An Ordinance Amending Section 6 -146 of the Greencastle City Code Regarding
Noise Ordinance Exceptions
WHEREAS, Section 6 -146 of the Greencastle City Code establishes excessive noise as a
public nuisance and regulates certain times when sound amplification . systems and other
machinery can be operated outside of buildings and other enclosed'strrictures;
WHEREAS, Section 6 -146 allows the Common Council to grant exceptions to the time
limitations set out in the Ordinance;
WHEREAS, the Common Council wishes to grant the Mayor the authority to grant
similar exceptions in situations where there will be no Common Council meeting prior to
the time when the exception is requested and the Mayor determines that an exception is
warranted under the circumstances.
NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF GREENCASTLE THAT:
Section 6 -146 (b) is hereby amended to read as follows:
b. No person shall operate any sound amplification system or any other machine,
device or equipment which produces sound outside of buildings or other enclosed
structures which would disturb the peace or welfare of the neighborhood between
the hours of 10:00 p.m. and 8:00 a.m. An exception may be granted upon request
to the Greencastle Common Council for a specific event. The Mayor shall have
the authority to approve requests when the event occurs prior to the next
Common Council meeting or under other unusual circumstances. The
Mayor shall notify the Common Council of any such approvals prior to the
time of the event.
All other terms and conditions contained in Section 6 -146 of the Greencastle City
Code shall remain in full force and effect.
This Ordinance shall take effect upon passage of the Greencastle Common
Council and its approval by the Mayor.
