CITY OF TEMPLE CITY
CITY COUNCIL
MINUTES
JULY 7, 1987
INITIATION:
1. CALL TO ORDER:
Pursuant to the Agenda posted on July 2, 1987, Mayor
Gillanders called the regular meeting of the City Council to
order at 7:30 p.m. on Tuesday, July 7, 1987.
2 The invocation was given by Reverend Barry Vail of the
Bethlehem Lutheran Church, 5319 Halifax Road.
3 The Pledge of Allegiance to the Flag was led by Mayor Gil -
landers.
4. ROLL CALL:
Present: Councilmen- Atkins, Dennis, Froehle, Swain,
Gillanders
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin,
Community Development Director Dawson, Parks
and Recreation Director Kobett, Public Works
Coordinator Peterson and Julie Estrada of the
Temple City Times.
PRESENTATION: Mayor Gillanders presented a City tile plaque
to Dr. Manual Freitas for 10 years of volunteer service to
the City's annual rabies clinic.
5. CONSENT CALENDAR:
Councilman Atkins moved to approve the Consent Clanedar
items as recommended, seconded by Councilman Swain and
unanimously carried.
A. APPROVAL OFIMINUTES - Regular Meeting of June 16, 1987
Approved as written.
B. ACCEPTANCE OF WORK - CROWN HEATING & AIR CONDITIONING
INSTALLATION OF CITY HALL AIR CONDITIONING CONDENSER
City Council accepted the work performed by Crown Heat-
ing and authorized the City Clerk to file a Notice of
Completion; authorized payment in the amount of $10,782
to Crown Heating; and authorized payment of the 10%
retention in the amount of $1,198 at the end of the
35 -day lien period.
C. RESOLUTION NO. 87 -2722 SALARY SCHEDULE AND PAY PLAN
City Council adopted Resolution 87 -2722, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING A
SALARY SCHEDULE AND PAY PLAN FOR FISCAL YEAR 1987 -88.
D. CONTRACT FOR CURB AND GUTTER REPAIRS
Council approved additional curb, gutter and sidewalk
repairs noted in the staff memo dated June 23, 1987.

E. RESOLUTION NO. 87 -2723 REQUESTING ALLOCATION AND PAYMENT
OF COUNTY AID -TO- CITIES FUNDS
Council adopted Resolution No. 87 -2723 , A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING
AN ALLOCATION AND PAYMENT OF COUNTY AID -TO- CITIES FUNDS
FOR THE MAINTENANCE OF SELECT SYSTEM STREETS.
F. PLANNING COMMISSION ACTION FROM THEIR REGULAR MEETINGS
OF JUNE 23 AND 30, 1987
Council received and filed a memo from the Planning
Commission outlining action taken at the Commission's
meetings of June 23 and 30.
G. ESTATE OF GERALD M. FITZGERALD
City Council established that the principal trust be in
the amount of $160,000; and authorized the temporary
advance of City funds in the amount of $10,000 to pay
related expenses of the trust estate pending receipt of
trust funds in September of 1987.
H. U.S. CONSTITUTION CELEBRATION PARADE - SAN GABRIEL
VALLEY MASONIC CONSTITUTION OBSERVANCE COMMITTEE
Council approved a Parade Permit subject to receiving a
Certificate of Insurance in the amount of $1,000,000;
and designated the parade as a private function.
I. APPROVAL OF FINAL MAP, TRACT NO. 43590: SIX -UNIT RESI-
DENTIAL CONDOMINIUM LOCATED AT 5562 WELLAND AVENUE (H &
S DEVELOPMENT)
City Council approved the CC & R's and map; made find-
ings per staff memo dated June 30, 1987; and instructed
the City Clerk to endorse the face of the map.
J. RENEWAL OF AGREEMENT FY 1987 -88 AUDITING SERVICE
- McGLADREY HENDRICKSON & PULLEN
Council approved the agreement for services to be ren-
dered by McGladrey Hendrickson & Pullen for FY 1987 -88;
and authorized the Mayor to sign the agreement.
K. SET PUBLIC HEARING: APPEAL OF PLANNING COMMISSION
ACTION ON ZONE VARIANCE 87 -835 - 5342 CAMELLIA AVENUE
Council set public hearing regarding an appeal of the
Planning Commission on Zone Variance 87 -835 for July 21,
1987.
L. LEASE OF XEROX COPIER
Council approved a 60 -month lease agreement with Xerox
and authorized the City Manager to sign the agreement.
M. CITY COUNCIL PUBLIC HEARINGS RE: RE- ZONING PER AMENDED
GENERAL PLAN
City Council received and filed the staff memo dated
June 30, 1987 listing the tentative schedule for zone
change hearings.
N. TRAVEL EXPENSES TO SACRAMENTO
City Council approved a standing travel authorization
for Councilmembers attending legislative hearings in
Sacramento.

0. APPRAISAL OF PROPERTY LOCATED AT 9167 LA ROSA DRIVE.
City Council authorized the appraisal of the present
location of Community Disposal Company, 9167 La Rosa
Drive, and the City Corporate Yard at 9229 Pentland
Avenue.
P. CLAIM FOR DAMAGE: NANCY & KENNETH STEINBAUGH
Council denied the subject claim and referred it to
Southern California Joint Powers Insurance Authority.
Q. RESOLUTION NO. 87 -2724: EMPLOYMENT OF BUDGETED PERSON-
NEL
City Council adopted Resolution No. 87 -2724 appointing
budgeted personnel.
R. RESOLUTION NO. 87 -2725: APPROVAL OF PAYMENT OF BILLS
City-Council-adopted Resolution No. -87 -2725 approving
the payment of bills.
6. UNFINISHED BUSINESS:-
A. PUBLIC HEARING: ORDINANCE NO. 87- 609 -UE EXTENDING
ORDINANCE NO. 87- 607 -U IMPOSING A MORATORIUM PERTAINING
TO MULTI - TENANT BUSINESS ENTERPRISES WITHIN A SINGLE
BUILDING OR PORTION THEREOF
City Manager Koski advised that Ordinance No. 87 -607 -U
will expire on July 17. Staff is recommending that the
Ordinance be extended in order to provide ample time to
survey other San Gabriel Valley cities to ascertain the
problems presented by multi- tenant uses and methods used
to mitigate and control inherent and subsequent problems
such as loss of sales tax revenue and violation of
Health and Safety Codes.
Mayor Gillanders declared the public hearing open and
invited anyone wishing to address the City Council on
the matter to come forward. As no wished to speak,
Councilman Atkins moved to close the public hearing,
seconded by Councilman Froehle and unanimously carried.
Councilman Swain moved to waived further reading and
adopt Ordinance No. 87- 609 -UE, AN URGENCY ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY EXTENDING
URGENCY ORDINANCE 87 -607 -U IMPOSING A MORATORIUM UNDER
GOVERNMENT CODE SECTION 65858 PERTAINING TO MULTI - TENANT
BUSINESS ENTERPRISES WITHIN A SINGLE BUILDING OR PORTION
THEREOF, seconded by Councilman Dennis and unanimously
carried.
B. ORDINANCE NO. 87 -608 (2ND READING) CHANGE OF ZONE FROM
C -1 -0 (RETAIL COMMERCIAL OFFICE) AND C -1 -R (RETAIL
COMMERCIAL RESTRICTED) TO C -1 (RETAIL COMMERCIAL)
City Manager Koski stated that, following the Council's
approval of the subject zone change on June 16, the
Planning Commission recommended denial of the zone
change request at their June 23 regular meeting with a
vote of 3 in favor, one opposed and one absent. The
staff memo dated June 30, 1987 serves as the report of
the Planning Commission regarding the subject zone
change in accordance with Government Code Section 65857.
Ordinance 87 -608 is now ready for second reading and
adoption.

Councilman Atkins moved to accept the report of the
Planning Commission; and waive further reading and adopt
Ordinance No. 87 -608, AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY APPROVING A CHANGE OF ZONE
FROM C -1 -0 AND C -1 -R TO C -1 FOR CERTAIN PROPERTIES (ZC
87 -836), seconded by Councilman Dennis and unanimously
carried.
7. NEW BUSINESS:
A. PUBLIC HEARING: APPEAL OF PLANNING COMMISSION ACTION ON
ZONE VARIANCE #87 -833 - 9207 -11 WEDGEWOOD (MAGRO)
City Manager Koski provided background information
stating that the Planning Commission at their June 9
meeting had denied the zone variance request as findings
required to approve the variance could not be made. Mr.
Magro wishes to subdivide two lots into three; however,
the new configuration he proposes would result in two
-lots with-less area. and width-than-required by code.
Councilman Swain moved to include Planning Commission
back -up material as part of the records of City Coun-
cil's public hearing on this matter.
Mayor Gillanders opened the public hearing inviting
those interested in addressing the subject to come
forward.
Cal Magro, 9207 Wedgewood, stated that there is suffi-
cient square footage in the two lots to split into three
lots; however, it would be costly to remove existing
structures in order to meet the code criterion with
respect to lot size. Most lots in the immediate neigh-
borhood have a frontage of 50 feet, and neighbors would
not oppose Mr. Magro's proposed change. It is the
intention of Mr. Magro to continue to reside at 9207
Wedgewood, and to sell 9211 and rent the house he pro-
poses to build at 92n9.
Councilman Atkins advvised Mr. Magro that, if he would
remove part of his carport and relocate the existing
garage, he would then have only one sub - standard lot.
After a brief discussion regarding this plan, it was
recommended to Mr. Magro that he take time to meet with
the Planning Department and redesign the subdivision of
his lots.
Councilman Swain moved to deny the appeal of the Plan-
ning Commission action on zone variance #87 -833; waive
any further costs to Mr. Magro; and request that Mr.
Magro seek the assistance of the Planning Department
with the subdivision of his property, seconded by Coun-
cilman Froehle and unanimously carried.

No one wished to address the City Council.

RECESS TO CRA:
At this time the City Council recessed to meet as the Temple
City Community Redevelopment Agency; approved the Minutes of
June 16, 1987; and adopted Resolution No. CRA 307: Warrants
and Demands. The Minutes are set forth in full in the
records of the Agency.
10. ACTION ON REQUEST BY CRA:
None
11. MATTERS FROM CITY OFFICIALS:
A. BENEFIT ASSESSMENT REPORT RECOMMENDING A $15 MILLION
INITIAL ASSESSMENT TO SUPPORT THE CONSOLIDATED FIRE
PROTECTION DISTRICT
City Manager Koski advised that the County Board of
Supervisors will hold a public hearing on July 23 re-
garding a proposed benefit assessment for fire support
services. The proposed assessment for a single family
home is $15.73 for the first year with subsequent as-
sessments not to exceed double the initial assessment.
Mr. Koski stated that this was a policy matter and the
City Council may, if they desire, take a position on the
matter.
Councilman Swain advised the Council that she had at-
tended a meeting of the County Contract Committee of
California Contract Cities Association at which the Fire
Chief spoke about the finances of the Consolidated Fire
Protection district. The State to provides some bail-
out funds for the fire district, but for the past two
years they have not been increased. Most fire districts
had provided for an assessment some years ago, Los
Angeles County had not. Although speaking as a resident
not a member of the City Council, Councilman Swain felt
that the $15.73 was a small price to pay for the supe-
rior service given Temple City residents by the County
Fire Department.
Fire Chief Harold McCann, stated that the Los Angeles
County Fire Department is spending $49 per capita for
fire protection while cities such as Pasadena, Glendale
and L.A. City spend $82, $89 and $67 respectively. The
proposed assessment is needed as the Department does
have a shortage of approximately $15 million this year;
and, if funds are not made available, it is estimated
that approximately seven fire stations will have to be
closed. Chief McCann advised that at a recent County
meeting Dean Dana made a motion to further study alter-
native sources of income and Supervisor Schabarum is
totally against the assessment.
Councilman Swain moved to support the County Fire De-
partment in their request for the assessment district.
The motion failed for lack of a second.
Councilman Froehle suggested that it might be too early
for the Council to take a stand on the issue as it
appears that even the Board of Supervisors are not in
agreement as to how the funds should be provided.
Councilmen Atkins and Dennis were in agreement with
Councilman Froehle stating that it would appear prema-
ture for a decision to support the proposed assessment
for the Consolidated Fire Protection District.

Councilman Froehle moved to delay making a decision on
the proposed assessment for the Consolidated Fire Pro-
tection District pending receipt of further information
from the County, seconded by Councilman Atkins and
carried on a roll call vote as follows:
AYES: Councilmen- Atkins, Dennis, Froehle
NOES: Councilmen- Swain, Gillanders
B. CODE SECTIONS AND RESOLUTIONS RE: CITY COMMISSIONS
Councilman Atkins suggested that Article XI of the City
Charter state the appointment and removal of members for
all commissions, and the individual code sections could
list the duties for each of the commissions as there
appears to be some inconsistency between the Charter and
the Code with respect to City commissions.
Councilman Atkins moved to request the City Attorney to
review the City Charter, Municipal Code and Zoning Code
as they pertain ,to City commissions and appointment of
commission members, seconded by Councilman Swain and
unanimously carried.
C. ICMA CONFERENCE - MONTREAL, OCTOBER 24 - 29, 1987
Councilman Atkins moved to approve the attendance of
City Manager Koski at the ICMA Conference in Montreal,
Quebec from October 24 to 29, 1987, and authorized the
conference expenses, seconded by Councilman Froehle and
unanimously carried.
D INTERIOR DESIGN SERVICES FOR SENIOR CITIZEN DROP -IN
CENTER
Councilman Swain moved to approve the proposal for
design services from Elia /Landa Design Group, Inc. for
interior design of the Senior Citizen Drop -in Center
located in the Civic Center; authorized the expenditure;
and amend the adopted budget accordingly, seconded by
Councilman Atkins and unanimously carried.
E. PARKWAY TREE REMOVALS RE: LONGDEN AVENUE ET AL IMPROVE-
MENT PROJECT
City Manager Koski stated that Los Angeles County Public
Works inspectors rcommended the removal of four Jacranda
trees located in the parkway area in front of 9521, 9531
and 9537 Longden Avenue. These trees will obstruct
pedestrian sidewalks due to their positions and canted
primary limbs. The trimming and root pruning necessary
to accommodate sidewalk placement would significantly
diminish the trees' stability thereby creating a poten-
tial hazard. Staff concurs with the County's recommen-
dation.
On motion by Councilman Swain, seconded by Councilman
Atkins, it was unanimously carried that a "subsequent
need" to take action arose concerning the trees on
Longden after the posting of the Agenda on July 2.
Councilman Atkins moved to authorize the removal of four
Jacaranda trees located in the parkway on Longden Ave-
nue, seconded by Councilman Froehle and unanimously
carried.

12. ADJOURNMENT:
On motion by Councilman Dennis, seconded by Councilman
Swain, the meeting of the City Council adjourned at 8:35
p.m. The next regular meeting will be held on Tuesday, July
21, 1987.
