RESOLUTION N0. 2103 RESOLUTION�OF INTEP7TION IN THE MATTER OF THE IMPROVEb4ENT OF ATLANTIC AVENUE IN TAE CITY OF LYNWOOD BY THE INSTALLATIUN OF AN ORNAMENTAL STREET LIGHTING SYSTEM � WHEREAS, pursuant to the proviaions of Division 4 of the Streets arid Highways Code, cited as the "Special Aaseasment Inves- ti�ation Limitation and Ma�ority Proteat Act of 1931", the City Councll of the City of Lynwood has determined that the improvement of Atlantic Avenue, as proposed in Reaolution No. 2094 of saic� City is feasible and that the public intereat, convenience and necessity require the improvement aubstantially as set forth in eaid report, and ti'VHEREAB, Said City Council has found that the lands to be assesaed will be able to atand the burden of the proposed asseasment, NOW, THERF.FORE, BE IT RESOLVED by the City Council of the Ci.ty of Lynwood as followe: SECTION 1: That in the opinlon of the City Council of the Clty of Lynwood the public interest and convenience require and it is the intention of said City Council to order the follov�ing work, or improvement, to be done, to-w.it: ' The construction and installation of an ornamental street , lighting system together with incidental and appurtenant work in ATLANTIC AVENiJE between the northerly line of the Pacific Electric Railway Company's Right of Way and the northerly bound.ary of the City of Lynwood, including portione of intersecting� atreete. All of said work or improvement shall be performed in the public ways and between the limita hereinbefore deslgnated except where the plans indicate that said work ahall be omitted. That all of the work or improvement aforesaid aY�a.11 be done and performed in accordance with and to the grades ehown on -1- Plans and Specifications No. 1948-A-1 on file in the office of the City Clerk of said City. Said plane are hereby referred to for a full and complete deacription of eaid proposed work and for the grades to wnich the work is to be done and said pdans and specifi- cationa are by reference made a part hereof and ahall govern for all detaile of the proposed work. That the estimated coat of said work or improvement is the sum of Sixty Three Thoueand Four Hundred and Thirty-Nine Dollara (�63,439.00). 3ECTZON 2S That said contemplated work or improvement, in the opinion of said C1ty Council is of more than local or ordinary public benefit, and sald Council hereby determines and declarea thP.t the district to be benefited by said work, or improvement, and to be asaessed to pay the costs and expenses of such work or im ment, is ahown on Plan No. 1948-A-2 on file in the office of the City Clerk of said City to which reference ie.hereby made for a full. and complete deacription of the assesament diatrict. , SECTIOAT 3: The City Council hereby determines and declarea that serial bonda shall be issued in the manner and form provided in Division 7 of the Streets and Hi�hways Code cited ae the "Improve- ment Act of 1911", as amended, bearing interest at the rate of six per centum per annum to represent each aseeasment of twenty-flve dollars (�25.00) or over, remaining unpaid for thirty days after the • date of the warrant. Said serial bonds ahall extend over a period ending nlne years from the secbnd day of January next aucceeding the next October fifteenth Pollo�ing their date. Said bonde and interest thereon shall be paid at the office of the City Treaeurer and the same shall be disburaed by him, all ae provided in the said "Improve- ment Act of 1911", as amended. SE�TION 4: Notice ie hereby given that the.provisiona oP that certain act of the Legislature of the State of CaliPornia des- ignated as the Streets and Highwaye Co3e Divielon 4, cited as the -2_ "Special Aasesament Inveatigation Limitation and Ma�ority Protest Act of 1931", as amended, have heretofore been fully complied with and all the reports required under the provisiona of said Act are on file in the office of the City Clerk of said City, open to public inepection, and may there be examined by all intereeted peraona. SECTION 5: The proceedinge for the aforesaid work, or improvement, shall be taken under an Act of the Legislature of the State oP California deaignated as the Streets and Highways �ode Bivision 7 cited as the "Improvement Act of 1911", and amendmente thereto. � SEGTIUN 6: The City Engineer is hereby directed to make a diagram of the property affected or benefited by said propoaed work or improvement as described herein and to be asseesed. to pay the costs and expenaea of said work, ehowing each separate lot, p3ece or parcel of land and the dimensions of each auch lot, piece or par- cel of land and the relative location of the same to the work, or improvement proposed to be done, all within the limita of said asseea- roent district. SECTION 9: The City Engineer, who is the Superintendent of Streeta, is hereby directed to.poat noticea of the passage of this reaolution in the time, form and manner required by law. SECTION 8: Notice ie hereby given that on Tuesday, the 4th day of,�ay, 1948, at the hour of 8:00 o'clock P. M„ at the m Council Chambera in the City Hall, 11331 Plaza Street, in the City of Lynvrood any and all peraone having any objectiona or proteats to said proposed work or improvement, or to the extent of the district to be assessed or to the grad.es to which the work is proposed to be done, may appear bePore said City Council and show cauae,why said . proposed work, or improvement, ahould not be carried out in accordance with this Resolution. _3_ SECTION 9: The City Clerk ehall certify to the passa�e of this Resolution by the City Council of said City of Lynvaood and cause the eame to be published twice in the Lynwood Prees, a weeklq newspaper published and circulated in said City and hereby deei�nated by eaid City Council for the purpose aforesaid. Said Clerk is also direeted to mail notices of the adoption of thie Resolution of Zntention in the time, form, and ma.nner, and to the persons, all as provided in aaid "Improvement Act of 1911'�, as amended. .
