AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A MAJOR
AMENDMENT TO THE FINAL PUD PLAN FOR LOTS A, B, C. D, E, AND I OF THE REPLAT OF
SOUTHGATE SUBDIVISION, SECTION 2, JEFFERSON CITY, COLE COUNTY, MISSOURI,
LOCATED IN THE 1200 BLOCK OF DUANE SWIFT PARKWAY.
WHEREAS, Dora Serrano, owner of the real estate hereinafter described, having submitted to
the City Council a Major Amendment to the Final PUD Plan of said real estate,
being located in Jefferson City, Cole County, Missouri, and more particularly
described as follows: Lots A, B. C, D, E and I, Rapist of Southgate Subdivision,
Section 2, Jefferson City, Cole County, Missouri, and addressed as 1223 through
1237 Duane Swift Parkway(Lots A through D)and 1224-1226 Duane Swift Parkway
(Lot E)and 1232-1234 Duane Swift Parkway(Lot 1); containing 2.45 acres.
WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with, as said property owners submitted to the Planning
and Zoning Commission and City Council a Major Amendment to the Final PUD
Plan for the above referenced property.
• NOW, THEREFORE, BE IT ENACTED BY THE COUN THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Major Amendment to the Final P._ ...an submitted by Dora Serrano on
file as Case No. P06001 In the Jefferson City Planning Division is hereby approved for the above
land referenced herein.
SECTION 2. The following principal land uses are approved for the site: Single-family
attached townhome containing two dwelling units or one single-family detached dwelling.
SECTION 3. Approval is made subject to the following conditions: (1) A single-family
attached townhome containing two dwelling units shall be permitted on each lot in the approximate
location shown on the amended Final PUD Site Plan. Instead of a two-unit townhome, one single-
family detached dwelling may be built on each lot in conformance with RS-2 district regulations;
(2)Compliance with the recommendations and technical corrections of the Engineering Division.
SECTION 4. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan.
SECTION 5. Access: The site will obtain access from Duane Swift Parkway.

DUANE SWIFT PARKWAY TOWNHOMES
December 9, 2005
The owner and developer propose to amend the existing PUD plan by changing
Lots A, B, C, D, B and I to two-unit townhome sites. Originally the plan called for single
family residential in this area. There are two existing single family residences (Lots Il, G
and F.) The owner of the home on Lot H is initiating this request. The subdivision has
multi-family apartments at the northwest corner of the entrance, and with the exception of
the two single family residences, the remainder of the development is two-unit
townhomes.

Background
The subject property is located in ilia Duane Swill Parkway Townhonnes PUD. This development received
Final PUD Plan approval in 1999.The PUD Plan was Iasi amended in 2002 when ilia permitted use of Lois
UU and VV, located immediately cast of the subject property, was changed from single-family residential to
two-family residential.
Nature of Itenuest
The subject property consists of six(6)vacant lots currently approved for single-family detached residential
use.'ilie owner is requesting to change ilia allowed use to two-unit townhomes.if approved,the total number
of dwelling units allowed on ilia six lots would increase from 6 to 12.
• Snroundhrg Uses
Two single-family hones are located in proximity to these lots. One Ironic is located on Lots F and G. The
other home is located on Lot 11 and is owned and occupied by the ownerofilia subject property,Ilia area north
and west is zoned RS-2 Single-family and is undeveloped. Lots to the northeast and cast are zoned forand have
been developed with two-family dwellings. The lots to the south of ilia subject lots are zoned single-fmmily
residential and are vacant.
Analvsls
Access.All lots would obtain access from Duarte Swifl Parkway,a local residential street with 60 feet of right-
of-way and 34 feet of paving.A street has been constructed in front of Lots A,13,C and B but no street has yet
been built in front of Lois D and 1, In fact,the street has not been built south of ilia subject area torn distance
of approxinnalely450 feet.This missing section should be completed as soon as possible to provide an alternate
access in ilia event one side of this looped street were to become impassible.
Trnf rc The estimated traffic from single fmnily homes is 9.6 trips per unit vs,5.9 trips per unit for townhomes
orcondonniniums. Ifapproved,total traffic from the 6 lots is estimated to increase front 58 to 71 trips per day.
Lot Size and Widih.All lots have at least 12,000 sq. fl.of land area and 100 feet of widili which exceeds RD
two-family residential standards of 6,000 sq. ft.and 60 feet of width. Minimum building setbacks will be 10
feel for the side yard and 25 feel for ilia front and rear yard.
Parking. The requirement fora two-familydwelling is 2 parking spaces perdwelling unit. Existing iwo-fafully
dwellings have generally met this with n one-car garage plus one space in ilia driveway for each unit.

• Sidewalks. The subdivision was platted prior to the requirement for sidewalks and no sidewalks exist.
Utilities. Water, natural gas and electric lines can be extended to serve the lots. All lots can be served by
existing sanitary sewer lines. A lire hydrant is located in front of Lot B which is within 300 feet of all orthe
subject lots.
Dminaue. Front lot, driveway and street drainage is provided by the curb and gutter system. Therc are a few
curb drainage inlets and underground stone sewers within certain sections Of the subdivision.
Discussion
The proposal would result in the inter-mingling of additional two-fancily dwellings with two existing single-
family residences. Two-family dwellings can either be built as duplexes(thc lot and both units under single
ownership with one or both units rented out)or as single-family nitached townhomes(units separated by a fire-
resistant vertical party wall with each unit individually owned).The applicant infornied staff that the intent of
requesting two-unit townhonnes is for the express purpose of providing for ownership and not rental of each
unit. Restrictive covenants would address such matters as the mininnun square footage of each unit and
materials used to finish the exterior of the dwellings.
Staff Recommendation
Staff supports approval of the requested amendment,subject to the following conditions;
1. A single-family attached townhome containing two dwelling units shall be permitted on each lot in the
approximate location shown on the amended Final PUD Site Plan. Instead of a two-unit townhome,one
single-family detached dwelling may be built on each lot in conformance with RS-2 district regulations.
2. Compliance with the recommendations and technical corrections of the Miginecring Division.
