I asked David Heery where they came from and he indicated that the stumps came from lot K. I have not and will not allow them to use my property as a dump site and stated that the stumps need to be removed. I have photos of the lots from the past which clearly indicate that there were no trees present greater than a couple of inches in diameter. There has been no soil added or removed from lots L and N and the contour has not been altered. I have no involvement in the construction on Lot K. My only involvement was to help them out my using my lot for parking and staging. I expect it to restored to it's original condition following completion of Lot K. The copy of each that will remain in this office also need to be signed and dated. This will need to be accomplished either before or at the same time the permits discussed below are released. Please use the attached application to apply for after - the -fact permits. Pages 1 and 2 are needed. The normal permit fee for "Clearing & Grading" is $75 as shown on the attached fee schedule. Please also note the fee for "Work Without a Permit." Do not submit any payment with the two permit applications. I have not yet determined if the "Work Without a Permit" fees will be assessed or if the penalties of the Soil Erosion & Sedimentation Control ordinance will be used. It will not be both. This decision will be made when I approve /sign the permit applications. The total amount due will include a fee for the consulting engineer's services. The permits will be prepared ASAP after receipt of the applications. If you choose to email or fax the applications this weekend, the permits could be ready by mid -day Monday. The signatures /dates discussed in paragraph 1 of this email and the applicable fees will be needed when the permits are picked up. 1 Until the permits are released, the o authorized work on Lots J, K and N is , ring of the footings of K which passed inspection earlier today. After the permits have been issued the installation of the BMPs shown on the redlined plans may begin. When the installation is complete please call me to request an inspection. After the BMPs have been accepted by the city, routine work may resume on the Belitskus single - family home. As discussed yesterday, daily maintenance of all BMPs is required. Do not wait until the City does a random inspection and identifies deficiencies for you. I have not verified your reports that no trees were removed during the unpermitted clearings. The 2004 subdivision tree survey needs to be compared to the tree removal permits that have been issued. Do either of you have information about the log shown in the attached DSCNO960 photograph? On June 23rd it was on the top of the pile of vegetation in the container. The tree removal permit for Lot K was picked up May 20th and it was my understanding those trees were removed before the new construction permit was released on June 7th. There's a lot of green vegetation in the photograph. The log seems to be related to the clearings of Lots J and N which were reported to this office on June 21St Jimbo — Two different plans were submitted showing which trees were to be removed on Lot K. Please contact Jerris Bryant ASAP so the permit file will correctly document that phase of work. Her phone number is 472 -5033, but it may be easier if you would visit this office to look at the two plans. I neglected to discuss at yesterday's meeting that when applications for new construction are someday submitted for Lots J and N, the original ground elevations of the 2004 subdivision topographic survey will be converted to NAVD88 and used to determine the natural grades. I offer the following comments in attempt to allow our 2:pm meeting to be more productive and shorter. The first picture shows stockpiled strippings from at least one of the two permitted lots. This was not present at the time I observed the permitted lot stripped and bare. As this south lot was not cleared at that time, there would have been no way to access the rear of this lot without disturbing it. The second pic shows a mini Co. Co's smaller than the permitted 20x40' are allowed where space dictates, which will no longer be the case if: 1) Tybee is presented documentation that either or both of these two lots with current violations are allowed.by the Owner to be used for access and /or laydown areas. 2) A suitable red lined or other acceptable plan is presented to Tybee's satisfaction. As discussed previously, Tybee is open to alternate layouts than 20x40. However, this mini Co, much narrower and shorter is not acceptable. The 6th pic was taken primarily to discuss the Co at the meeting. If the entire length of the lot is to be used for access, an alternate Co configuration is appropriate. The third pic shows deposits of dirt on the roadway that were there before the heavy rains yesterday. The 4th pic shows more earth than previously all the way to the end of the brick street. Due to the amount of dirt and existing buffer further east, my concern is fortunately focused on installation and maintenance of BMP's and not discharges into the state waters. The 5th shows the dumpster on still another lot to the south on an area vegetated. This should be discussed at our meeting and I'll avoid lengthy comments in this correspondence. The pictures clearly show the land was disturbed prior to any BMP's installed. There did appear to be a substandard Co- Construction Exit on the lot to the west of the permitted site that I reviewed plans on. No other BMP's were apparent from the pictures were noted in the pics taken as late as Sunday afternoon. The pics tires show the absence of any ground cover. Prior to the permitted project commencing field operations, dense vegetation covered both the adjacent lot and the one across the street. Prior to last Friday's City and State Code violations, I advised David Heery, the apparent site superintendent, that he should discuss the "bush hogging" he proposed with you. I informed him that I was unaware of the maximum tree size allowed to be cut. Furthermore, I warned him that the failure to avoid equipment tires /tracks from uprooting the vegetative cover would be considered I permitted land disturbance. Additionally. I told David that prior to Tybee concurring with the Co being on adjacent property to serve the permitted site, Tybee would need suitable documentation of agreement between parties. From Tybee's City Code: Land - disturbing activity: Any activity which may result in soil erosion from water or wind and the movement of sediments into state waters or onto lands within the state, including, but not limited to, clearing, dredging, grading, excavating, transporting, and filling of land but not including agricultural practices as described in section 15 -030, subsection 5. The construction of single - family residences, when such construction disturbs less than one acre and is not a part of a larger common plan of development or sale with a planned disturbance of equal to or greater than one acre and not otherwise exempted under this paragraph; provided, however, that construction of any such residence shall conform to the minimum requirements as set forth in O.C.G.A. 12 -7 -6 and this paragraph. For single - family residence construction covered by the provisions of this paragraph, there shall be a buffer zone between the residence and any state waters classified as trout streams pursuant to Article 2 of Chapter 5 of the Georgia Water Quality Control Act. In any such buffer zone, no land- disturbing activity shall be constructed between the residence and the point where vegetation has been wrested by normal stream flow or wave action from the banks of the trout waters. For primary trout waters, the buffer zone shall be at least 50 horizontal feet, and no variance to a smaller buffer shall be granted. For secondary trout waters, the buffer zone shall be at least 50 horizontal feet, but the director may grant variances to no less than 25 feet. Regardless of whether a trout stream is primary or secondary, for first order trout waters, which are streams into which no other streams flow except for springs, the buffer shall be at least 25 horizontal feet, and no variance to a smaller buffer shall be granted. The minimum requirements of subsection (b) of O.C.G.A. 12 -7 -6 and the buffer zones provided by this paragraph shall be enforced by the local issuing authority; Due to denial of illegal action, I've pasted some definitions and other information from State and City websites. Downer 912 695 -7262 1 �%(1) Best management practices as set for i subsection (b) of this Code section shat; required for all land - disturbing activities. Proper design, installation, and maintenance of best management practices shall constitute a complete defense to any action by the director or to any other allegation of noncompliance with paragraph (2) of this subsection or any substantially similar terms contained in a permit for the discharge of storm water issued pursuant to subsection (f) of Code Section 12 -5 -30. As used in this subsection, the terms "proper design" and "properly designed" mean designed in accordance with the hydraulic design specifications contained in the "Manual for Erosion and Sediment Control in Georgia" specified in subsection (b) of this Code section. CONSTRUCTION ACTIVITY means the disturbance of soils associated with clearing, grading, excavating, filling of land, or other similar activities which may result in soil erosion. Additionally, numerous publications provide a condensed version of requirement, such as the following one from the Citizen's Guide to Development in Coastal Georgia By Sustainable Coast. 1. 1) Erosion and Sedimentation Act (Administered by individual local governments or DNR's Environmental Protection Division: EPD) 2. 3. Requires a Land Disturbing Activity (LDA) permit for all sites over 1.1 acres and that no construction or earth disturbing activity be conducted within 25 feet of either side of a stream, canal, lake, or other water of the state as defined in the Act. This 25 -foot no- construction zone is called a streamside buffer or riparian buffer zone. There are certain industrial category exemptions from this law. Single family residences are also exempt from this permit, but are compelled by law to establish standard erosion control practices called Best Management Practices (BMPs). The site owner/builder will be fined for not establishing the erosion control BMPs and for excavating or building within the 25 -foot streamside buffer. In my opinion, inadequate sediment barriers have been installed. Still a lot of sand on the paver road. One large portion of a tree is on top in the 2 dugnpster (pic 960). Attached 2010 photos of the lots. I'll need to c pare the tree survey on the attached plat to the tree removal permits that have been issued for these lots. More work. Below is the penalty section of the Soil Erosion & Sedimentation Control ordinance. I would like to discuss penalties and the process for issuing them with you. Sec. 15 -070. - Penalties and incentives. A. Failure to obtain a permit for land - disturbing activity. If any person commences any land - disturbing activity requiring a land- disturbing permit as prescribed in this ordinance without first obtaining said permit, the person shall be subject to revocation of his business license, work permit or other authorization for the conduct of a business and associated work activities within the jurisdictional boundaries of the local issuing authority. B. Stop -work orders. 1. For the first and second violations of the provisions of this ordinance, the director or the local issuing authority shall issue a written warning to the violator. The violator shall have five days to correct the violation. If the violation is not corrected within five days, the director or the local issuing authority shall issue a stop -work order requiring that land - disturbing activities be stopped until necessary corrective action or mitigation has occurred; provided, however, that, if the violation presents an imminent threat to public health or waters of the state or if the land- disturbing activities are conducted without obtaining the necessary permit, the director or the local issuing authority shall issue an immediate stop -work order in lieu of a warning; 2. For a third and each subsequent violation, the director or the local issuing authority shall issue an immediate stop -work order; and; 3. All stop -work orders shall be effective immediately upon issuance and shall be in effect until the necessary corrective action or mitigation has occurred. 4. When a violation in the form of taking action without a permit, failure to maintain a stream buffer, or significant amounts of sediment, as determined by the local issuing authority or by the director or his or her designee, have been or are being discharged into state waters and where best management practices have not been properly designed, installed, and maintained, a stop work order shall be issued by the local issuing authority or by the director or his or her designee. All such stop work orders shall be effective immediately upon issuance and shall be in effect until the necessary corrective action or mitigation has occurred. Such stop work orders shall apply to all land- disturbing activity on the site with the exception of the installation and maintenance of temporary or permanent erosion and sediment controls. C. Bond forfeiture. If, through inspection, it is determined that a person engaged in land- disturbing activities has failed to comply with the approved plan, a written notice to comply shall be served upon that person. The notice shall set forth the measures necessary to achieve compliance with the plan and shall state the time within which such measures must be completed. If the person engaged in the land- disturbing activity fails to comply within the time specified, he shall be deemed in violation of this ordinance and, in addition to other penalties, shall be deemed to have forfeited his performance bond, if required to post one under the provisions of subsection 15- 050.B.6. The local issuing authority may call the bond or any part thereof to be forfeited and may use the proceeds to hire a contractor to stabilize the site of the land- disturbing activity and bring it into compliance. 3 1. Monetary t a /ties. Any person who violates any pro. Jns of this article, or any pe mit condition or limitation established pursuant to this article, or who negligently or intentionally fails or refuses to comply with any final or emergency order of the director issued as provided in this ordinance shall be liable for a civil penalty not to exceed $2,500.00 per day. For the purpose of enforcing the provisions of this ordinance, notwithstanding any provisions in any city charter to the contrary, municipal courts shall be authorized to impose penalty not to exceed $2,500.00 for each violation. Notwithstanding any limitation of law as to penalties which can be assessed for violations of county ordinances, any magistrate court or any other court of competent jurisdiction trying cases brought as violations of this ordinance under county ordinances approved under this ordinance shall be authorized to impose penalties for such violations not to exceed $2,500.00 for each violation. Without expanding the areas that have already been disturbed, two rows of type C silt fence or its equivalent must now be installed in all areas within 200 -feet of state waters, including the 6 River Oak Lane lot and at the dead end of the lane. Type A is allowed in the areas that are more than 200 -feet from the marshline. It is crucial that no sediment be allowed to discharge into state waters. Michael — Which lot do you own? The first lot (pits 001 & 002) is west of 6 River Oak, and the second (pic 006) is to the south, across the street. No erosion control plans have been reviewed for these lots. No work permit has been issued. No sediment barriers are installed. The first lot has a construction exit that has not been inspected. The second lot is adjacent to marshland. I just got off the phone with Jimbo (cell 663 -0027) of Coastal Constructive Innovations. He said the owner(s) of the lots authorized them to bush -hog. The authorization below from Michael Thomas for parking and staging does not request grading. Removal of the vegetation from the two unpermitted lots is a serious violation. The sand on the paver road is a serious violation. Were any trees removed? Jimbo said he will send a work crew immediately to install sediment barriers. The sand will also need to be swept from the road. I will monitor the site throughout the weekend. Dianne K.
