SUBJECT: PLANNING COMMISSION ACTIONS -MEETING OF APRIL 10,2018 RECOMMENDATION: The City Council is requested to receive and file the Planning Commission (Commission) actions from their meeting of April 10, 2018. BACKGROUND: On April 10 , 2018, the Commission held their regularly scheduled meeting . ANALYSIS: The following is a summary of actions taken at the April 10, 2018 meeting : 1. ROLL CALL: Present: Commissioner-Haddad , Vice-Chair Cordes , Chair Marston Absent: Commissioner-None Exc used : Commissioner-Lee, O'Leary 2 . CONSENT CALENDAR The Commiss ion continued the minutes from their regular meeti ng of March 27, 2 018 . City Council May1,2018 Page 2 of 3 3. PUBLIC HEARING A AN APPEAL OF THE COMMUNITY DEVELOPMENT DIRECTOR'S DETERMINATION THAT A ZONING CLEARANCE APPLICATION TO CONVERT AN ACCESSORY STRUCTURE INTO AN ACCESSORY DWELLING UNIT (ADU) IS INCOMPLETE BECAUSE THE PROJECT AS PROPOSED DOES NOT COMPLY WITH STATE ADU LAW OR THE TEMPLE CITY MUNICIPAL CODE The Commission upheld the Community Development Director's determination that the structure is not eligible for conversion to an ADU as proposed in the application. The property is improved with a 1 ,046-square- foot single-story house and a detached 440-square-foot, two-car garage. Attached to the garage is a 360-square-foot storage room that was constructed illegally without a permit. The applicant sought to apply a section of the State ADU law that was in effect at the time he submitted the application that allows for an "existing garage" to be converted to an ADU regardless of the setback. To be eligible for conversion to an ADU, the structure must qualify as an existing structure and must qualify as a garage. Since the structure in question is not permitted it is not considered existing and it is not a garage, It therefore does not meet the States standard for an ADU and was consequently denied. The property is located in the R-1 zone, and is designated as Single Family Residential by the City's General Plan. 4. UNFINISHED BUSINESS-None 5. NEW BUSINESS-None 6. COMMUNICATIONS-None 7. UPDATE FROM THE PLANNING MANAGER Planning Manager Reimers updated the Planning Commission that the commercial and industrial zoning code update will be discussed April 24, and that the residential zoning code will be discussed in May. 8. ADJOURNMENT The Commission meeting was adjourned at 9:05p.m. City Council May 1, 2018 Page 3 of 3 CITY STRATEGIC GOALS: Reviewing the Commission actions of April 10, 2018, furthers the City's Strategic Goals of Citizen Education and Communication. FISCAL IMPACT: This item does not have an impact on the Fiscal Year 2017-18 City Budget.
