HomeMy Public PortalAbout06/12/1954Minutes of Meeting of Town Commission of the Town of Gulf Stream,Florida held on Saturday,June 12,1954 at 10 a.m. Page two Mayor Lindsay read a carbon copy of a letter written by the County Engineer on the date of May 24th to the Murphy Construction Company approving Mr. Murphys request for construction of groynes on the Ocean Front in the Town of Gulf Stream, and stating that this approval is contingent upon a similar approval being obtained from the Town of Gulf Stream. The Mayor also read a letter of May 28th,1954 which he had sent, after consultation with Town Counsel, to all Ocean Front Property Owners in the Town of Gylf Stream and he further read a copy of his letter of May 28th addressed to the Murphy Company, copies of both of these letters attached herewith. The Mayor reported that he had received no request from Mr. Murphy for any building permits for groynes. He further reported that he had received several letters from property holders in reply to his letter of May 28th. One letter from Mr. J.D.S.Coleman which in part read as follows: "I am astounded that the Board of County Commissioners would approve such a request without having a public hearing on the same so that property owners whose interest would be affected would have q chance to protest. Having had a great deal of experience with ocean front property during my entire life I am bitterly opposed to any groynes and would go to any lengths including asking for an injunction to protect such action«e also a letter from Mrs. Biggs which he read. The Mayor also read a letter from Mr. Talbot Speer to- gether with copy of his reply. Following the Mayors remarks the whole matter was thoroughly discussed. The letter of April 21,1953 written to the Mayor by the then County engineer Mr. J.M.Boyd was read, copy attached to the minutes. After further discussion it was decided that no action could be taken until we receive from Mr. Murphy or some other Contractor a request for building permits. It was then decided that if said Building Permits are for baffles of 15 feet as described in the then County i Engineer J.M.Boyd's letter of April 21,1953, that building permits } be granted. If however, building permits are requested for the building of groynes other than those described in said letter of April 21st,1953 by J.M. Boyd, the granting of said permits shall be held up until the Comm- issioners are furnished with Engineers reports, satisfying them that no damage will be done to adjacent property, or if such reports cannot be furnished them, building permits be suspended until the matter can Ue further discussed at a meeting of the Town Commission. Dear -Mr. Murphy: There has been filed with the Town of Gulf Strum, a. copy of letter written to you on homy 24, 1954, by Stephen R. hi.ddleton, County Engineer, which letter reads as follows: "This is to advise that the Board of County Commissioners today approved your request for the construction of groynes on the ocean O front in the Town of Gulf o'trerm, in accordance with your request dated :.pril 22, 1954. This rpproval is contingent on n similar approval boing outained from the Town of Gulf Stream." You are advised that under the Ordinances of the Tom of Gulf Stream, you a.re required to file with the Town Clerk an application fur the construction df said proposed groynes covered by your application with the Board of County Commissioners of Palm Beach County. We would approcicte it if you would cccompany your application with plans, specifications and location where the said groynes are to be constructed in the Tom of Gulf stream. :.fter a careful examdnation of your application and specifications have been made, you will then be advised whether or not the 'Town of Gulf Strorm will grant you a permit for the construction of said proposed groynes. The Town-of Gulf stream as a municipality, owns no public beaches or public streets which may be effected or damaged by the construction of said proposed groynes. Lindsay; In reply to your telephone inquiry, no.application has been made to Palm Beach County for a piroval of construction of work recently per- formed at the Gulf Stream Golf Club, consisting of short spur baffles extending reward from the beach bulkhead oceanside of the Club, although Chapter 24789, Florida laws of 1947, provides that such work requires approval of the Board of County Commissioners. Upon the matter being unoff-.cially brought to my attention, I contact :.r. Murphy of The 11urphy Construction Company and informed him of the violation. Mr. Murphy stated that the work done ias zz an experiment only and not considered permanent. I later visited the Club Beach wit] Yr. Murphy and found two spurs extending 15 ft. seaward from the wall constructed xilk of steel sheet pile. These short lengths , although suggestive of a groyne, are not long enoug?, to be classed as a groyne and, in my opinion, do not constitute a serio" s erosion potential to adjacent property in themselves, but certn uey should not bs ex- tjoded. The great danger in a constructionof this kind is that it may possibly induce a desire to extend the baffles to groyne length, or influence others in the area to construct works of greater length, based on the short spurs as a precedent, which wound be detrimental to adjoining property and force an extension of the groyne system southward progressively without end. As the County Board has not been advised of the desire for an approval in bhis instance or officially notified of other property owners ob- jections, the matter has not been officially referred tn me.
