CALL TO ORDER AND ROLL CALL
Mayor Aymon called the special meeting of the McCall City Council to order at 9:00 a.m.
Mayor Aymon, Council Member Giles, Council Member Nielsen, and Council Member
Sowers all answered roll call. Council Member Holmes was absent.
City staff members present were BessieJo Wagner, City Clerk; Michelle Groenevelt, Community
Development Director; Morgan Bessaw, City Planner; Rachel Santiago, Permit Tech
Planning & Zoning Commission members present were Fallan Fereday, Chair; Steve Clements;
Derek Williamson; Samuel Thompson; Scott Tunnell; Robert Lyons
Additional attendees were Elaine Clegg
WORK SESSION
AB 18-281 Land Use Training - Elaine Clegg, Idaho Smart Growth staff and Boise City
Council member,will provide a 2-hour training session specific to land use.
Elaine Clegg, Idaho Smart Growth staff and Boise City Council Member, provided a 2-hour
training session specific to land use. The topic areas of the training included the role of commission
and governing boards, process and effective review, and decision making as it relates to land use
and planning.
Ms. Clegg covered the following within her presentation:
1. Commissioner qualifications: work well together, well rounded community members with
perhaps some background in planning, objective even in a small town, and have the time
and desire to read the materials and staff reports and participate in the meetings by asking
questions and listening.
2. Roles and expectations:
a.) Council and Commissioners support and understand each other's roles,
Commissioners are advisors, Council are policy makers.Nice to have an orientation
process. Commissioners meeting with key staff and have 2 half day trainings and a
manual.

b.) Planners and other staff are paid technical experts, can make some administrative
decisions like in Boise, sign approval, that are appealable to the commission or
council. They prepare objective staff reports and should present the issues.
c.) Applicants are often community members and have a financial stake and usually
have a professional background and have interest in seeing the project succeed.
d.) Public, not getting paid. May be emotional and have an interest and knowledge of
that particular area. Their job to suggest an acceptable alternative or way to mitigate
the impacts.
e.) Chairs of each committee need to be positive and upbeat, keep people on task and
concisely and clearly preserve decorum.
3. Commission and Council communication should be a regular occurrence. Sometimes
appointing a liaison is helpful. Staff can help mentor the chair. Quarterly meetings between
chairs and vice chairs of each body are a possibility.
4. Require planning commission training and support with a modest budget. Trainings can
cover responsibilities of the position, legal provisions, ethics, meeting procedures, how to
make collective decisions and roles and relationships. Subscribe to planning journals, plan
design website and blog.
Types of Planning Decisions: Legislative, Administrative, Quasi-Judicial
1. Legislative: ex-parte is allowed here, can be lobbied by anyone, examples are zoning
changes or comprehensive plan.
2. Administrative: Plans etc.
3. Quasi-Judicial: Do's and Don'ts, must have a public hearing and the decision must go on
the record. No conflicts of interest, must be un-biased, no ex-parte contacts. If there is a
discussion outside of the hearing make sure to disclose it. No Independent site visits. If a
site visit is important then schedule a meeting for all the commission or council.
Ms. Clegg engaged the group in working through some different scenarios, giving them the
opportunity to work through true life situations learning what their legal parameters are.
Ms. Clegg asked for next steps to success and a better Commission
• Mayor Aymon commented that education on legal issues around decisions would be
helpful
• Commissioner Williamson suggested that every few years have Jerry Mason from AIC
do land use training
• Commissioner Thompson requested more review and prep as a commission. Perhaps
take time to talk to staff about questions or concerns.
• Commissioner Tunnell suggested that perhaps there is a need for more time to review
the information because he's focusing on what might be most contentious. Is it possible
to get some interim information or get it in a format that is easier to disseminate?
Questions from Council to P&Z Commission:
Council Member Nielsen requested that land use code changes exercise an incremental approach.
He would like to see some projecting as to how some changes affect other sections of the code.

There were additional suggestions that perhaps work sessions, getting monthly memo updates, or
maybe an overall roadmap could be helpful, as well as community training on Public Hearings and
the land use issues to help understand the legal issues around land use.
ADJOURNMENT
Without further business, Mayor Aymon adjourned the meeting at 11:11 a.m.
