IPnPROVEMENT OF PORTIODIS OF FLOV7ER STREET IN THE CITY OF LYN��TOOD BY THE REMOVAL OF CERTAIN EXIST- ING IMPROVET�tENTB AND THE CONSTRUCTION OF CEidEDiT CONCRETE CURBB AND CEMENT CONCRETE DRIVE['�AYS AIQD SIDE[�dALKS, AND PLANT-MIXID GUTTERS.' Z�JHEREAB, pursuant to the provisions of Division 4 of the ; ,. Streeta and Highways Cocle, cited as the "Special A�aeesment Investi- gation Limitation and Majority Protest Act of �931.��, the City Council of the Gity of Lynwood has determined that the improvement of.Agnes Avenue, as pro�osed in Resolution No 2338 of said City is feaeible, and that the public interest, convenience and necessity require the improvement substantiall,y as aet forth in said reoort, and WH�REAS, sa,id City Council has found that the lands to be asseased will be able to etand the burden of the proposed aaeees- • ment, NOV1, THEREFORE, BE IT RESOLVED by the City Council of the -_ Gity of Lynwood as follo�rs: ' Section 1: That in the opinion of the City Council of the City of Lyn��rood the public.interest and convenience require and it is the intention of sa.id Cit;� Council to order the follow-� ing work, or improvement, to be done; to-wit: ' The removal of certain existing improvements including trees; drive�,�ays, curbs, and sidewalka and the conatrtzction of cement concrete curbs, cement concrete drivewaya and sidewalks, ,' and plant-mixed gutters in certain portions of F'lower 3treet lying , between the westerl,y line of Long Beach Boulevard and the center � line,of Peach Street including portions of.intersecting streets. All of sa.id work or improvement shall be performed in the public waya and between the limita hereinbefore designated except where the plans ind.icate that said work shall be omitted, That all of the vtork or improvement aforesaid shall be done and performed in accordance wit� and t,o,the grades ahown on -1- :, . . ,, Plans and Specificat'ions No 1951-L-1 on file in the office of the City Clerk.of said City. Said-plans are hereby referred to for a full and complete description of said propoaed work and for the , grades to which the work is to be done and said plans and apecifi-' catlona are by reference made a part hereoP and shall govern for all details of the proposed work. That the total estimated coat of eaid work or improvement is the sum of Seven thousand 8ix hundred ninety-one and 55/100 Do3lars (�7,691.55). That said contemplated work ia of general public benefit and the said City Council hereby determines that forty per cent: (40�) of the cost of said propoaed improvement shall be paid from the general £und of said,:iCity. , Section 2: Triat said contemplated work or improvement, in � the opinion of said City Council is of more than local or ordinary . public benefit, and sa3d City Council hereby determines and declares that the district to be benefited by said tirork, or improvement, and to be asseased to pay the costs and e_xpensea of such work or improve- � raent, ie shown on Plan No, 1951-L-2 on file in the office o-f the City , _ Clerk of said City to �rhich reference is hereby made for a full and complete description of the asaessmerit diatrict. ,. Section 3: The City Council hereby determinea and declares ' that serial bonds shall be iasued in the manner and form provided in Division � of.the Streets and Highways Cbde cited as the "Improvement � Act of 1911", as amended, bearing intereat at the rate of eix per cent per annum to represent each assessment of TUrent.y-five Dollars (�25.00) or over, remaining unpaid for thirty aays after the date of the warrant; sa3d ser2al bonda ahall extend over a period ending nine years from the second day of January next succeeding the next October fifteenth follow- ing their date. Said bonds and intereat tnereon shall be ?�aid at the o£fice of the City Treasurer and the same shall be disbursed by him, a.11 as provided in the said "Improvement Act of 1911�', ae amended. - 2- Section 4: Notice ia hereby given that the provisions of that certain act of the.Legislature oi the State of'California designated as the Streeta and Highwaye Code Divieion �, cited as the "Special Aasessment Investigation Limitation and P�IaSority Protest Act of 1931°, as amended, have heretofore been fully com- plied taith and all the reports required under the provisions of said Act are on Pile in the office of the City Clerk of said City open to public inspection, and may there be examined by all in- terested persons. Section 5: The proceedinga for the aforeeaid vrork, or im- provement, ahall taken under an Act of the Legialature of the Btate of Cali£ornia designated�as the Streets and Highways Code, Division 7 cited as the "Improvement Act of 1911", and amendmenta thereto. Section 6; The City Engineer ia hereby directed to make a diagram of the property affected or benefited by said propoeed work or improvement as deacribed herein and to be assessed to pay the costs and expenses of said work, showing each separate lot, place or.parcel of land and the dimensions oP each such lot, piece or parcel of land -•. and. the relative location of the sa.me to the work, or improvement, pro- posed to be done, all within the limits of aaid assess�ent district, Section 7: The City Engineer, who is the Superintendent. of 5treets, is hereby directed to post noticea of the paeaage o£ thia Resolution in the time, form, and manner required by law. Section 8: Notice is hereby given that on Tuesday, the 18th day of 9eptember, 1951, a.t the hour of 8:00 o!clock p.m., at the • Gouncil Chambers in the City Hall, 11331 Plaza Street, in the City of Lynwood, any and all persona having any ob�ectiona or protests to said proposed wor?c or improvement, or to the extent of the diatrict to be asaeesed or to the grades to tiahich the work ie proposed to be done, may appear before ea.id City Gouncil and show cause ti�rhy said probosed work, or improvement should not be carried out in accordance with this Reaolutlon. -3- .
