PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR WISSEL President Oler called the meeting to order and the following business was conducted: ROLL CALL Present were: Doug Goss, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Lary Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Lisa Scheib, City Ordinance Violations Clerk; Alisha Estabrook, Park Department; Pat Zochowski; Roger Sieb, Esmond Shoes; John Veach, Veach's Toy Store; Ray and Sharon Ontko, Dox Pop; Vivian & Ralph Himelick, Sanders Jewelers; Kim Vessels, Assistant City Attorney; Police Chief Mark Connery; Police Lt. Donnie Benedict; Fire Chief Jerry Purcell; Dave Burns; Jason Whitney, Center City Development; Tony Foster, Metropolitan Development; Dakota Collins; Tracy Bosell, Street Department; Sandra Spencer, City Controller; Sergeant at Arms; and, Media. APPROVAL OF MINUTES Councilor Hollis moved to approve the minutes of the meeting held July 6, 2015, supported by Councilor Cruse- Nicholson. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • A Neighborhood Conference will be held October 24 to discuss juvenile problems • Fire Fighting 101 Cadet Dillon Moore was introduced as the National Champion in a recent competition • The City has come to an agreement with CSX Railroad to purchase 13.07 acres of land for the consideration of $334,250.00. The City is only required to pay 20% of this purchase price with the obligation of the Indiana Department of Transportation of 80 %. • The Financial program GEMS is running REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the July 2 & 9, 2015, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS None Common Council Minutes July 20, 2015 Page 2 of 6 MISCELLANEOUS BUSINESS • MORRISON REEVES LIBRARY BOARD APPOINTMENT: Councilor Miller moved to approve Dr. Adam Reising as recommended by the MRL Board of Trustees, supported by Councilor Parker. Upon a vote viva voce, the motion carried. • A meeting is scheduled to discuss additional proposed changes to the parking ordinances for timed parking in the downtown area. This meeting will be July 28, 2015, 8:30 am, at the Innovation Center at 814 East Main Street. ORDINANCES ON FIRST READING Councilor Parker moved to suspend the rules and read Ordinance Nos. 43, 44 45, 46, 47 and 48 -2015 2015 on first reading by title only, supported by Councilor Miller. Upon a vote viva voce, the motion passed. ORDINANCE NO. 43-2015 — AN APPROPRIATION (TRANSFER) ORDINANCE AMENDING THE 2015 BUDGET (Street) The Ordinance Violations Ordinance Violations Clerk read Ordinance No. 43 -2015 on first reading by title only. This Ordinance would authorize the transfer of funds within the 2015 Street Department Budget as follows: Delete $34,000.00 from Contractual Concrete Add $34,000.00 to Capital Equipment Delete $85,000.00 from Other Contractual Services Add $85,000.00 to Hot/Cold Mix Supplies Councilor Miller moved to advance Ordinance No. 43 -2015 to second reading and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion carried. Councilor Wissel moved to advance Ordinance No. 43 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. ORDINANCE NO. 442015 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE STAMM KOECHLEIN FAMILY FOUNDATION (Park) The Ordinance Violations Ordinance Violations Clerk read Ordinance No. 44 -2015 on first reading by title only. Common Council Minutes July 20, 2015 Page 3 of 6 This Ordinance would authorize the City of Richmond to submit a grant application to the Stamm Koechlein Family Foundation and to accept said grant funding in an amount up to Five Thousand Five Hundred Dollars and Zero Cents ($5,500.00). If awarded, these funds shall be appropriated for the Parks Department to sponsor the 2016 Summer Outdoor Movie Series. Councilor Parker moved to advance Ordinance No. 44 -2015 to second reading and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion carried. The Ordinance Violations Clerk read Ordinance No. 44 -2015 on second reading by title only. Councilor President Oler declared Ordinance No. 44 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 44 -2015, supported by Councilor Hollis. Upon a vote viva voce, the motion carried. Councilor Wissel moved to advance Ordinance No. 44 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion carved. The Ordinance Violations Clerk read Ordinance No. 44 -2015 on third reading by title only. Ordinance No. 44 -2015 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 45 -2015 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 ( Vandor) The Ordinance Violations Clerk read Ordinance No. 45 -2015 on first reading by title only. This Ordinance is a petition of Vandor Corporation (Industries Road) for a five year tax abatement for Information and Technology Equipment valued at Seventy Five Thousand Dollars and Zero Cents ($75,000.00). The Tax Abatement Committee recommended approval. Councilor Miller moved to advance Ordinance No. 45 -2015 to second reading and read by title only, supported by Councilor Cruse- Nicholson. Upon a vote viva voce, the motion carried. The Ordinance Violations Clerk read Ordinance No. 45 -2015 on second reading by title only. Councilor President Oler declared Ordinance No. 45 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 44 -2015, supported by Councilor Wissel. Upon a vote viva voce, the motion carried. Councilor Wissel moved to advance Ordinance No. 45 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Hollis. ORDINANCE NO. 47 -2015 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA CRIMINAL JUSTICE INSTITUTE (Operation Pull Over) The Ordinance Violations Clerk read Ordinance No. 47 -2015 on first reading by title only. This Ordinance would authorize the City of Richmond Police Department, in cooperation with the Wayne County Traffic Safety Partnership, to submit a grant application to the Indiana Criminal Justice Institute to obtain funds for overtime pay for officers participating in the Operation Pull Over project, outside their current assignments and to accept said grant funding in an amount up to Thirty -five Thousand Dollars and Zero Cents ($35,000.00). Councilor Hollis moved to advance Ordinance No. 47 -2015 to second reading and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion carried. The Ordinance Violations Cleric read Ordinance No. 47 -2015 on second reading by title only. Councilor President Oler declared Ordinance No. 47 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Goss moved for engrossment of Ordinance No. 47 -2015, supported by Councilor Parker. Upon a vote viva voce, the motion carried. Councilor Wissel moved to advance Ordinance No. 47 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. ORDINANCE NO. 48 -2015 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA CRIMINAL JUSTICE INSTITUTE (DUI Task Force) The Ordinance Violations Clerk read Ordinance No. 48 -2015 on first reading by title only. This Ordinance would authorize the City of Richmond Police Department, in cooperation with the Wayne County Traffic Safety Partnership, to submit a grant application to the Indiana Criminal Justice Institute to obtain funds for overtime pay for officers participating in the DUI Taskforce project, outside their current assignments, and, to accept said grant funding in an amount up to Forty Thousand Dollars and Zero Cents ($40,000.00). There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 48 -2015, supported by Councilor Hollis. Councilor Wissel moved to advance Ordinance No. 48 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Dissenting was Councilor Miller. ORDINANCES ON SECOND READING ORDINANCE NO. 36 -2015 — A GENERAL ORDINANCE AMENDING SUBSECTION 74.47 OF RICHMOND CITY CODE The Ordinance Violations Clerk read Ordinance No. 36 -2015 on second reading by title only This Ordinance would allow unlimited parking in Parking Lot "G" — 100 block of South 9"' Street; and, increase the fine for overtime parking in any off street parking facility from $20.00 to $50.00 with no reduction if paid within 72 hours, unless it is a violation of failure to display an annual or monthly parking pass for reserved parking spaces. This fine will remain $10.00. Councilor Parker moved to amend Ordinance No. 36 -2015 to state there will be reduction to $25.00 if the fine is paid within 72 hours, supported by Councilor Hollis. Upon a vote viva voce, the motion carried 8 -1. Dissenting was Councilor Cruse - Nicholson. Councilor President Oler declared Amended Ordinance No. 36 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Miller moved for engrossment of Amended Ordinance No. 36 -2015, supported by Councilor Hollis. Upon a vote viva voce, the motion carried. Councilor Parker moved to advance Amended Ordinance No. 36 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Amended Ordinance No. 36 -2015 was adopted with an 8 -1 roll call vote. Dissenting was Councilor Cruse - Nicholson. ORDINANCE NO. 38 -2015 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1 -12.1 (C.I.T.) The Ordinance Violations Clerk read Ordinance No. 39 -2015 on second reading by title only. This Ordinance is a petition of CIT Realty, LLC for a ten year tax abatement on real estate valued at Three Hundred Twenty Five Thousand Dollars and zero cents ($325,000.00).
