I Ll0 /' AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO RECORD A DEED RESTRICTION ON LOT 4, GARDEN VIEW SUBDIVISION SECTION 1, IN THE CITY OF JEFFERSON, MISSOURI. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk are hereby authorized and directed to record a deed restriction on Lot 4, Garden View Subdivision Section 1, in the City of Jefferson as described in the attached "Declaration of Covenants and Restrictions." Section 2. This Ordinance shall be in full force and effect from and after the date of Its passage and approval. Rademan, emaftcr referred to as the Owner, owner of certain land described below: Re Fees $ of needs Fees 552.00 All of Lot 4,Garden View Subdivision Section 1,in the City of Jefferson, Mlssouri,k%( SF L per plat of record in Plat Book 7, Page 45, Cole County Recorder's Office, till it Deputy W' hereinafter referred to as the"Property", for and in consideration of the mutual covenants existing or hereafter to exist between itself and the grantee or grantees of any of the Property, does hereby adopt and place the following covenants and restrictions upon those portions of the Property as set forth below. The Owner must: 1. Designate a riparian buffer consisting of the north bank of the jurisdictional channel, the streambed of the jurisdictional channel, and a strip of land 50 feet wide extending from the south bank of the jurisdictional channel for the purposes of aquatic habitat and wetland protection; 2. Prevent any construction of improvements,mowing,brush-hogging, clear-cutting, burning, grazing, haying, or other activity detrimental to the riparian buffer as designated above, with the specific exception that a paved or unpaved pathway would be allowed to the south of the jurisdictional channel and within the riparian buffer; and • 3. Post the 50 foot wide riparian buffer with appropriate signage designating the area as a wildlife area and designating that the area not be mowed, and maintaining the signs in perpetuity. The restrictions hereby declared and the covenants herein contained shall be restrictions and covenants running with the Property and shall be binding upon the Owner and its successors and assigns.These restrictions and covenants are made for the benefit of any and all persons who now own or who may hereafter acquire any of the Property, and may be enforced by the U.S. Army Corps of Engineers, Kansas City District.
