It is understood that if this permit is granted the builder will at all times comply with the zoning, subdivision, flood control, building, fire, soil
and sedimentation, wetlands, marshlands protection and shore protection ordinances and codes whether local, state or federal, including all
environmental laws and regulations when applicable, subsequent owners should be informed that any alterations to the property must be

This permit must be posted in a conspicuous location in the front of building and protected from the weather. If this permit is not posted work

work has begun within six months of the date of issuance.

Re: Letter of Acknowledgment (LOA), Shore Protection Act Permit 169, 19th Street
Dune Crossover, City of Tybee Island, Chatham County, Georgia
Dear Mr. Carpenter:
This Letter of Acknowledgement (LOA) is in response to your request dated March 29th, 2012 to
perform maintenance on the existing crossover located at the eastern end of 19th Street, Tybee
Island, Chatham County, Georgia. Shore Protection Committee Permit #169 authorized the
construction and maintenance of this public access crossover as depicted in the attached plans.
The proposed maintenance includes replacement of pilings as needed, new stringers and new
decking for the existing 19th Street Dune Crossover.
The Department authorizes the maintenance as depicted in the attached plan provided all Best
Management Practices (BMPs) are used to prevent any erosion and sedimentation at the site and
to protect jurisdictional shore areas. No vegetation is to be disturbed beyond the limits of the
project during construction. Any incidental impacts to the dunes or vegetation must be restored
to pre - project vegetated and topographic conditions; any backfilling must be beach quality and
obtained from an upland source and not from the beach. The proposed work will be done from
the crosswalk using hand tools only; no heavy equipment is authorized in connection with this
project. No stock piling of materials is allowed in the dunes. Please contact staff to meet you
on site immediately prior to construction to determine the exact landing of the crosswalk
on the seaward side of the dune.
This LOA is not meant to exempt the above referenced activity from future environmental laws.
This LOA is valid for the above referenced project. Any change in the use, location, dimensions
or configuration of the approved project, without prior notification and approval from this office
could result on the revocation of this permission and in the required removal of the materials and
related structures. This project must comply with all other Federal, State, and local statutes,
ordinances and regulations.

If construction related to this project occurs during turtle nesting season (May 1st and October
3 1St) an individual with a DNR Sea Turtle Cooperators Permit must survey the area of the pilings
and the access to be used by the equipment prior to the work beginning. All sea turtle nests must
be avoided and no heavy equipment may be used within 20' of a nest area.

Standard Operating Procedures
Title: Submerged Lands (Tidal Water Bottoms and Coastal Marshlands) and
Water - Related Easements and Assignments of Such Easements
Number: SPC — 207 (08 -01 -2010)
1. Definitions.
(a) Sovereign Land: Lands owned by the State or lands held in the public trust.
(b) Riparian: Belonging or relating to the bank of a river or stream; of or on the
bank, or belonging or relating to the shore of the sea or other tidal waters.
2. Purpose.
To provide guidance in processing applications by non - governmental entities for
easements or assignments of existing easements over "sovereign land ", i.e.
submerged lands, tidal water bottoms, coastal marshlands, or other riparian parcels,
when the purpose of the easement is not for the construction of railroads, utilities or
pipelines.
3. Policy Statement.
It is standard operating procedure of the State Properties Commission not to seek
the required legislative authorization for non - governmental easements over
sovereign lands unless the easements are for the express purpose of furthering the
construction of railroads, utilities and pipelines.
It is standard operating procedure of the State Properties Commission to decline a
request for assignment to non - governmental entities of existing easements over
sovereign land, except for the purposes of constructing railroads, utilities and
pipelines, unless: 1) The new Assignee is the riparian, fee simple owner of the high-
land adjoining the sovereign lands to which the assignee seeks riparian privileges;
and 2) The requested sovereign lands to be assigned do not extend beyond the
prolongated side boundary lines of the riparian parcel(s) or encroach upon
neighboring riparian parcels; and 3) The sovereign lands to be assigned cannot be
severed, or have not been severed from the aggregate adjoining riparian parcel(s) by
subdivision, transfer or conveyance. Allocation of sovereign lands shall be consistent
with the precedent of Dorroh v. McCarthy, 265 Ga. 750, 462 S.E. 2d 708 (1995) and
1993 Op. Att'y General No. 93 -25.
All 3 requirements in the previous paragraph must be met and all necessary permits,
licenses or authorizations (such as permits required by the Georgia Coastal
Marshlands Protection Act of 1970, the Georgia Shore Protection Act, or the U.S.
Army Corps of Engineers) must first be obtained by the riparian, fee simple owner
prior to the State Properties Commission considering the assignment of an existing
easement in sovereign lands.

4. Procedure.
(a) Applicant will submit to the Deputy Executive Director of the State Properties
Commission at the address below an application letter requesting the
assignment of an existing State Water Bottoms easement.
(b) The application letter shall explain the request, provide any relevant
background, substantiate the applicant's adjacent fee simple ownership, and
attach any required permits /licenses /authorizations referred to in paragraph
#3 of the Policy Statement above.
(c) Supporting documents shall also be attached to the letter and submitted at
that time.
(d) The application and supporting documentation shall include, but not be
limited to:
a non - refundable check made out to the State of Georgia for the
application fee (no fee for residential use applications; $5000 for non-
residential use applications);
the name, address, telephone and other contact information (ex. Email) of
the potential Assignee; all current vesting deed(s) and surveys
demonstrating that the potential Assignee is the riparian, fee simple
owner of all relevant adjacent high -land parcels;
public interest justification as to why the assignment and use of sovereign
lands should be granted; discussion of any alternative use or location
other than the requested assignment;
surveys of existing easement(s) requested to be assigned; surveys and
drawings of the proposed or existing project in the proposed assignment
area, and any other supporting documentation as may be deemed
necessary in the sound discretion of the State Properties Commission to
properly evaluate the application for granting or assigning an existing
easement over sovereign land.

Standard Permit Conditions for Dune Crossovers
Only one crossover structure shall be allowed on a parcel. In considering the design and
routing of a crossover, the shortest route over the lowest area of the dunes shall be plotted
to minimize impacts to the sand sharing system. For new construction, no decks or
viewing platforms will be approved in the jurisdictional area. Previously permitted and
grandfathered structures may be maintained provided they arc serviceable. Additionally,
the applicant requesting the structure must own 1 00% of the private Inds through which
the structure crosses or have the express written permission of the owner.
The following standard conditions shall apply to dune crossovers:
1. The height of the structure shall be at least 36" above the grade of the sand dune and
the width shall be no greater than 6' as measured from the outside posts, to allow for sand
movement or accretion in the dynamic dune field.
2. The terminal point of the crossover shall be seaward of the seaward most dune but
shall not encroach seaward of the ordinary high water line in the active intertidal beach.
3. If the shoreline erodes and the crossover extends seaward of the ordinary high water
line, it will be the responsibility ofthe applicant to move the permitted improvements
back to the dry sand beach, landward of the ordinary high water line.
4. The structure shall begin at the toe of the landward most dune.
S. Heavy equipment is prohibited in the Shore Protection Act jurisdiction. This project
must be constructed using hand tools.
6. Clearing and grading of dunes is not authorized in conjunction with the construction of
this project; stockpiling of materials in the dunes is prohibited.
7. Vegetation may be cleared only for the width of the permitted structure. The
maintenance trimming of jurisdictional vegetation will only be allowed within 6" of the
sides of the structure and 7' high over the structure.
8. No motorized vehicles are permitted on the crossover structure, except for motorized
wheelchairs for handicapped persons.
9. Any sand needed to restore the site to pre - project vegetated and topographic
conditions, or for backfilling, must be beach quality and obtained from an upland source
and not from the beach.
