RE80LUTION ASCERTAINING AND DETERI�SINING RATE OF PER DIEM WAGE3 AND THE GENERAL PREVAILING RATE OF PER DIEM WAGES FOR LEGAL HOLIDAYB AND OVER- TIME WORK IN THE LOCALITY FOR EACH CRAFT OR TYPE OF LABORER, WORKMAN OR MECHANIC NEEDED TO EXECUTE THE CONTRACT FOR FURNISHING AND DELIVERING CERTAIN MATERIALS AND SUPPLIES IN CONNECTION WITH THE ABOVE MENTIONED,IMPROVEMENT IN ACCORDANCE WITH PLAN9 AND 3PECIFICATIONB N0. 1951-B-1. BE IT RESOLVED by the City Council of the City of Lynwood, I California, as followe: WHERF.AS, purauant to an Act of the Legielature of the State of California, approved April 24, 1937, and known as the "Labor Code", the City Council of the City of Lynwood ia requlred to ascertain the general prevailing rate of per diem wages and the general prevailing rate of per diem vrages for legal holidaya and overtime work, in this locality, for each craft or tyue of laborer, workman or mechanic needed to execute the propoaed contract for the conatruction of curba, eide- walke and gutters in Peach Street, in accordance with Plans and 3peci- fications No. 1951-B-1 on file in the office of the City Clerk of the said City of Lynwood. ' Provided that notwithatanding the general provieion con- tained herein, Flagmen, Guarda, and Watchmen ahall be paid one and one-half times the prevailing rate for overtime (overtime shall be time worked in excess of eight houre per day or forty houra per week), and the atraight prevailing rate for time worked on 9aturdays, 8undays and Holidaya where such time doee not conatitute overtime. -2- The foregoing prevailing wage schedule is based upon a working day of eight houra, and in the event that laborere, workmen, or mechanics are employed less than eight houre per day, the rate of per diem wages ahall be deemed to be'that fraction of the fore- going rates that the number of hours of employment bears to eight. The rate of compensation for any clasaification not listed in the achedule, but which may be required to execute the proposed work, shall be commenaurate and in accord with the rates specified for eimilar and"comparable classification or for thoae performing aimilar or comparable dutiea.
