TR'HERrA5, pursuant to the provisions of Division 4 of the Btreet� and Higherays Code, cited as the "Special Assessment Investigation Limitation and P,4a.�ority Proteat:Act of 1931", the City Council of the City of Lynwood has determined that the improvement of Fern�vood t�venue, as proposed in Resolution No. 2099 of said City is feasible and that the public interest, convenience and necesslty require the improvement substentially as aet fortn in s�.id report, and VJHc^,RFAS, said City Council has found that the landa to bz ' asseased will be able to stand the burden of the proposed assessment, NOW, THEREF'ORE, BE IT RE30LVED by the City Council of the C3ty of Lyn�vood as followa: Section 1: That in the opinion of the City Council of tne City of L•ynwood the public intereat and convenience require and it is the intention of said C2ty Council to order the following worL, or improvement, to be done, to-r�it: The construction of cement conerete curbs, guttera, sideevalka and drive�vay approaches alor� the nortnerly side of the northerly road- way of Fernvaood Avenue between the center line of Ernestine Avenue and the center line of Gertrude Drive; � The construction of eement concrete curba, gutters, and drive- r�*ay approaches along the easterly side of Ernestine Avenue between the northerly line of the northerly roadway of Fernv�ood Avenue and the westerly prolongation of the first alley northerly of sQid Fernwood Avenue The construction of cement concrete curbs and gutters along the westerly side of Gertrude Drive between tne northerly iine of the northerl�� roadway of Fern�r�ood Avenue and the easterly prolongation of the eoutnerly line of the first alley northerly of said Fernovood Avenue. All of said work or improvement shall be performed in the public waya and between the limits hereinbefore designated except where the plans indicate that said work shall be omitted. That all of the work or improvement aforesaid shall be � done and perPo*_ in accordance with and to the grades shov�n on _l_ Plana and Specifications No. 1948-D•1 on file in the office of the City Clerk oP said City. Said plana are hereby referred to for a full and complete description of said propoaed work and for the gradea to �hich the work is to be done and eaid plans and specifi- cations are by reference made a pnrt hereof and shall govern for all details of the proposed work, That the estimated coet of said work or improvement is the sum of Two Thousand One Hundred and Forty-three And Ninety-five _ One-hundredths Dollara ($2,143.95), _ , , ' Section 2: That said contemplated work or improvement, in the opinion of said City Council is oF more than local or ordinary publie benefit, and said City Council hereby determines aad declares that the diatrict to be benefited by said work, or improvement, and . to ba,asaessed to pay the costa and expenses of such work or improve- , ment, is.shown on Plan No. 1948-D-2 on file in the office of the City Clerk of said City to which reference ia hereby mad� for a f'ull and aomplete description of the assessment district. Section 3: The Clty Council hereby determines and declarea � that serial bonds shall be issued in the manner and form provided in Division 7 of the Streets and Highways Code cited as the "Improve- ment Act of 1911", aa amended, bearing interest at the rate of six per eentwn per annum to represent each assessment of twentg-five dollars (�25.00) or over, remaining unpaid Por thirty days after the - date of the warrant. Said serial bonds shall extend over a period ending nine years from the second day of Januarg next succeeding the nest October fifteenth following their date. Said bonds and interest thereon ahall be paid at the oPfice of the City Treasurer and the same ahall be disburaed by him, all as provided in"the said "Improve- ment Act of 1911", as,amended. Section 4: Notice i.s hereby given that the provisions-of that certain.eot of the Legislature of the State.of Csllfornia dea- _2_ ' 3gnsted as the 8traets and Highwags Code Dinision 4, cited ss the �"Special Aasessment Investigation Limitation and Majority Protest Act of 1931", as amended, have heretofore been fixlly complied with and sll the reports required under the provisiona of said Act are on file in the office of the City Clark of said City, open to public _ inspection, end may there':be examined by all interested peraons. Section 5: The proceedings for the aPoresaid arork, or improvement, shall be tsken under an Act of the Legislature of the State of California deaignated sa the Streets and Highways Code Division 7 cited as the "Improvement Aat of 1911", and amendments thereto. , Section 6: The City Fligineer is hereby directsd to make „ a diagram of the property affected or benefited by seid propoaed work or improvement sa described herein and to be assesaed to pay the eoats and expenses of said work, showing each separate lot, place or parcel of land and the dimensior►s of eaeh suoh lot, piece or par- cel of land and the relative location of the same to the work, or improvement proposed to be done, all within the limita of said assesa- ment diatrict, " Section 7: The Cit'y Engineer, who is the Superintendent , of Streets, is hereby directed to poat notices of the passage of this resolution in the time, Porm and manner required by lew. � � Seetion 8: Notice is herebg given that on Tuesday, the 15th day of June, 1948, at the hour of 8:00 o'clock P. ffi., at the Council Chambers in the City Hall, 11331 Plaza Street, 1n the City of Lynwood any and all peraona having any ob�ections or proteats to said proposed�work or improvement, or to the extent of the diatrict to be sasessed or to the grades to which the work ia proposed to be done, may appear before said City Council and show cauae why said proposed work, or improvement, should not be carried out in accordance ` v�ith this Resolution. � _ � , , I I - � � Seetion 9: The'City Clerk ahall eertify to the peasage � of this Resolution by the City Council of said City of Lyn�ood and esuas the same to be published twice in the Lgn�ood Preas, a weakly newapaper published and circu�ated in s aid City and hereby designated ;; by said City Council for the purpose aforesaid.
