FLOODING TH € T OCCURRED ON AUGUST 20, '072 WHEREAS, on August 20, 2022, severe rainstorms occun-ed in the; La Sal Mountains, Grand County, and in the City of Moab, Utah; WHEREAS, these rainstorms created a 100 -year flood event that caused flash flooding though the Pack Creek and Mill Creek drainages pith massive quantiti of debris, mud, and water; WHEREAS, the debris and flooding created impassable conditions on many roadways while also damaging, homes, private property, public roads, walk. paths, public use areas, and infrastructure throughout the City of Moab; WHEREAS, homeowners, public officials, and public works crews have taken measures to mitigate and prevent further damage by procuring and distributing sandbags, closing roads, and surveying affected areas to enact other emergency preventative measures; WHEREAS, these conditions had the potential to worsen, and have worsened, and iruinediate attention is needed to ensure the safety, health, and welfare of the citizens of the City of Moab; WHEREAS, on August 21, 2022, Mayor Joette Langianese executed Emergency Order 2022-©1 to declare an emergency pursuant to Utah Code § 53-2a-205; WHEREAS, Utah Code § 53-2a-208 authorizes the legislative body of the municipality by majority vote to extend the state of emergency in accordance with Utah Code Subsections 53-2a- 208(6)(b)(ii) and (iii) if done prior to the expiration date; WHEREAS, the Mayor finds the City of Moab requires additional assistance from the federal government; and WHEREAS, the aforesaid rainstorms, flooding, and conditions that resulted in the City of Moab constitute an ongoing "local emergency" and therefore necessitate the declaration be extended. NOW, THEREFORE, BE IT RESOLVED THAT: 1. Nature of the Local Emergency: A local emergency exists for the City of Moab due to the flooding and related impacts that resulted from the stone event on August 20, 2022, the impacts of which threatened and affected the entire City and continue to threaten and affect the 1 entire City. Emergency Powers and Operations: The City of Mt (Ibis emergency powers and operations are hereby invoked and City personnel and resources are ordered and authorized to perfi nn all functions authorized by federal, state, and local law to address this local emergency, including but not limited to those actions authorized under Utah Code § 53-2a-205. Assistance: The City of Moab is authorized to request all assistance available with respect to this local emergency from all federal, state, and local sources, and is authorized to participate ire or enter into any mutual aid a reeraer ►ts, 4i Terra. Einerpency Order 2022-01 is extended to February 1, ti22, pursuant to Utah Code Ann. Subsection 53 -2a -208(6)(b) and (iii) by the majority vote of the City Council Ossemi:nation: This resolution extending Emergency Order 2022-111 until February 1, 2023, will be: (a) filed with the Clerk of the City of Moab pursuant to Utah Code § 53-2a-209; (b) posted to the City of Moab's website, the 1..itah Public :Notice website, and applicable City social media accounts as determined by the City: Manager, and (e) delivered to Grand County and the State of Utah.
