NELSON, his wife, CHARLES CHASTAIN and MARTHA CHASTAIN, his wife, ROBERT CHASTAIN, a single mon, JACK D. PAYNE end PEGGY M. PAYNE, his wife, J.E. KERBY and IRETA KERBY, his wife, K. E. MCDOUGLAD end AUDREY McDOUGALD, hls wife, ANSEL E. ZUFELT and HEAH M. ZUFELT, his wife, end SOUTH EASTERN UTAH TITLE COMPANY, a corporation, request- ing that the City Council of Moab, Utah, enact en ordinance vacating Nelson Avenue end Chastain Street, as some appear on the official plat (of Utantum Village Su►division, Plat A, on file in She Recorder's Office of Grand County, Well, end, WHEREAS, sold petitioners ere the sole and only legal end equitable owners of the reel property which abutts and edjoins said streets sought to be vacated, and have given their written consent In sold Petition to the eneet■ent of such en ordinance, and have waived such netiso of intention to vacate by the governing body es Is pro- vided by low, and, WHEREAS, the owners above mentioned have egreed to convey to Moab City, or to dedicate to the public, whichever the city requests, She approximately oast 30 feat of Lots 1 through 10, inclusive, and the south part of Lot 10, in Sleek 4, Uranium Villege Subdivision, Plat A, fer use as a street, which street snail be known as 100 East Street, end an extenilen of Urenlum'Avenue to connect 1n to 100 Eost Street, and that said streets will then provide access and vehicular treys' to the area en which the new high school is being built. WHEREAS, it appears that the vacating of sold streets will enable the adjoining end abutting owners to Make more edventegeous use of their properties, and that the public will not be prejudiced by such action. NOW, TIOREFORE, BE IT RESOLVED by the City Council of Moab City, State of Utah, Section 1, TKO She full width of Nelson Avenue between Main Street on the West end Chastain Street on the East, end the full width of Chastain Street between Uranium Avenue on the South and Grand Avenue on the North, as said Nelson Avenue and said Chastain Street appear on the official plot of Uranium Village Subdivision, Plat A, filed in the Recorder** office of Grend County, Utah, on April 21, 1955, as Entry #260865, and recorded in Book of Plats et Pages 27-28, be, end the some are vacated end declared no longer to be public property for use es streets, avenues, alleys, or pedestrian ways. The reel property adjoining end abutting said Nelson Avenue end said Chasteln Street so vacated Is situate in Grend County, State of Utah, and particularly described as followss Lots 3,4,5 6,7 and 8 of Block 11; Lots 1,5,6,7,8, and 9 of Block -Ills end Lots 1, 2 3 4 5 6, 7, 8, 9 and 10 of Black IV, Uhran l um Village Subdi v i s i on, Plat A, accordingGo the affieial plat thereof, on file in o the Reeederls office of said county. Sold vacation is made expressly subject to ell existing rights of way end easements of ell public utilities of any and every kind end description, now located in, on, under, or over the confines of the said Nelsen Avenue and said Chest•In Street so vacated; and also subject to the right of entry thereon for the purpose of inspecting, maintaining, repairing, replacing, removing, altering, or rerouting sold utilities and all of them.
