CITY OF MEDINA RESOLUTION NO.2011-70 RESOLUTION ESTABLISHING ADMINISTRATIVE RULES REGARDING THE DISCHARGE OF FIREARMS WITHIN SENSITIVE HUNTING AREA 1 WHEREAS, the Medina City Council has designated a portion of the City generally located south of Medina Road and east of Hunter Drive as Sensitive Hunting Area 1 pursuant to Section 320.15 of the City Code; and WHEREAS, Section 320.15 authorizes the City to establish administrative rules related to the discharge of firearms and hunting within sensitive hunting areas. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Medina hereby establishes the administrative rules in Exhibit A, attached hereto, and that all hunting and discharge of firearms within Sensitive Hunting Area 1 shall be subject to such rules. Resolution No. 2011-70 August 16, 2011 EXHIBIT A Administrative Rules for Hunting and Discharge of Firearms within Sensitive Hunting Area 1 The Medina city council has established a sensitive hunting area in which special rules apply. The sensitive hunting area is depicted on the attached map. Within the sensitive hunting area, no discharge of firearms or use of deadly weapons shall be allowed except in strict compliance with the following administrative rules: 1. Written perrission from the landowners of all parcels within the setback area specified in Medina code section 320.11 is required prior to issuance of a hunting permit. 2. No trespassing on the land of another, even to retrieve a wounded animal, is allowed without making a reasonable attempt to obtain the permission of the landowner. A reasonable attempt to obtain the permission of the landowner will be satisfied if the hunter makes personal contact with the landowner at the residence or, if the landowner is not present, leaves a written note in a prominent location at the house explaining the time and reason for the intrusion and the identity of the hunter. 3. No firearms may be discharged in such a manner or location as to allow pellets to fall on any property other than that on which the hunting is taking place or on which permission has been received from the owner. 4. The number of hunters allowed on the property at any time is limited to the landowner and up to three guests. 5. Discharge of firearms is limited to the period one-half hour after sunrise to one-half hour before sunset. 6. All hunters are required to pick up a hunting permit personally from the Medina police department. Failure to comply with any pre -conditions will result in denial of a hunting permit. Failure to comply with any other administrative rule will result in revocation of the hunting permit for the remainder of the season if a first violation or revocation of hunting privileges for life in the case of a second violation. Any person denied a permit or whose permit is revoked after issuance may appeal to the city council as provided for in Medina code section 320.13, subd. 5. Nothing in these administrative rules shall be construed as to be contrary to federal or state law regarding the discharge of a firearm or use of a deadly weapon or to authorize the violation of such federal or state law.
