HomeMy Public PortalAbout2011-045 Resolution Adopting Comp Plan Amend Regarding 1700 Deerhill RdMember Siitari introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2011-45 RESOLUTION ADOPTING A COMPREHENSIVE PLAN AMENDMENT REGARDING THE FUTURE LAND USE OF 1700 DEERHILL ROAD WHEREAS, the City of Medina (the "City") has adopted a comprehensive plan pursuant to Minn. Stat. 462.355, 473.175 and 473.851 to 473.871 to regulate development and land use within the community (the "Plan"); and WHEREAS, on December 21, 2011, the City adopted Resolution 2010-85, which approved an amendment to the Plan to change the Future Land Use designation for the following three properties if certain conditions were met: "Parcel A" — property having the property identification number 26-118-23-22-0001 on file with Hennepin County, Minnesota, and which is identified as parcel A in Exhibit A attached hereto "Parcel B" — property having the property identification number 27-118-23-11-0002 on file with Hennepin County, Minnesota, and which is identified as parcel B in Exhibit A attached hereto "Parcel C" — property having the property identification number 27-118-23-14-0003 on file with Hennepin County, Minnesota, and which is identified as parcel C in Exhibit A attached hereto; and WHEREAS, Resolution 2010-85 stated that the amendment to the Plan shall not become effective until approved by the Metropolitan Council and formally adopted by the City Council; and WHEREAS, Resolution 2010-85 also required that the amendment shall not be effective for Parcels B and C until such time as these lots were combined into one parcel; and WHEREAS, on January 25, 2011, the amendment to the Plan was approved by the Metropolitan Council; and WHEREAS, on February 15, 2011, the City Council adopted Resolution 2011-09, which adopted the amendment to the Plan relative to only Parcel A because Parcel B and Parcel C had not yet been combined into a single parcel; and WHEREAS, Parcel B and Parcel C have now been combined into a single parcel, which is legally described in Exhibit B, attached hereto (the "Combined Parcel"); and WHEREAS, the City Council has determined that the relevant conditions of Resolution 2010-85 have now been met with regards to the Combined Parcel. Resolution No. 2011-45 May 17, 2011 NOW, THEREFORE, BE IT RESOLVED, by the city council of the City of Medina, Minnesota, that the Comprehensive Plan amendment approved by Resolution 2010-85 is hereby adopted and in effect relative to the Combined Parcel, as shown in Exhibit C, attached hereto.
