HomeMy Public PortalAbout07/03/1954MINUTES OF MEETING OF THE TOWN COMMISSIdN OF THE TOWN OF GULF STREAM, FLORIDA,•HELD AT T E TOWN HALL ON SATURDAY, JULY 3,1954, AT 10:00 A.N. c Mayor Lindsay called to order the recessed meeting of the Town Commission of the Town of Gulf Stream, Florida at the Town Hall and there were present Commissioners, L.Seton Lindsay, S.B. Iglehart and William J. Bauer. Mayor Lindsay called to the attention of the Town Commissioners that this was a regular recessed meeting of the Town Commission and that any and all business which should come to the attention of the Town Commission could be considered. Town Clerk Bauer presented the Town Commission with an Ordinance which had been read the first time in full at a meeting of a Town Commission held on June 12,1954, the title to which Ordinance is as follows: "AN ORDINANCE OF THE TOWN COMMISION OF THE TOWN OF GULF ST =Y,AM; FLORIDA, PROVIDING FOR THE INOCULATION AGAINST RABIES AND LICENSING OF ALL DOGS: PROHIBITING DOGS FROM BEING iN ANY PLACE OF BUSINESS: PROVIDING FOR THE MUZZLING OF ALL VICIOUS DOGS; AND PROVIDING FOR A PENALTY FOR VIOLA ATION OF THIS ORDNANCE." On motion duly made by Commissioner Bauer Commissioner Iglehart, the above entitled second time in full. On motion duly made by Commissioner Bauer issioner Iglehart said Ordinance as read and passed as an 6rdinance of the Town of and on vote the Town Commission approved anoRDINR n7CE' and seconded by Ordinance was read a and seconded by Comm - in full was adopted Gulf Stream, Florida, ;he adoption of said Those voting in favor of said adoption were Commissioners Lindsay, Iglehart and Bauer. On motion duly made, seconded and carried thw Town Clerk was ordered to post a copy of said Ordinance on the bulletin board at Town Hall for the required period of time and file the Original said ordinance in the Ordinance Book of the Town with proper notqtions of the date of the first reading of the Ordinance, the date of the second reading of the Ordinance, the date of the final passage reading and the dates itvas posted as required by law. The Commissioners approved payment of accounts paid by checks numbered 1616 to 1649 of the general account and'; -5 to 7 inclusive of the Water account. Town Clerk Bauer reported bank balances as of June 30,1954 as General Account $4;957.40 Water Account 4;794.41 Depreciation Fund 2,56$.04 refund of A request by Mr. Henry V. Pope fortcost of Water Hydrants he had installed at Bermud#k Heights and Polo Cove was tabled until a full meeting in the fall. After discussion it was unanimously voted that a fee of $5.00 per month be paid to C.W.Ramsey for mowing the grass on the property of the Town of Gulf Stream, The Mayor reported that a litter had just been received from the County Engineer Stephen R. Middleton and he read the letter in full and instructed that a copy be attached to the minutes. He also read a letter received from Engineer James N.Borowski,P.E. and instructed that a copy of that letter be attached to the minutes. The Mayor went on to state that he discussed the matter with the Towns Attorney C.Y.Byrd and that Mr. Byrd felt that in view of the County Commissioners approval we had ample reason to feel that the Building Permit should be issued for the 30 foot baffles in front of Mr. Talbot Speer's property and the Town Clerk was so instructed. Attention: Mr. L. Seton Lindsay, Mayor Dear Mr. Lindsay, June 28,19540 This will acknowledge receipt of your letter of June 15th. as to the basis on which the Board of County Commissioners on May 24,1954, approved the application of Murphy Construction Company to construct certain 30 foot groynes on the ocean beach in Gulf Stream. Three principal considerations entered this action. First, the Board of County Commissioners is required by law to act on such applications; however, in carrying out this duty, the Board does not thus become responsible for beach erosion. Second, approval of the application enables six owners to pro- tect their properties against further damage. Third, the pro- posed construction was of such small scale that the probability of its causing damage to other property seemed remote. With reference to the first consideration outlined above, it is my understanding that before an gpplicant is authorized to actually go ahead with work of this kind, the affected municipality must also approve his application. Information is not at hand as to whether Gulf Stream has received the application in question, but in any event it is hoped that the above will be of assistance in connection with the application in the event it is filed. Dear Sir: Reference is made to our discussion of the installations of groins in the Ocean in front of the T.T.Speer residence and the plans for this proposed work handed to you at that time. Information ifi furnished that a study of the beach con- ditions by the undersigned and several consultations since our dis- cussion lead me to of the opinion that to place groins 30t long at right angles to the bulkhead would not damage the beach properties to the south as far as the Iglehart Residence. As indicated in our discussion I withheld my opinion subject to further thought in the matter. It has xzK been definitely established that the littoral current passes southward in the northern hemisphere and is the carrier of the beach sands from the New England, Middle Atlantic and Southeastern States. These sands are deposited on the Florida Coast wherever there are natural or artificial barriers. Groins as proposed for the Speer Residence are designed to be in- stalled at a low top elevation to allows the deposit of sand with a minimum of scouring around the structure and to allow excess accretion to move on southerly. In view of my study in the matter I heartily endorse the groins as designed and hope that they will be permitted to retard the flow of sand which is continually carrying the sand south at a rapid rate into the Straits of Florida. Time will not be kind to our beaches and the supply of sand to the north is rapidly depleting,; these facts we must face and act accordingly. Very truly yours, JNB : fw signed: James N. The Town Commission of the'oTown of Gulf Stream, Florida met at the Town Hall in the Town of Gulf Stream,'Florida, on July 2nd and from day to day thereafter until July 8th,1954 between the hours of ten o'clock amm. and twelve o'clock a.m.noon, as a Boa rd of Equalizers, to hear and consider an# and all complaints of tax payers, and to receive and equalize values of real estate and improved properties shown on the 1954 Tax Assessment Roll. The Town Clerk presented to the Board a copy of a notice which he had posted on the Town Bulletin Board under date of May Oth, 1954 and that said notice had remained posted on Said Bulletin Board continuasly from May 8th,1954 to July 8th,1954. The Commission ordered a copy of Said Notice attached to these minutes and made a part of the same by reference. The Town Tax Assessors's 1954 Tax Assessment Roll, as presented to the Town Commission, disclosed the following total valuations: Total Value of All Real estate and 9 Improvements for 1954, Total Value of all Real Estate and Improvements 31,$203$96.00 i Homestead exemptions WiAaws " " 1301000.00 Widows 11000.00 " Q500.00 but not counted as total assessed value was I $5000.00 and entitled to Homestead. Lan4s held under Town Tax Sale ertificates none total Value of Real Estate and and Improvements less Homestead- and Widows Exemptions "$1,6$9,$96.00 1,$20,$96.00 After reviewing the Tax Roll and the assessed valuations as shown thereon and submitted to the Town Commission, sitting as a Board of Eoualizers, by the Town Tax Assessor, the following resolution was offered and adopted: WHEREAS, The Town Commission met as a Board of Equalizers at the Town riall in the Town of Gulf Stream; Florida, from the 2nd of July until to and through the 8th of July,1954,and at said meetings heard all complaints by tax payers in reference to the assessed valuations placed on the Assessment Roll by the Town Tax Assessor, and it was further resolved that the Tax Assessment Roll, as prepared by the Tax Assessor, was fair, reasonable and just; and MEETING OF TOWN COMMISSION SITING AS B� RD OF EQUALIZERS pave (2) f Ct WHEREAS, no tax payers appeared before the Board of Equalizers '1' at any time during the days upon which it met for the purpose of hearing complaints and equalizing tax values. NOW THEREFO.RBE , BE IT RESOLVED, that said Tax Assessment Roll for 1954 as submitted by the Town Tax Assessor be, and the same is hereby equalized,-and adjusted as required by law and the same is accepted as being fair, just and equal as to values. On motion duly made, seconded and carried, the above and fore- going resolution was unanimously adopted; having equalized and adjusted the valuations shown on the 1954 Tax Roll the following resolution was adopted: Be It Resolved, that-the 1954 Tax Roll as has this day been revised and equalized , be returned to the Tax Assessor and that the Tax Assessor is hereby instructed and directed by the Town Commission to correct, equalize and fix values on the said Assess- ment Roll as having been equalized by the 'own Commission, and said values shall not be changed. A meeting of the Town Commission of the Town of Gulf Stream Florida sitting and meeting as Board of Equalization, was held at the 'own Hall in the Town of Gulf Stream, Florida, July 1; 1954 at L0: A.M. and there were present at said meeting Commiss- ioners L. Seton Lindsay, S. B. Iglehart and William J. Bauer. Town Clerk Bauer presented to the members assembled a Proof of Publication, which Proof of Publication was furnished by the editor of the Delray Beach Journal, setting forth in substance the following notice: "NOTICE is hereby given Ownerp of property located within the Town of Gulf Stream, Palm Beach Uou *ity, State of Florida, and to the Public, that the Town Tax Assessor has completed the Town Tax Assessment Rolls for the year 1954, and has filed said 1954 Assessment Rolls with the Town Commission of the Town of Gulf Stream, Florida. That the Town Commission of the Town of Gulf Stream will meet on July 1,1954, and on each day thereafted until July 8th,1954 (except Sunday), from ten otclock A.M. to twelve otclock P.M., as a Board of Equalization for the purpose of hearing complaints and receiving testimony as to the value of any property, real or personal, as fixed by the Town Assessor of Taxes, of perfecting, reviewing and equalizing the assessments. On motion duly made, seconded and carried, the Proof of Publi- cation submitted by the Town Clerk was ordered filed and made a part of these minutes of the Board of Equalization. Mayor Lindsay announced that the Board of Equalization was now open for hearing to the public and taxpayers and that anyone having any complaint or desiring to have his values reviewed and equalized with other values would please present in writing or orally such complaints.
