RESOLUTION N0. 2108 REBOLUTION OF INTENTION IN THE MATTER OF THE IA4PROVEMENT OF ATLANTIC AVENUE IN THE CITY OF LYNVr'OOD BY THE CONSTRUCTION OF CEMENT CONCRETE SI DEUVALKS . WHEREAS, pursuant to the proviaions of Division 4.of the Streets and Highways Code, cited as the "3pecial Aaseasment Invea- . tigation Limitation and Ma�ority Proteat Act of 1931", the City � Council of the City of Lynwood has determined that the improvement of Atlantic Avenue ae propoaed in Resolution No. 2095 of said City Council, is feasible and tha.t the public interest, convenience and necessity require improvement aubetantially ae eet forth in said report, and WHEREAS, said City Council hrxe found that the lande to be aasessed will be able to stand the burden of the proposed asaeaement, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynvrood as follovra: SECTIOId 1: That in the opinion of the City Council of the City of Lynwood the publie intereat and convenience require and it is the intention of said City Council to order the following work, or improvement, to be done, to-c�it: The conatruction of cement concrete sidewalka together with incidental and appurteriant work in certain portiona of,the weaterly side of Atlantic Avenue between the eoutherly line of San- born Avenue and the center line of Shirley Avenue including portione oP intersecting atreeta. All of said work or improvement ahall be performed in the public ways and between the limita hereinbefore designated except where the plana indicate that said work ehall be omitted. That all of the work or improvement aforesaid ahall be done and perPormed in accorriance with�and to the grades shown on plan 1948-E-1 _1_ n . � on file in the oPfice of the City Clerk of said City. Said plans are hereby referred to for a fukl and complete deacription of said � proposed vuork and for the grades to which the work is to be done and said plana and specifications are by rePerence made a pa.rt hereoY . and shall govern for alI detaila of the proposed work. ` Tha.t the estimated cost of said work or improvement is the sum of Eight Hundred and Ten Dollars•(�810.00). � SECTION 2: That said contemplated work or improvement, in the opinion of said City Council is of more than local or ordinary publie benefit, and said City Council hereby determines and declarea that the diatrict to be benefited by aaid work, or improvement, and to be assessed to pay the coats and expenses of auch work or improve- ment, ia shown on Plan IVo. 194,8-8-2 on file in the office of the City , Clerk of said City to which reference is hereby made for a fuZl and ' complete description oP the assessment�diatrict. SEGTION 3: The City Council hereby determines and declares that serial bonda shall be ieaued in the manner and form provided 1n Division 7 of the.Streets and Highways Code cited as the "Improve- ment Act of 1911", as ainended, bearing interest at the rate oP six per ceritum per annum to represent eaah asseesment of twenty-five dollars (�25.00} or over, remaining unpa,id for thirtq days after the dr�te of the vaarrant. 3aid serial bonda aha.11 extend oner a period , ending nine yeare from the aecond day oP January next eucceeding the , next October fiPteenth following their date. Said bonds and intereat thereon shall be paid at.the ofPice of the City Treasurer and the .. st.inme shall be disbursed`by him, all as provided in the said"improve- � ment Act of 1911", as amended. SECTION 4: Notice ia hereby given that the proniaions of tnat certain act of the Legislature oP the State of California designated as the StreeLa and Hlghways Code Division 4, cited as the ru_ "Special Asseasment Investigation Limitation and T�9a�ority Protest Act of 1931", as amended, have heretofore been fully complied with and all the renorts required under the proviaione of said Act are on Pile in the Office of the City Clerk of said City, open to public inapection, and may there be examined by all interested pereona. SECTION 5: The proceedinga for the aforeeaid work, or improvement, shall be taken under an Act of the Legislature of the State of California deaignated as the Streets and Highwaye Code Division 7 cited as the "Improvement Act of 1911", and amendments thereto. SECTION 6: Phe City Engineer is hereby directed to make a diagram of the property affected or benePited by said proposed mork or improvement ae described herein and to be aeseeaed to pay the coats and expensea of said work, ehowing each aeparate lot, piece or parcel of land and the dimensions oP each such lot, piece or par- cel of land and the relative location of the eame to the work, or impronement propoaed to be done, all within the limita of said assesa- ment diatrict. 5ECTION 7: The City Engineer, who is the Superintendent , of Streeta, is hereby directed to poat notices of the passage of thie reaolution in the time, form and manner required by law, SECTION 8; Notice is hereby given that on Tuesday, the 4th day of May, 1948, at the hour of 8:�J0 o'clock P. �,, at the Council Chambera Sn the City Hall, 11331 Plaza Street, in the City oP Lynwood any and all peraona having any ob�ections or proteets to said propoaed work or improvement, or to the extent of the dietrict to be aesessed or to,the grades to which the work ie propoaed to be done, may appear before said City Council and show cauae why said proposed work, or improvement, ahould not be carried out in accordance with this Resolution. -3- SECTION 9: The City Clerk sha.11 certify to the passa�e of this Resolution by the City Council of said City oP Lyn�vood and • oauae the same to be publiahed twice in the Lynwood Presa, a weekly newapaper published and circulated in said City and hereby desig- nated by said City Council for the purpoae aforesaid. Said Clerk is also directed to mail notices oP the adoption oY thia Reaolution of Intention in the time, form, and manner, and to the persons, all ae provided in said "Improvement Act oP 1911", amended.
